AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD INITIATING A SYSTEM OF FLEXI-
B ILITY INTO REAR YARD SETBACK REQUIREMENTS.
WHEREAS, it is desirable to initiate a system of flexi-
bility into the rear yard setback requirements in the present
Municipal Code of the City of Bakersfield, and
WHEREAS, it is desirable to bring the rear yard setback
requirements of the City of Bakersfield into conformity with the
rear yard setback requirements of the County of Kern, and
WHEREAS, it is desirable to provide for more appropriate
utilization of existing residential lots when improvements are
developed thereon,
NOW, THEREFORE, BE IT ORDAINED by the C~ncil of the City
of Bakersfield as follows:
SECTION 1.
That Section 17.13o060 of the Municipal Code of the City
of Bakersfield is amended to read as follows:
17.13.060 Rmar yard. There shall be a rear yard behind
every main building of not less than twenty-five (25) feet or
twenty (20) per cent of the depth of the lot, whichever is less,
provided, however, the rear yard may be reduced to five (5) feet
if not more than forty-five (45) per cent of the lot is covered by
buildings or structures.
SECTION 2.
That Section 17.15.060 of the Municipal Code of the City
of Bakersfield is amended to read as follows:
17.15.060 Rear yard. There shall be a rear yard behind
every main building of not less than twenty-five (25) feet or
twenty (20) per cent of the depth of the lot, whichever is less,
provided, however, the rear yard may be reduced to five (5) feet
if not more than fifty (50) per cent of the lot is covered by
buildings or structures.
SECTION 3.
That Section 17.17.060 of the Municipal Code of the City
of Bakersfield ts ~mended to read as follows:
17.17.060 Rear yard. There shall be a rear yard behind
every main building of not less than fifteen (15) feet, provided,
however, the rear yard may be reduced to five (5) feet if not more
than fifty-five (55) per cent of the lot is covered by buildings
or struc Cure s.
SECTION 4.
That Section 17.19.060 of the Municipal Code of the City
of Bakersfield is amended to read as follows:
17.19.060 Rear yard. There shall be a rear yard behind
every main building of not less than fifteen (15) feet, provided,
however, the rear yard may be reduced to five (5) feet if not
more than sixty (60) per cent of the lot is covered by buildings
or structures.
SECTION 5.
That Section 17.52o130 of the Municipal Code of the City
of Bakersfield is amended to read as follows:
17.52.130 Accessory buildings. No accessory buildings
in the R-l, R-2, R-3 or R-4 Zones in excess of 250 square feet in
area shall be located nearer than five (5) feet to any side or
rear property line.
SECTION 6.
This ordinance shall become effective thirty days from
and after the date of its passage°

passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 22nd day of April~ 1963~
