NOTICE OF RIGHT TO APPEAL
Any person may appeal a decision of the Board of Zoning Adjustment. The appeal must be filed in
writing within 10 days from date of the Board’s hearing with the City Council, c/o City Clerk; 1501
Truxtun Avenue; Bakersfield, CA 93301. Appellants, except those within the public notice area,
must include a $675 non-refundable filing fee with the appeal. If all appeals are withdrawn before
the City Council’s meeting, they will not hear the item and the Boards decision will become final.

The City will not issue any permit, license or other approval for a use involved in an application
until after the appeal period has closed. If the City Clerk does not receive an appeal within the 10-
day period, the Board’s decision will become final.

- Conditional Use Permit to construct two 2,280
(Ward 2)
sq. ft. duplexes on a 15,000 sq. ft. site located in a C-1
(Neighborhood Commercial) zone located at 1402 and 1404
Kentucky Street.
Staff Recommendation: Approve
2) File No. 06-0428
- Conditional Use Permit to allow temporary farm
(Ward 7)
animals for 4-H/FFA projects on a 7,500 sq. ft. site located in an R-
1 (One-Family Dwelling) zone located at 1717 Hendricks Lane.
Staff Recommendation: Approve
3) File No. 06-0559
- Conditional Use Permit to allow retail sales and
(Ward 2)
installation of tires and custom wheels at an existing 3,895 sq. ft.
commercial building in a C-1 (Neighborhood Commercial) zone
located at 2730 Brundage Lane.
Staff Recommendation: Approve
B.MODIFICATIONS
File No. 06-0449
1) – A zoning Modification to reduce the required
(Ward 7)
setback along the eastern property line from 50 feet to 18 feet to
permit the construction of 90 foot tall wireless telecommunication
antenna monopalm at an existing retail center zoned C-2 (Regional
Commercial) located at 2710 Ming Avenue.
Staff Recommendation: Approve
