AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING SECTION 12.40.030 OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1o
That Section 12.40o030 of the Municipal Code of the
City of Bakersfield be and the same is hereby amended to read as
fo llows:
12.40.030 Exception for hardship. Not~rithstanding any
other section of tht's chapter, in the event of unnecessary hardship
or results inconsistent with the general purpose of this chapter
result through the strict and literal interpretation and enforcement
thereof in relation to properties which, because of topography~
size~ shape, location~ or other special circumstances, might be
unreasonably or inconsistently affected by the provisions of this
chapter, the Direc.tor of Public Works mny~ upon receipt of
substantial data relative to the property affected~ waive the
provisions of this chapter in respect to construction of curbs,
gutters and sidewalks in RESIDENTIAL ZONES.
SECTION 2.
This ordinance shall become effective thirty days from
and after the date of its passage.
