HomeMy WebLinkAboutORD NO 1517 ORDINANCE NO. 1517 NE~ SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTIONS 5.16.010 AND 5.16o020 OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD REGARDING THE SALE OF BICYCLES. WHEREAS~ the 1963 session of the California Le§islature amended Section 1873 of the Civil Code to permit local Chiefs of Police to auction unclaimed bicycles after they had been held for a period of three months~ and WHEREAS~ there is a shorta§e of space in the police building of the Bakersfield Police Department~ NOW~ THEREFORE. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Section 5.16.010 of the Mun~cipal Code of the City of Bakersfield be amended to read as follows: 5.16o010 Storage of property--Restoration to owner-- Disposition of property held as evidence. All unclaimed personal property in the possession of the Police Department of the City of Bakersfield shall be stored in a safe place for a period of not less than three (3)i months° The Chief of Police shall restore such property to its legal owner upon satisfactory proof of ownership and payment of reasonably necessary costs incurred in the care and protection thereof~ unless such property is held by the Police Department as evidence in a pending case~ in which event it shall be disposed of only on order of the proper court. SECTION 2. That Section 5o16.020 of the Municipal Code of the City of Bakersfield be amended to read as follows: 5.16.020 Auction sale of .property stored three months-- Exceptions--Notic, e in official newspaper. At any time after the expiration of said three (3) months period the Chief of Police shall sell all such unclaimed personal property, o~her than that held as evidence in a pending case, at public auction to the hi,heat bidder.
