AN ORDINANCE ESTABLISHING A DEPARTMENT OF WATER
RESOURCES FOR THE CITY OF BAKERSFIELD, CREATING
THE OFFICE OF DIRECTOR OF WATER RESOURCES AND
PRESCRIBING THE DUTIES OF THE DIRECTOR OF WATER
RESOURCES.
WHEREAS, it appears that the City of Bakersfield m~y
have property rights as a result of the termination of the Bakers-
field Municipal Water District by operation of law, and
WHEREAS, ~here is a need for further study and investi-
§ation of water problems pertaining to the City of Bakersfield,
and
WHEREAS, in order to properly administer any property
rights the City of Bakersfield may have and to adequately study
water problems of the City of Bakersfield, it is necessary to have
an officer of the City of Bakersfield so trained and empowered as
to act in the best interests of the City of Bakersfield, and
WHEREAS, some of the water problems confronting the City
of Bakersfield require i~:.~:.~-diate action in order to preserve the
public property,
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City'of Bakersfield as follows:
SECTION 1.
That Chapter 3.96 is hereby added to the Municipal Code
of the City of Bakersfield to read as follows:
3.96.010 Department of Water Resources Created. There
is hereby established a Departmnent of Water Resources.
3.96.020 Office of Director of Water Resources Created.
There is hereby created the Office of Director of Water Resources
who shall act as head of the Department of Water Resources.
3.96.030 Director of Water Resources=-Method of Appoint-
ment. The Director of Water Resources shall be appointed by the
City Manager. In the absence of appoi~.t~.e, nt of a Director the City
l~=anager shall act as Director.
3.96.040 Duties of Director of Water Resources. The
duties of t/~e Director of Water Resources shall be as follows:
a. Supervise the adm~nistration of the Department of
Water Resources.
b. Conduct surveys and studies of water problems per-
raining to the City of Bakersfield.
c. Prepare reports and present them to ~he City Manager
and City Council from time to ti~ or on request,
d. Supervise and administer any water properties or
rights which the City of Bakersfield now has or may
hereafter acqu/re.
3.96,050 Ordinances in conflict repealed. All
ordinances or parts of ordinances of the City of Bakersfield in
conflict herewith are hereby repealed.
SECTION 2o
Emergency Ordinance. This ordinance is hereby declared
to be necessary for t .... uediate adoption and effect in order to
preserve valuable property rights belonging to the citizen's of the
City of Bakersfield in order to protect property interests which
the City .of Bakersfield has acquired by term~nation of the Bakers-
field Municipal Water District by operation of law.
SECTION 3.
Effective Date. This ordinance shall be effective from
and after February 24, 1964.
