AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADDING SECTION 11.04.775 TO THE
MUNICIPAL CODE OF THE CITY OF BAKERSFI~D.
WHEREAS, that portion of Oak Street between the north
city limit line at California Avenue and the south city limit line,
a line between Bank Street and Verde Street, was relinquished to
City jurisdiction by the State Division of Highways, effective
July 1, 1964; and -
WHEREAS, Section 11.04.090 of the Bakersfield Municipal
Code covers the enforcement with exception of the speed limit
zone; and
WHEREAS, the area in question was zoned for 40 miles per
hour by the State Division of Highways, and
WHEREAS, a survey indicates that the 40 miles per hour
speed limit in this area is a safe and reasonable speed limit for
vehicular traffic;
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield that Section 11.04.775 is added to the Municipal Code
of the City of Bakersfield to read as follows:
SECTION 1.
11.04,775 Speed limit on Oak Street between California
Avenue and Bank Street. A prima facie speed limit of forty miles
per hour is hereby determined and declared to be the prim- facie
speed limit at which vehicles may travel on Oak Street south of
the center line of California Avenue to the south city limits, a
line between Bank Street and Verde Street, 1043.86 feet northerly
of the southwest corner of Section 35, Township 29 South, Range 27
East, Mo D. Bo & M., excepting therefrom the 200 feet of Oak Street
southerly of the North line of Chester Lane.
SECTION 2.
Effective date of Ordinance. This ordinance shall
become effective thirty days from and after the date of its passage.
I HEREBY CERTIFY that the foregoing Ordinance was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 8th day of September, 1964,
by the following vote:
