HomeMy WebLinkAboutORD NO 1534 01~INANCE NO. 1534 ~ SERIES AN ORDINANCE SETTING FORTH CHARGES FOR POLICE REPORTS WI~REAS, ~he Police Department of the City of Bakersfield has been making a charge of fifty-cents for reports prepared by it in conjunction with automobile traffic accidents and crimes, and WHEREAS, said charge does not cover the adminis- trative and material costs for the preparation of copies' of said reports, and WHEREAS, it is desirable to set forth the provis- ions undo-~ which said reports shall be furnished and the cha~ges which will be made. NOW, THE~EW0RE, BE IT ORDAINED by the Council of the 0ity of Bakersfield that Chapter 5.36 is added to the Municipal Code of the City of Bakersfield as follows: SECTION I CHAPTE~ 5.36 CHARGES F(~ PGLICE REPORTS Sections: 5.36.010 In addition to any charges that may othe~ise be provided by law, the Chie£ of Police of the City of Bakers- field shall charge and collect fees for the following services: (a) FoF £~nishing photostatic or other reproductions of tra£fio accident reports. (b) For ftt~nishing copies of photographs taken dtt~- ing the corpse of an investigation of a traffic accident. (c) For £tt~ntshtng photostatic or other reproduc- tions of a crime report. 5.36.020 The charges to be made for the services set out in Section I of this ordinance shall be as follows: (a) For £tt~nfshing photostatic or other reproduc- tions of traffic accident reports .... $2.00 for fttll report; 1.00 for partial report. (b) For furnishing copies of photographs taken during the course of an investigation of a traffic accident .... $2.50 per 8" x 10" photograph. (c) For furnishing photostatic or other reproductions of a crime report .... $2.00 per report. 5.36.030 The fees required herein shall not apply to any depart- ment or agency of the Federal, State, County or Municipal govern- ments or political subdivisions thereof, nor to any public officer, board or body acting in an official capacity. 5.36,040 The proceeds from fees charged hereunder shall be trans- ferred by the Chief of Police, or his authorized deputy, to the office of the Auditor-Controller of the City of Bakersfield for deposit to the general fund. 5.36.050 Ail orders for copies of police records as set forth in this chapter shall be on a cash basis. ~:~en an order has been placed and the required fee has been paid, such order may not be cancelled or the fee ~efunded except in case of clerical error whereby no order was in fact placed for the service. 5.36.060 Nothing contained in this chapter shall be construed as g~anting to any person the right, power or privilege to inspect~ copy, duplicate, read or be advised of the contents of any docu- ment, record or police report ~,hlch in the opinion of the Chief of Police of the City of Bakersfield, or his authorized deputy, is of a confidential nature or concerns a matter still under in- vestigation by the Police Department. The City Clerk shall certify to the passage of this ordinance and cause the same to be published in the manner 8ECTZON This Ordinance shall become effective 30 days from and after its date of passage.
