AN ENEP~qC~ ORDINANCE OF THE CITY OF BAKERSFIELD
ADDING SECTION 13.40.471 TO CHAPTER 13.40 OF THE
MUNICIPAL CODE OF THE CITY OF BAKERSFIELD,
ST~ICTING PE~HTS FOR SIGNS OVER FIFTY FEET IN
~EIGHT WITHOUT PR[OR APPEDVAL OF CITY COUNCIL.
~, an emergency exists, in that large brightly
illuminated signs may, under existing ordinances, be erected in
areas and locations in the City which cause discomfort, annoyance,
loss of property values to surrounding areas, create hazards to
traffic safety, and repugnance to the welfare of the general
public, and
WHEREAS, the City Planning Co~-m%sston and the City
are in the process of formulating a comprehensive slsn ordinance
regulating the design, location, electrification, size and
maintenance of all sJ~ns and sign structures within the City of
Bakers field, and
WHEREAS, the purpose of this ordflmnce is to protect
and preserve life, health, property and the public welfare during
the time necessary to s~udy and enact legislation regnlating signs
within the City of Bakersfield.
NOW~ THEREFOF. E, HE IT ORDAINED by the Council of the
City of Bakersfield as follows:
SECTION 1.
That Section 13.40.471 be added to Chapter 13.40 of the
Municipal Code of the City of Bakersfield to read as follows:
13.40.471 Co..n..struction ~- Approval of city .C~ounc~l. No permit
for any sign exceeding a height of fifty feet from ground level
shall ~; issued without prior ~p~roval of the City Council of the
City of Bakersfield, provided however, that such approval is not
applicable in a D (Architec~u=al Design Zone) or in the CoC (Civic
Center Zone).
SECTION 2.
Th-~s ordf, nance ~s hereby declared to be an emergency
ordinance w~th~n ~e meaning o~ Section 2~ o£ the Charter o~ the
C~ty o£ Bake~.sf~e-ld~ Cal~fornia~ sa-~d ordinance is necessary ~:o
preserve the public l~al~he property and safe~y, and slmll be
effective on and a£ter Hay 2~ 19~§. Th~s ordinance sh~11
tem~nate n~ne~y d~ys after =he ef£ecttve date he~[n.
