~e~n~ Code o~ the S~ate o~ ~[~o~, and
WBEREAS, the Council of the City of Bakersfield did, on
the 23rd day of August, 1965, pass a Resolution being No. 47-65, in
compliance with the provisions of the Annexation of Uninhabited
Territory Act of 1939, and -m~ndments thereto, bein~ Title 4,
Division 2, Part 2, Chapter l, Article $ of the Gover-m-nt Code of
the S~ate of California, specifically describing the boundaries o~
the territory so proposed to be annexed to the City of Bakersfield,
and desi~natin~ such territory by an appropriate name, and setting
Monday, the 20th day of September, 1965, at the hour of eight
o'clock P. M., in the Co--ct1 Chambers of the City Hall, 1501
Truxt~m Avenue, Bakersfield, California, as the day, hour and place
when and where the City Council would hear protests -~de by any
person owning real property within the aforesaid territory, and
WHEREAS, said Resolution was published at least once in
The Bakersfield Californian, a newspaper of general circulation
published in the City of Bakersfield, said publication having been
completed at least four days prior to the date set for said hearing,
in compliance with Section 35310.1 of Che Government Code, and
WHEREAS, at the trine set for hearing protests, no written
protests were filed a~ainst the proposed annexation by any owner
of property within 'the territory proposed to be annexed.
NOW, THEREFOREo 'BE IT ORDAINED by the Council of the City
of Bakersfield, as follows:
SECTION 1.
That the Gouncil of the City of Bakersfield hereby
approves the annexation to and inclusion within the incorporated
l~mtt8 of the City of Bakersfield, of that esr.Cain uninlmbited
territory desi~nated as "Union No. 2"; and it is hereby further
ordained that said territory be and the same is hereby annexed to
said City; that said territory is described as follows:
A parcel o£ land situate in the County of Earn, State of Calt£ornia,
and being a portion of the S.W. 1/4 of Section 20, Township 29 South,
Range 28 East, M.D.M.
o£ that Special Election to annex the Alta Vista Tract area which
was held on Narch 20, 1923, the result o£ which was filed Narch 28,
1923, with the Secretary of State, said Exception No. 1 being
described as the
"F~CEFTION NO. l: Co~-ncing at the southwesterly corner
of said q.u?rter section; running thence northerly, alon~ the westerly
b_oundary line of said quarter section, a distance of 417.42 feet;
the_ncc at a right an~le easterly 417.42 feet; thence at a right
angle southerly 417.42 feet to a point on the southerly boundary
line .o.~.said.qua_~ter section; and thence vesterly~, along said .last
namea Line, 417.42 feet to the point of beginning and containing
4.00 acres of land, more or less.
Said territory, and the proper~y located therein, shall,
upon the completion of the annexation of the same to the City
Bakersfield, be subjected to taxation equally with other property
in the City of Bakersfield to pay the bonded indebtedness of the
City of Bakersfield, described in the aforementioned consent of the
o~ner of property, located therein, the' issuance of bonds to
· represent said indebtedness being provided for in Ordinance No. 893,
Ney Series, in Ordinance No. 950~ New Series, in Ordinance No. 1112~
Ney Series, tn.'.~Edtnaice No; 1229, Ne~ Series, and in Ordinance
No. 1364, Ney Series, all of 8aid City, and any and all other
indebtedness or liability of the City outs~anding or authorized on
.. and after the date of completion of said annexation.
SECTION 2.
T~ts ordinance shall become effective thirty days from
and after the date of its passage.
! HEREBY CERTIFY that the £orego[ng Ordinance vas
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the 20th day of September, 196§,
by the following vote:
