A RESOLUTION OF APPLICATION PROPOSING
PROCEEDINGS FOR ANNEXATION OF TERRITORY TO
THE CITY OF BAKERSFIELD AS ANNEXATION NO. 518
LOCATED NORTH OF PANAMA LANE BETWEEN SOUTH
ALLEN ROAD AND NORD AVENUE. (WARDS 4 & 5).
WHEREAS, the City of Bakersfield desires to propose a change of organization, to wit, the
annexation to the City of Bakersfield of the hereinafter-described territory, pursuant to Section 56654
of the Government Code of the State of California; and
WHEREAS, the proposed annexation territory is within and consistent with the City of
Bakersfield Sphere of Influence boundary; and
WHEREAS, the City of Bakersfield agrees to annex the territory located north of Panama
Lane between South Allen Road and Nord Avenue; and
WHEREAS, the City has agreed to serve the territory upon annexation; and
WHEREAS, the property owner of the territory has consented to annexation; and
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield that it
hereby finds and determines as follows:
1. That the City of Bakersfield hereby proposes the annexation to the City of
Bakersfield of the territory in Exhibit "A" and shown on map marked Exhibit "B" and
adopts the Notice of Exemption in Exhibit "D" for the project attached hereto and
made a part of this resolution as though fully set forth herein, located north of
Panama Lane between South Allen Road and Nord Avenue.
2. That a plan for providing services within the affected territory of the proposed
annexation, in accordance with the provisions of Section 56653 of the Government
Code, is marked as Exhibit "C", attached hereto and made a part hereof as though
fully set forth herein.
3. That this proposal for change of organization, to wit, annexation, is made pursuant to
the Cortese-Knox-Hertzberg Local Government Reorganization Act of 2000, and it is
requested that proceedings be authorized for annexation in accordance therewith.
4. That the reasons for the proposed change of organization are that the owners of the
affected territory desire to receive municipal services from the City of Bakersfield,
and the City desires to receive tax revenues for benefits given and to be given to the
territory proposed to be annexed.
5. That for this proposed annexation territory and the prezoning therefore, an
environmental document was prepared in accordance with State CEQA guidelines
and the City will use the environmental document for the proposed prezoning and
annexation.

6. That the laws and regulations relating to the preparation and adoption of the
environmental document as set forth in the California Environmental Quality Act
have been duly followed.
7. That the territory proposed for annexation as described herein has been determined
to be uninhabited pursuant to Section 56046 of the Government Code.
8. That the territory proposed for annexation as described herein has been determined
to have 100% of the property owners consenting to annexation.
9. That the territory proposed for annexation as described herein is within the City of
Bakersfield Sphere of Influence Boundary.
10. That the Local Agency Formation Commission waive the protest hearing
proceedings pursuant to Part 4, commencing with Section 57000 of the Cortese-
Knox-Hertzberg Local Government Reorganization Act of 2000.
11. That the names of the officers of the City of Bakersfield who are to be furnished with
copies of the Executive Officer's Report and who are to be given mailed Notice of
Hearing, if any, are:

1. What effects, if any, would annexation of this territory have on the existing level of city/district
services (i.e., need for additional emergency service personnel or construction of new facilities,
etc)? The annexation of this territory will have minimal effect on the near term level or capabilitv
of the City to provide needed services. Upon future development, additional police officers would
possiblv be required to maintain the current level of city service. The planned development
includinq public streets or municipal facilities within the territorv will increase the future
maintenance responsibilitv of the City but should not affect the existinq level of service.
2. Would city/district require any upgrading or change in facilities to serve affected territory (roads,
fire hydrants, mains, etc.): If so, would city/district or developer be responsible for financing?
Consistent with City pOlicv and provided Owner/Developer fulfills its obliqations concerninq
formation of a Community Facilities District, City aqrees to initiate and complete the formation of a
Community Facilities District on portions of the property which are desiqnated for residential use
bv the Specific Plan which will levv a tax rate which, when combined with the constitutionallv
allowed property tax rate, will result in a 2 percent property tax rate based on anticipated home
sale prices for the units within the Specific Plan. The facilities to be financed will be reqional in
nature and may include fees and/or infrastructure improvements for the defined facilities.
3. Indicate and explain existing zoning in affected territory. County approved the zoninq
desiqnations for the proposed annexation territory at the time the McAllister Ranch Specific Plan
was approved in November 1993. Existinq County zoninq desiqnations are as follows: E Y2 RS
(Estate Residential, Y2 acre minimum lot size, Residential Suburban combininq) on 143.09 acres;
R-1 cL (Low Densitv Residential, Cluster combininq) on 90.87 acres; R-2 PD (Medium Densitv
Residential, Precise Development combininq) on 303.21 acres; R-3 PD (Hiqh Densitv
Residential, Precise Development) on 159.67 acres; c-2 PD (General Commercial, Precise
Development combininq) on 118.30 acres; c-2 PD PE (General Commercial, Precise
Development and Petroleum Extraction combininq) on 320.10 acres, and DI (Drillinq Island) on
37.61 acres.
4. Indicate and explain proposed prezoning in area. (List effects on present land use that would
occur as a result of annexation such as maintenance of livestock on property, etc.) The City will
adopt an ordinance chanqinq the existinq County zoninq desiqnations to comparable City zoninq
desiqnations. The City's prezoninq actions will result in the followinq: R-1 CL (Low Densitv
Residential, Cluster combininq) to R-1 (one-Familv Dwellinq) on 90.87 acres; R-2 PD (Medium
Densitv Residential, Precise Development combininq) to R-2 PUD (Limited Multiple Familv
Dwellinq, Planned Unit Development) on 303.21 acres; R-3 PD (Hiqh Densitv Residential,
Precise Development) to R-3 PUD (Limited Multiple Familv Dwellinq, Planned Unit Development)
on 159.67 acres; c-2 PD (General Commercial, Precise Development combininq) to c-1 PDc
(Neiqhborhood Commercial, Planned Commercial Development) on 118.30 acres; c-2 PD PE
(General Commercial, Precise Development and Petroleum Extraction combininq) to c-c PcD
PE (Commercial Centers, Planned Commercial Development and Petroleum Extraction
combininq) on 320.10 acres, and DI (Drillinq Island) to DI (Drillinq Island) on 37.61 acres.

List city/district services that area will directly or indirectly benefit from such as decrease in fire
insurance rate, shorter emergency response time, use of community facilities, etc. City Police
should be able to respond in a more timely manner than present County Sheriff services. Parcels
within the incorporated area will connect to available City sewer system, rather than future
residents incurrinq the cost of construction and operation of a separate seweraqe treatment
facilitv bv the McAllister Ranch Irriqation District. As the McAllister Ranch Irriqation District had
vet to secure lonq-term water entitlements, utilizinq water service from the City will provide
qreater certainty and cost of water availabilitv. The present City refuse collection rate is
substantiallv lower than fees County residents now pay to independent companies. No special
assessments or charqes for street sweepinq, leaf collection, street liqhtinq enerqv costs and fire
hydrants are imposed when located within the City's incorporated area. City qovernment also
provides increased political representation for the residents within the corporate limits. The
Developer of the proposed annexation territory will dedicate land and provide fundinq for the City
to construct a new fire station within the annexed territory, also the developer will construct and
dedicate a new librarv facility to the County. The Homeowners' Association will assume the
responsibilitv for all street landscape maintenance, except for the roadway median. Park facilities

will be constructed bv the Developer and dedicated to the City for operation and maintenance
throuqh the City's Consolidated Maintenance District.
6. Please provide the following information relative to city/district and county taxes:
List existing tax rate(s) in area. The existinq tax rates in the area are 1.092253% (Tax Rate Area
061-029) and 1.067273% (Tax Rate Area 061-028) of assessed market value. These represent
the total property tax rates. When annexed a desiqnated percentaqe of the total property tax of
the area will accrue to the City and remainder to the County for providinq health care and social
services. Rate as shown on 2005-2006 County Auditor-Controllers 2005 Lien Date).
7. Would affected area be subject to any bonded indebtedness of the city/district? If so, explain.
No. the tax rate list shows no city bonded indebtedness. nor any bonded indebtedness of the
McAllister Ranch Irriqation District.
8. How will the difference in tax rates affect a property with a market value of $50,000.00?
The property rate will not increase due to annexation and re-assessment will not occur due to
annexation.
9. Is the proposed area subject to a Williamson Act Contract? No. the existinq annexation area is
not subiect to a Williamson Act Contract.
