RESOLUTION NO. 304-04(1)
A RESOLUTION AMENDING RESOLUTION
NO. 304-04 ADOPTING THE MCDONALD
PLANNED SEWER AREA AND MAKING
FINDINGS RELATIVE THERETO.
RECITALS
WHEREAS, on December 15, 2004, City Council adopted Resolution 304-04
adopting the McDonald Planned Sewer Area and setting fees to be charged to the 256
properties contained within the area; and
WHEREAS, the fee per property was set at $4,579.45 per Equivalent Single Family
Dwelling and would increase three percent (3%) per year; and
WHEREAS, as homes connect to the sewer line, they will be assessed this Planned
Sewer Area fee as well as the established sewer hook-up fee; and
WHEREAS, the construction of the sewer line has been delayed and it appears that
the properties will not be able to connect to it before 2007; and
WHEREAS, the fees are unchanged, but the City desires to modify the fee schedule
to set forth the beginning year of collection of the fees as 2007 instead of 2005 and the
ending year as 2031 instead of 2029.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein by
reference,
2, Exhibit "B", which is attached to Resolution 304-04, is abrogated in its
entirety and the Exhibit "B" attached hereto shall replace it.
