A RESOLUTION ADOPTING A CITY
COUNCIL POLICY REGARDING NON-
WARD-BASED APPOINTMENTS TO CITY
BOARDS AND COMMISSIONS
RECITALS
WHEREAS, when vacancies occur on City boards and commissions, the City
Clerk posts announcements requesting interested persons to submit applications to fill
such vacancies; and
WHEREAS, the applications are available at the City Clerk's office and are
downloadable from the City website; and
WHEREAS, the City Council has adopted a procedure to make appointments
when a vacancy is to be filled by the councilmember representing a particular ward; and
WHEREAS, in 1999, the City Council adopted Resolution No, 187-99 to set a
voting policy for appointments which are to be made by the entire City Council; and
WHEREAS, that policy is cumbersome and difficult to apply when there are more
than two nominees for a particular vacancy; and
WHEREAS, the City Council desires to adopt a voting policy which can apply
and resolve issues regardless of how many nominees are being considered and
regardless of how many vacancies are to be filled,
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of
Bakersfield as follows:
1 . The above recitals are true and correct and are incorporated herein by
reference.
2. Each application to fill a vacancy which is timely received by the City Clerk
shall be considered a nominee for the vacancy which is to be filled by the
entire City Council.
3. At a regular City Council meeting, the City Clerk will distribute written
ballots containing the name of all nominees for the vacancy in question.
4. The City Council members will mark their ballot, voting for one nominee
only, indicate their Ward number and return the ballot to the City Clerk.

5. The nominee receiving the most votes cast, regardless of how many
Council members are actually present or actually vote, shall be appointed
to fill the vacancy.
6. If there is a tie for the most votes cast, the mayor shall break the tie by
casting a vote for one of the tied nominees,
7. If there are two or more vacancies to be filled, the City Clerk shall, after
the first vacancy has been filled, follow steps 3 through 6 with the winning
nominee(s) names obliterated from each subsequent ballot.
8. When all voting has been completed, the ballots shall be available for
review,
9. When all voting has been completed, the vice-mayor shall make a motion
to appoint all winning nominees to all vacancies on such boards or
commissions.
10. This resolution only applies to appointments which are not ward-selected
appointments and completely replaces and supplants Resolution No. 187-
99 in its entirety.
