1.54.0S0 Ordinances in Conflict Repealed.
1.54.010 Office of Finance Director Created. There is hereby
created the Office of Finance Director who shall be appointed by
the City Manager. Pursuant to City Charter, the Finance Director
is the Auditor-Controller and in accordance with Section 39, shall
perform the duties of Auditor and Treasurer, in addition to those
set forth herein.
· 1.54.020 Duties and Responsibilities of Office. The Office of
Finance Director shall be responsible for the following:
(a) Duties as Prescribed by City Charter. All duties to be
performed by the Auditor and Treasurer as prescribed by the City
Charter shall be performed by the Office of the Finance Director.
The'delegation of duties within the office shall separate the
custody of monies from the accounting, of monies.
(b) Central Accounfing System. Supervise and be responsible
for the maintenance of a general accounting system for the city;
keep accounts for appropriations contained in the city budget which
will indicate the amount of the appropriation, amount paid therefrom,
the unpaid obligations against it, and the unencumbered balance;
require reports and receipts and disbursements from each receiving
and spending agency of the city government to be made daily or at
such intervals as may be expedient; and other duties as required by
the City Charter, city ordinances, and the laws of the State of
California.
· (c) Treasury Management. Supervise.the collection Of all taxes,
special assessments, license.fees, franchise fees, other revenues of
the city, and to audit such. accounts as are necessary to determine
the amounts due the city from such revenues; have custody of all
invested funds for the city as provided by Charter or State laws.
(d) Central Purchasing Program. Supervise and administer a
central purchasing program for use by any office, department, or
agency of the city government. .'
(e) Financial Reports. Submit to the City Manager for trans-
mission to the City Council, a monthly statement, of receipts and
disbursements and such other financial reports required to indicate
the financial condition of the city.
(f). Annual Financial Statement. Prepare'a complete financial
· .statement and report at the end of each fiscal year.
1.54.030 -Ordinances in Conflict Repealed. All ordinances or parts
of ordinances of the City of Bakersfield in conflict herewith are
hereby repealed.

1.56.010 Creation of Division. There is hereby 'created for the
government of the city a division of the Auditorium Manager's Office
to be known as the Division of Recreation.
1.56.020 Supervision by Auditorium Manager. The Division of
Recreation shal.1 be under the direct supervision of the Auditorium
Manager or his authorized representative.
1.56.030 Officers and Employees. Under the direct supervision of
the Auditorium Manager, all permanent employees of the Division of
Recreation shall'maintain their existing titles and civil service
status.
1.56.040 Duties of Auditorium Manager. The Auditorium Manager
shall direct the administration of the .Division of Recreation, and
it shall be his duty to:
(1) Recommend policies on recreation, service for approval of the
City Council.
(9~) Prepare or cause to be prepared, the annual budget for the
Division of Recreation for approval by the City Council.
(3) Cooperate with other governmental agencies and civic groups
in the advancement of a sound recreational program.
(4) Advise with the City Council on development of recreation
areas, faC'tittles, programs, and services.
(5) Recommend the adoption of standards on areas, facilities,
program, and 'financial support.
(6) Interpret the policies and functions of the Division of
Recreation to the public.
(7) Recommend for employment required personnel as set forth by
the City of Bakersfield and supervise'such personnel in the perfor-
mance of their various duties.

(8) Promulgate rules or regulations for the conduct of activities
within city parks and recreational areas for the preservation of pro-
perty and the Orderly use of the property. "
.1.56.050 Duties of Director. The Director of Recreation shall be
responsible for the administration of the Division of Recreation in
accordance with the policies set forth by the Auditorium Manager.

'1.80.010 Purpose of Chapter--Expenditures. The declared purposes
of this chapter are to provide for the preparation and carrying out of
plans for the civil defense of persons and property within this city
in the event of a disaster, and to provide for the co-ordination of
the civil defense and disaster functions of this city with all other
public agencies and affected private persons, corporations, and organi-
zations. Any expenditures made in connection with such civil defense
and disaster activities, includin~ mutual aid activities, shall be
deemed conclusively to be for the direct protection and benefit of the
inhabitants and property of the City of Bakersfield.
1.80.'020 Definitions--Civil Defense--Disaster.
(1) Civil Defense, 'as used in this chapter, shall mean the pre-
paration for and the carrying out of all emergency functions, other
than functions for which military forces are primarily responsible,
to prevent,, minimize, and repair injury and damage resulting from
disasters. It shall not include, nor does any provision of this
chapter apply to, any condition relating to a labor controversy.
(2) Disaster, as used in this chapter, shall mean actual or
threatened enemy attack, sabotage, extraordinary fire, flood, storm,
epidemic, riot, earthquake, or other similar public calamity.
1.80.030 Civil Defense and Disaster Council Created--Membership.
The Bakersfield Civil Defense and Disaster Council is hereby created
and shall consist of the following:
(1) The Mayor, who shall be chairman.

(2) The Director of Civil Defense and. Disaster, who shall be
vice-chairman.
(S) The Assistant. Director who shall be vice-chairman during
the absence or disability of the Director.
(4) Such Deputy Directors and Chiefs of operating civil defense
and'disaster departments, services, or divisions as are provided for
by resolution pursuant to this chapter.
(§) Such representatives of civic, business, labor, veterans,
professional, or other organizations having an official group or
organization civil defense and disaster responsibility as may be
appointed by the Mayor with the advice and consent of the City Council.
1.~0.040 Same--Powers and Duties. It shall be the duty of the
Bakersfield Civil Defense and Disaster Council, and it is hereby
empowered, to review and recommend for adoption'by the City Council,
civil defense and disaster and mutual aid plans and agreements and
such ordinances and resolutions and rules and regulations as are
necessary to implement such loans and agreements. The Civil Defense
and Disaster Council shall meet upon call of the chairman or in his
absence from the city or inability to call such meeting, upon the
call of the vice-chairman.
1.S0.0§0 Director of Civil Defense and DisastermOffice Createdm
AssistantMPowers and Duties. There is hereby created the Office
of Director of Civil Defense and Disaster. The City Manager shall
be the Director of Civil Defense and Disaster. The Director of Public
Works shall be the Assistant Director of Civil Defense and. Disaster,
and the Chief of Police and Fire Chief shall serve as Deputy Directors
of Civil Defense. The Assistant Director shall perform the duties
and responsibilities of the Director'during the absence or disability
of the Director, and shall.perform such other' duties and responsi-
bilities as may be ordered by the Director. The Director is hereby
empowered:
(1) To request the City Council to proclaim the existence or
threatened existence of a disaster and the termination thereof, if
the City Council is in session, or to issue such proclamation if the
City Council is not in session, subject to confirmation by the City
Council at the earliest practicable time.
(2) To ask and/or.advise the Mayor to reques~ the Governor to
proclaim a state of extreme emergency when in the op.inion of the
Director, the resources of the area or region are inadequate to cop~
with the disaster.
(S) To control and direct the effort of the civil defense and
disaster organiZation of this city for the accomplishment of the
purposes 'of this chapter.

(4) To direct coordination and cooperation between divisions,
services, and'staff of the civil defense and disaster organizations
of this.city and to resolve questions of authority and responsibility
that may arise between them.
(5) To .represent the civil defense and disaster organization of
this city in all dealings with public or private' agencies pertaining
to civil defense and disaster.
1.80.060 Powers of Director During Disaster or State of Extreme
Emergency. In the event of the proclamation of a disaster as herein
provided, or the proclamation of a state of extreme emergency by
the Governor or the State Director of Civil Defense, the Director is
hereby empowered:
(1) To make and issue' rules and regulations on matt'ers reasonably
related to tile protection of life and property as affected.by such
disaster; provided, however, such rules and regulations must be con-
firmed at the earliest practicable time by the-City Council.
(2) To obtain vital supplies, equipment, and such other properties
found lacking and needed for the protection of the life and property
of the people, and bind the city for the fair value thereof, and if
required immediately, to commandeer the same for public use.
(3) To require emergency services of any city officer or employee
and, in the event of the proclamation of a state of extreme emergency
by the Governor in the region in which this city is located, to command
the aid of as many citizens of this community ~s he thinks necessary
in the execution of his duties; such persons shall be entitled to all
privileges, benefits, and immunities as are provided by State law for
registered civil defense, and disaster, worker volunteers.
(4) To requisition necessary personnel or material of any city
department or agency.
(5) To execute all of his ordinary powers as City Manager, all of
the special powers conferred upon him by this chapter or by resolution
adopted pursuant thereto, all powers conferred upon him by any statute,
agreement approved by the City Council, o'r by any other lawful authority,
and in conformity with Section 38791 of the Government Code, to exercise
complete authority over the city and to exercise all police power
vested in the city by the Constitution and general laws.
1.80.070 Civil Defense and Disaster Organization. All officers
and employees of this city, together with those volunteer forces
enrolled to aid them during a disaster, all groups, organizations,
and' persons who may by agreement or operation of laws be charged with
duties incident to the protection of life and property in this city
during a disaster, including persons commandeered under the provisions
of Section 1.80.060 (3), hereof, shall constitute the civil defense
and disaster organization of the City of Bakersfield.
1.80.080 Divisions, Services, and Staff of the Civil Defense and
Disaster Organization. The functions and duties of the Bakersfield
'Civil Defense and Disaster Organization shall be distributed among
such divisions, services, and special staff as the City Council shall
prescribe by resolution.
The City Council shall concurrently with the adoption of
this chapter, adopt a resolution setting forth the form of organization,
establishment, and designation of divisions and services, the 'assign-
ment of function~, duties and powers, the designation of officers
and employees. Insofar as possible, the form or organization, titles,
and terminology shall conform to the recommendations of the Federal
Government 'and the Civil Defense Agency of the State of California.
1.80.090' Unlawful Acts~Penalty. It shall be a misdemeanor,
punishable by a fine of not to exceed five hundred dollars, or by
imprisonment in the County Jail of Kern County, for not' to exceed
six months, or both, for any person during a disaster:
(1) Wilfully to obstruct, hinder, or delay any member of the
civil defense ahd disaster organization in the enforcement of any
lawful rule or regulation issued pursuant to this chapter, or in the
performance of any duty imposed upon him by virtue of this chapter.
(2) To do any act forbidden by any lawful rules or regulations
issued pursuant to this chapter, if such act is of such a nature as
to give, or be likely to give assistance to the enemy, or to imperil
the lives or property of inhabitants of this city, or to prevent,
hinder, or delay the defense or protection thereof.
(3) To wear, carry, or display, without authority, any means of
identification specified by the civil defense and disaster agency of
the Sta~e.
1.80.100 Repeal and Saving Clause. Ordinance No. ??8 New Series
of the City of Bakersfield is hereby repealed; provided, that it is
the intent of the City Council in enacting this chapter that'it shall
be considered a revision and continuation of the ordinance repealed
by this chapter, and the status of volunteers shall not be affected
by such repeal; nor shall civil defense and disaster mutual aid plans
and agreements, rules and regulations or resolutions adopted pursuant
to such re.pealed ordinance be affected by such repeal until amended,
modified, or superseded as provided in this chapter.

2.20.010 Declaration of Legislative Findings and Policy. The
Council of t~ City of Bakersfield finds and declares that there is
a clear and present danger that in the event of war, Bakersfield and
other cities in California may be subject to.enemy attack.
While such attacks are in progress and during the recon-
struction period following such attack, it is vital that the'city
government continue to function in order to preserve law and order
and to continue or restore local services.
In enacting this chapter, the City Council intends to avail
itself to the fullest extent of the powers granted to local, govern,
ments .by Division 7, Article 6 of the Military and Veterans Code of
the State of California.
2.20.020 Definitionsj
(1) DISASTER means a war or enemy caused calamity such as an
enemy attack which renders .unavailable a majority of the Council of
the City of Bakersfield.
(2) UNAVAILABLE means that an officer is either killed, missing,
or so seriously injured as to be unable to attend meetings and
otherwise to perform his duties. Any question as to whether a parti-
cular officer is unavailable shall be settled by the legislative
body of the City of Bakersfield, or any remaining available members
of said body (including stand-by officers who are serving on said
legislative body).
(3) STAND-BY OFFICERS means qualified persons appointed pursuant
to this chapter to hold themselves available to function as incumbents
of the' post for which they have been appointed in case of disaster.

(4). LOCAL AGENCY means counties, cities and counties, cities,
districts, authorities, and other public corporations, and entities
in the State of Czlifornia, whether organized and existing under
charter or general law.
2.20.030 Stand-by Officers--Appointments, Vacancies, Designations.
To provide f~r the continuance of the legislative and administrative
departments of the city, the City Council shall have the power to.
appoint the following stand-by officers: ..
(1)' Three for each Councilman..
(2) Three for the Mayor.
(3) Three for the City Manager.
(4) Three for each Department H~ad.
Such appointments shall be made by a simple majority of
the City Council.
In case a stand-by office becomes vacant because of removal,
death, resignation, or other cause, the City Council shall have the
power to appoint another person to fill said office.
Stand-by officers shall be designated l, 2, and 3 in the
order of their priority of succession to the office.

2.20~040 Qualifications of Stand-by Officers. The qualifications
of each stand-by officer shall be carefully investigated and a summary
of the qualifications of each such officer shall be entered on the
minutes when he is appoi, n~ed.
Consideration shall be given to places of residence and work,
so that for each office for which stand-by officers are appointed,
there shall be the.greatest probability of survivorship. Stand-by
officers may be residents or officers of a local agency other than
that to which they are appointed as stand-by officers. The residence
requirements for officers and employees contained in Section 43 of
the'City Charter shall not apply to stand-by officers.
2.20.050 Oath of Office--Term, Removal. Each stand-by officer shall
take the oath of office required for the officer occupying the office
for which he stands by.
Persons appointed as stand-by officers shall serve in their
posts as stand-by officers at the pleasure of the legislative body
appointing them and may be removed and replaced at any'time with or
without cause. Stand-by officers shall receive no compensation for
the performance of their duties as stand~by officers.

2.20.060 Duties. Each stand-by officer shall have the following
duties:
('1) To inform himself of the duties of the office for which he
is stand-by officer. For this purpose, the officers and em'ployees.
of the city shall cooperate with the stand-by officers.
(2) To keep informed of the business and affairs of the city to
the extent necessary to fill his post competently. .For this purpose,
the city may arrange information meetings, and require attendance.
(3) To immediately report himself ready for duty in the event of
disaster at the place and in the method previously designated by the
city.
(4) To fill the post for which he has been appointed when, because
of disaster, it has become vacant. Stand-by officers No. 2 and 3 shall
substitute in succession for stand-by officer No. 1 in the same way
that said.stand-by officer is substituted in place of the regular
officer. He shall serve until the recovery of the regular officer
from his injuries or the election or 'appointment of a new regular
officer.
2.20.070 Meeting of Legislative Body After Disaster. Th~ City
Council shall meet as soon as possible after a disaster. The place
oi'meeting need not be within the local agency. The meeting may be
called by the Mayor, City Manager, City Attorney, or by a majority
of the available members of the City Council. Should there be only
one member of the City Council available, he may call and hold said
meeting and perform acts necessary to reconstitute the City Council.
2~20.080 Power and Duties at First Meeting. At the first meeting
after the disaster, the City Council shall:
(1) Ascertain the ~amage to the city and its personnel and
property. For this purpose, it s'ha11 have the power to issue sub-
poenas to compel the attendance of witnesses and the production of
records.
(2) Proceed to reconstitute itself by filling vacancies until
there are sufficient councilmen to form a quorum. Should only one
Councilman or the Mayor be available, then he Shall have the power to
reconstitute the City Council.
(3) Proceed to reconstitute the City Council by appointment of
qualified persons to fill vacancies.
(4) Proceed to perform its functions in the preservation of law
and order and in the furnishing of local services.
2.2~.090 Temporary Officers. Should all members of the City Council,
including all stand-by members, be unavailable, temporary officers
shall be appointed as fOllows:
(1) By the Chairman of the Board of Supervisors of Kern County,
and if he is unavailable,
'(2) By the Chairman of the Board of Supervisors of Tulare County,
and if he is unavailable,
(3) By the Chairman of the Board of Supervisors of Fresno County,
and if he is unavailable,
(4) By the ~ayor of the City of Delano, and if he is unavailable,
(5) By the Nayor of the City of Fresno.
2.20.100 Severability. If any section, subdivision, subsection,
sentence, clause, or phrase in this chapter, or the application thereof,
to any persons or circumstance is for any reason held invalid,.the
validity of the remainder of the chapter, or the application of such
provision to other persons or circumstances shall not be affected
thereby. The City Council hereby declares that it would have passed
this chapter and each section, subdivision, subsection, sentence,
clause, or phrase thereof, irrespective of the fact that one or more
sections', subdivisions,.subseotions, sentences, clauses, or phrases,
or the application thereof, to any person or circumstance be held
invalid.

3.14.330 Severability.
S.14.010 Merit Principle. All appointments and promotions with
the class if i%;d service of the city shall be based on merit, effi-
ciency, and fitness to be ascertained so far as practicable by com-
petitive exsm~ination. Employment with the City of Bakersfield shall
be subject to the work performance, compliance with regulations, and
work requirements of the city.
S.14.020 Fair Employment. No appointment to or removal from any
class or position within the city service shall be affected or
influenced in any manner by a consideration of race, creed, religion,
or national origin.
S.14.0S0 City Manager Designated. as Personnel Director. The City
Manager shall be designated as the Personnel Director of the City of

Bakersfield. All personnel transactions shall be subject to approval
of the City Manager. The City Manager shall provide such clerical or
secretarial services to the Civil Service Boards as may be necessary
to carry out their functions.
3.14.040 Personnel Administration. In accordance with Section 17
of the Charter of the City of Bakersfield, no member of the Council
shall, except insofar as is necessary in the performance of the
duties of his office, directly or indirectly take any part in the
appointment, promotion, or dismissal of any. officer or employee in
the service of .the city other than officers or employees, of the
Council. Administration of personnel and. compensation policies shall
be the responsibility of the City Manager as authorized by the Charter
of the City of Bakersfield, the Municipal Code, and the Administrative
'Rules and Regulations, and in conformance with established civil ser-
vice procedures.
3.14.050 Definitions.
(2) Acting Employee shall mean a permanent employee holding a
different position under an acting appointment.
(4) Actual Service shall mean time engaged as a permanent
employee ill the performance of the duties of a position
including leave of absences with pay.
(6) Advancement shall mean a salary increase within the limits
of a salary range established for a class.
(8) Allocation shall mean the assignment of a job to 'a class
or position in accordance with the duties performed and/or
the salary range assigned to a class or position.
.(!0). Appointing Officer/Appointive Power shall mean the Depart-
ment Head or his authorized representative.
(12) Appointment shall mean the acceptance by a person of a
position in city service.
(14). Board shall mean the Civil Service Board of the City of
Bakersfield for the Miscellaneous Departments, Police Depart-
ment, or Fire Department.
(16) Break-in-Serviqe shall mean any interruption in continuous
service, except for approved leave of absences or call to
military service in the Armed Forces of the United States.
(18) Call-Back Time shall mean the time when an employee is
directed by his department or division to return to work to
perform additional services after the normal work period.
(20) City shall mean the City of Bakersfield.
(22) ~--~y Physician shall mean a. medical doctor chosen by each
of the city's civil service boards. "
(24) Civil Service Rules shall mean the rules and regulations
formulated by the Miscellaneous, Police, and Fire Civil
Service Boards.
(26) Class shall mean a group of positions which are sufficiently
alike in general duties and responsibilities to warrant the
use of the same title, class (job) specification, and salary
range, and the application of common standards of selection,
transfer, and promotion.

(28) Class Number shall mean an identification numb.er assigned
to each class (job) specification.
(SO) Class Specification shall mean a written description of a
class or position which includes class t.itle, class number,
a general statement of nature of work, duties, responsibi-
lities: and minimum or desirable qualif, ications.
(32) Class Title shall mean a brief'descriptive designation of
each class or position within the city service.
(34) Classification shall mean the act of grouping a position
or positions into a class.
(36) Compensatory Time shall mean equivalent time off .granted
to an employee for overtime worked or for extra service
rendered.
'. (38) Continuous Service shall mean employment by permanent
employees without interruption except for approved leaves.
of absences. Reinstatement or re-employment does not make
service continuous.
(40) Demotion shall mean the movement of an employee from one
class or position to another class or position having a
lower maximum rate of pay.
(42) Dep;~rtment shall mean a major administrative unit within
the City of Bakersfield.
(44) Discharge shall mean separation from city service for cause.
(46) Disciplinary Action shall mean reprimand, suspension,
reduction in salary, or discharge.
(48) Division shall mean a unit of a department.
(50) Employee shall mean and .include any person who.' has been
employed by a duly authorized appointive power to work for
the City of Bakersfield on a salary, daily wage, or honrly
pay; .and who has not been discharged from such service.
(52) Employee Organization shall mean any organization which
includes employees of the city, and which has as one of its
primary purposes representing such employees in their rela-
tions with the city.
(54) Employment Status shall mean appointment to a position as:
'('l) Acting, (2) Part-time, (3) Permanent, (4) Probationary,
(5) Seasonal, or (6) Temporary employee.
(56) Increment Date shall mean the date at which step adjust-
ment was last made for time-in-grade.
(58) Layoff shall mean separation from a seasonal, part-time,
or permanent position because of work load, economy, lack
of funds, or because the position has been abolished.
(60) Leave of Absence shall mean approval to be absent from
duty with or without pay for a specified' period.
(62) Overtime shall mean time spent by permanent employees, in
excess of normal work periods.
(64) Part-time Employee shall mean.a person 'employed in any
seasonal or permanent position for a daily work period of
less than the normal working day.
(66) Permanent Employee shall 'mean an employee who h'as success-
fully completed his 'probationary period and has been appointed
to permanent civil service statt~.

(68) Personnel Director shall mean the City 5{anager or his
authorized representative.
(70) Position shall mean all classifications of employment
provided by the Compensation Ordinance, whether
occupied or vacant, permanent or seasonal.
(72) Probationary Period shall mean a working test perioa ox
six months duration during which an employee is required
to demonstrate his fitness for the position to which he is
appoint.ed by actual performance of the duties of the posi-
tion.
(74) Promotion shall mean the assignment or reclassification
of an employee from one class or position of another class
or position having a higher salary range.'
(76) Public Safety Employee shall mean Policemen and Firemen.
(78) Reclassification shall mean the changing of a position
from one class to a different class.
(80) Reinstatement shall mean reappointment after a break in
service to a position within a class formerly held.
(82) Salary Range shall, mean specific pay rates assigned to a
class title.
(84) Salary'Schedule shall mean a list of class titles assigned
to specific salary ranges.
486) Salary Step shall mean five salary levels within a specific
salary range in an assigned range number.
(88) Seasonal Employee shall mean employment to a class for
seasonal needs without civil service status.
(90) Section shall mean a unit of a division.
(92) Separation shall mean'Ieaving a position for any reason
and includes transfer and reassignment.
(94) Service shall mean employment by the city.
(96) Suspension shall mean the temporary removal of an employee
from duty.
(98)' Temporary Employee shall mean an employee filling a perma-
nent position without civil service status.
(100) Termination shall mean the separation of an employee from
city service. Termination may be by death, discharge, layoff,
resignation, retirement, or work completion.
(102) Time-in-Grade shall mean the length of time a permanent
employee shall have spent in his class or position.
(104) Time-in-Service shall mean the length of time a permanent
employee has served in continuous city service beginning with
his probationary appointment to a permanent position.
(106) Transfer shall mean the .change of an employee from one
department or division of city service to another.
(108) Unclassified. Service shall mean all elected officers, all
members of boards, commissions, and all temporary and
seasonal employees.
3.14.060 Class Specifications. It shall be the responsibility of
the Personnel Director or authorized represehtative to prepare a
written description of each class or position within the city service.

Such description shall be known as Class Specifications and shall
contain the following sections:
(a) Class Title. A brief and descriptive designation of the
type of work performed.
(b) Nature of Work. A general description of the work and
responsibility of the class or position.
(c) Illustrative Examples 'of Work. Duties of the class or posi-
tion listed ;ts some, but not inclusive, examples of the typical kinds
of work performed.
(d) Desirable Knowledges, Abilities, and Skills. A description
of those factors of education and skill needed for adequate perfor-
mance of the duties of a class or position.
(e) Desirable Experience and Training. A description of the
background of exper.ience and training that would ordinarily 'prepare
an employee ent. ering into a specific class or position.
Necessary special qualifications may be added to a class or
position where the performance of duties require 'a Specific license,
certificate, permit, or skill.
Such class specifications must receive the approval from
the approPriate Civil Service Board and be adopted by the Council
of the City of Bakersfield. New class specifications, m°dification,
or abolishment of existing class specifications may be made upon
the recommen¢lation of the Personnel Director and the appropriate
Civil Service Board with approval of the City Council. Department
Heads may request review or new class specifications, modification,
or abolishment of existing class specifications upon written request
to the Personnel Director.
S.14.070 Reclassification. If determined by the City Manager and
approved by the City Council that the duties and responsibilities of
an employee within a class .are sufficiently like the duties and
responsibilities of a position of another class, the position may be
reclassified to an appropriate position. The. employee affected is
subject to c¢.~rtification of the appropriate Civil Service Board.
S.14.080 Adoption of Civil Service Rules. Rules establishing
equitable and uniform procedures for the conduct of examinations,
certifications, and hearings for employees shall be formulated by
the Miscellaneous, Police, and Fire Civil Service Boards in confor-
mance with the Charter of the City of Bakersfield.
S.14.090 Adoption of Administrative and Departmental Rules. The
City Manager shall establish rules of conduct and discipline as are

necessary through the Administrative Rules and Regulations or direc-
tive. Departments shall adopt operational standards in accordance
with guidelines .established by this Chapter, Administrative Rules and
Regulations, and directives. Such rules and standards shall be made
available to employees.
S.14.100 Employment Constitutes Acceptance of Rules. Acceptance
of city employment constitutes agreement Dy eacl~, employee of the rules
established by the Civil Service Board having authority over his class,
the Administrative Rules and Regulations, and departmental rules.
S.14.110 Appointing Authority. Appointment to all classes or posi-
tions, other than City Manager and City Attorney, and all personnel
transactions shall be sub~ect to approval of the City Manager.
S.14.120 Appointments. Appointments to vacant positions within
the city service shall be made in accordance with the provision' of
the Charter 'of the City of Bakersfield and the rules established by
the Miscellaneous, Police, and Fire Civil Service Boards. Employment
within city service is within the following status:
(1) Acting. Appointment of a permanent employee to a different
position for :~ temporary period of time.
(2) Part-time. Appointment to a permanent position for a
seasonal or set-term position for a daily Work period of less than
the normal working day whether or not on a recurring basis.
(S) Permanent. Appointment to a position within city service
after completion of probation period. . .
(4) Probationary. Appointment from a certified civil service list
to a pos. ition for a test period of six months to demonstrate fitness
for appointment to a permanent, position.
(5) Seasonal. Appointment to a position for a limited term or
seasonal needs under temporary employee status.
(6) Temporary. Appoin.tment for .temporary services, to a. position
within city service without examination or certification of a civil
service board. Temporary employment may not. exceed 120 worki}~g days
within any. one department in any period of one year
S..14.1S0 Nepotism/Appointment of Spouse or'Relative. The employment
of spouse or relatives tends to caus'e problems in sensitive areas of
inter- and in. tra-departmental relationships, and 'can create undesirable
results in connection with evaluation of employees performance and
discipline. The problem of favoritism, whether real or imagined, exists
and has a harmful effect upon employee morale and efficiency.
(1) There shall be no appointments to a salaried position within
the City of Bakersfield of a relative by marriage or blood within the
third degree of any member of the City Council,.Boards, or Commissions
of the city.
(2) There shall be no appointment to a salaried position of any
person who is married to a city employee or lives in the same household..
(3) Appointments of persons who are related, not mentioned in
(1) and (2), to a city employee may be approved if the appropriate
.Board. determines that a conflict does not or will not exist.
These rules do not affect present employees.
3.14.140 Contract. The City Manager shall recommend to the City
Council, as may be necessary, contracts with consultants or persons
of special skills to perform special assignments on behalf of the
City of Bakersfield. Persons so employed shall be limited to the
terms of their contract and shall not enjoy civil service status or
other benefits of city employees.
3.14.150 Probationary Period. All appointments to a permanent
position shall be tentative and subject to a probationary period of
six (6) months. During the probationary period, the employee shall
be required to demonstrate his fitness to the position to which he
is appointed by actual performance of the duties of the position.
At the conclusion of 'the probationary period, the department must
file an Employee Performance Evaluation stating the retention of the
Probationary employee in the city service is desired or the proba-
tionary employee will be considered unsatisfactory and will be
terminated.
Pursuant to Section 43 of the Charter, the employee must
be a city resident prior to permanent appointment.
3'.14.160 Termination of Probationary Employee.. During the proba-
tionary per~d, an employee may'be terminated at any time by the
appointive authority without cause or right of appeal.
3.14.170 Employee Performance Evaluation. An evaluation of the
Performance of each probationary and permanent employee by the
Department Head shall 'be 'made in accordance with the Administrative
Rules and Re$~ulations.
3.14.180 Medical Examination. All persons appointed on proba-
tionary status shall be examined and certified'as fit for duty by
a city physician. Medical examinations may be required for any
change in class or position. If in the opinion of the Department
Head an employee is physically unable to perform all the duties of.
his position, he may order a medical examination by a city physician.
Medical examinations required by the city shall be paid by the city.
3.14.190 Temporary Employment. Appointments may be made to a
position for temporary services within city departments and upon
the approval of the City Manager. Employees appointed on a
temporary basis may not work more than.one hundred twenty working
days (960 hours) in any one department in any continuous period of
365 days. Employees appointed on a temporary basis shall not be
eligible for vacation, sick leave, retirement, pay for holidays, or
other associated employee benefits. Temporary employees may be
terminated at any time by the Department Head upon notification to
the employee.
3.14.200 Change of Pos it ions.
(a) Promotions. In the. event of a promotion to a higher grade
during the probationary period within a division, the Department
. Head may reduce the employee to his former grade with the approval
of the City Manager.
(b) Change of Position. All employees changing from one class
or position to a different class or position shall be required to
undergo a s'ix-month probationary period. Civil service status shall
be determined at the time of change.
(c) Transfer'. Employees within the same class of the City of
Bakersfield may be'transferred from one department or division to
another, subject to the approval of the Department Heads concerned,
and with the authorization of the City Manager.
3.14..210 Reinstatement.
(a) Certification. Employees who have voluntarily left the
city service and who have attained a satisfactory Employee Perfor-
mance Evaluation upon termination, may. be certified for reinstate-
ment by the appropriate Civil Service Board for appointment to the
position last held.
(b) Credits. Employees may be reinstated at the salary step
in the salary range assigned to the class or position last earned.
The reinstated employee's prior service shall not be credited towards
sick leave, vacation, or time-in-service'within the class or depart-
ment.
3.14.220 LayOff or Demotion. When in a department having ten (10)
or more subordinate positions, the Department Head, with the approval
of the City Manager, may reduce, by layoff or demotion, the personnel
of that department because of lack Of work or shortage of funds. The
youngest employee in point of time-in-service in the department or
class affected shall be the first employee demoted or laid off. When
two or more employees have the same seniority rating, the employee who
attained the highest grade in the. Civil Service Board examination . .
for the position held at the time of layoff or demotion shall be
deemed to have greater seniority.

3.14.230 Disciplinary Action. DisCiplinary action shall be taken
against employees for infractions of the City Charter, Municipal Code;
Administrative Rules and Regulations, Administrative practices, and
Departmental procedures or policies.
(a) Reprimand. A Department Head may cause ~ reprimand to be.
filed in an employee's personnel file upon sufficient cause. The
reprimand shall be in the form of an Employee Performance Evaluation
.form and/or a Deficiency Notice. A copy of the reprimand shall be
furnished the employee.
(b) Suspension. The Department Head may suspend from duty for
cause, any employee within his department for a period not to exceed
thirty (30) days in any one instance, subject to appeal and review
of the City Manager. Notice of the suspension stating the cause will
be filed on the Change of Employee Status form and a copy furnished
the employe~.
(c) Reduction in Salary. A Department Head may recommend the
movement of an employee from one salary step within a salary range
to a lower salary step for performance less than standard. Such
recommendation will be filed on an Employee Performance Evaluation
form with a copy furnished to the employee thirty (30) days in advance
of the salary reduction. Recommendations for salary reductions must
receive the approval of the City Manager.
(d) Right of Appeal. An employee shall have the right to
appeal to the City Manager, any'disciplinary action, other than dis-
charge, taken against him. Appeals must be.in writing and must be
filed with the City Manager within five (5) days of the action taken.
Failure to appeal shall be held to be an admission of the validity
of the disciplinary action.
(e) Hearing. Upon receipt of an appeal, the City Manager shall
investigate the circumstances of the disciplinary action and set a
date of hearing within ten (10) days of receipt of appeal. An accused
employee may designate a representative to speak in his behalf at the
hearing. The accused employee and.the Department Head shall be allowed
the right to 6all witnesses for purposes of the hearing upon request
to the City Manager. Failure of the accused employee to appear at the
hearing shall be deemed a withdrawal of his request for hearing and
the disciplinary action shall be final.
(f) Decisions. The City Manager shall render his decisions on
hearings of appeal from disciplinary action in writing within thirty
(30) days of hearing; a copy furnished the Department Head and accused
employee, and a copy filed in the personnel record of the employee.
(g) Forfeiture of Salary. Employees placed on disciplinary
suspension shall forfeit salary and shall not accrue rights to
employee benefits, vacation, sick leave, etc., during the course
of suspension.
(h) Discharge. When in the opinion of the Department Head, an
employee has conducted himself in such a way as to justify his dis-
charge f.rom city service, the Department .Head shall suspend the
employee and notify him in writing of. his intentions to file charges
for his removal. Such notice shall be prepared and sent by regular
mail at the same time as suspension from the employee's position is
made. A copy of the notice shall be filed, with the Civil Service
· Board and the City Manager. The Department Head shall prepare writ-
ten charges which shall be served on the suspended employee within
thirty (30) days of the notice of intent to file charges. The
accused employee must answer these charges within ten (10) days
after being served. Failure to answer the charges within.ten (10)
days shall be held to be an admission of the charges by the accused
and a waiving of hearing, whereupon the Civil Service Board shall
find the accused employee guilty as charged and he shall be removed
and discharged from city service as of the day of his suspension by
the Department Head.

S.14.240 Terminations. Separation from city service of a perma-
nent employee may occur for the following reasons:
(a) Lack of Work/Lack of Funds. A permanent employee may be
terminated by the City Manager because of a shortage of work or
funds, completion or reduction of the work load, abolition of the
position, or a change .in the duties of the department concerned.
In the event a position is abolished, the employee will be given
two (2) weeks notice prior to the termination date.
.. (b) Resignation. Employees leaving city service in good stand-
ing should notify their Department Head in writing at least two (2)
weeks before the effective date of resignation.
(c) Absent Without Leave (A.W.O.L.). An absence unauthorized
for a per~-0~ of two (2) consecutive worming days shall be considered
a voluntary resignation and result in the immediate termination of
the employee unless the employee can demonstrate that such absence
was due to circumstances beyond his control.
(d) Discharge. A permanent employee may b® terminated 'from
the.ci.ty service at any time for disciplinary reasons and following
the procedures established by the appropriate Civil Service Board.
(e) Incapacity. Employees who are unable to perform all the duties
of their position due to physical or mental incapacity shall be termi-
nated from the city service under the appropriate provision of civil
service regulations. Such termination shall in no way prejudice or
jeopardize any rights the employee is entitled to by employment with
the city until the time and termination.
(f) Retirement. Employees retiring from city service are subject
to the terms and conditions of the City of Bakersfield's contract
with the State Employees' Retirement System. Employees planning to
retire should give their department written notice thirty (S0). days
prior to the effective date of retirement. Mandatory retirement age
for Police is 65 and all others is 70.
(g) Termination-Retirement/Firemen. Fire Department personnel
retiring from city service shall be subject to the conditions
established by the "Relief and Pension Fund" as created by amendment
· to the Charter of the City of Bakersfield. Mandatory retirement age
for firemen is 62.
3.14.250 Outside Employment. Public Safety (Police and Fire)
.personnel off, he City Of Bakersfield will devote their entire time
to the performance of their duties and shall not hold any other pro-
fession, trade, Calling, or business. Employees other than public

safety members may hold outside employment if. it is determined such
employment will not interfere with the satisfactory performance of
their city duties. In order to insure that such outside employment
is not detrimental to the City of Bakersfield or is not a conflict of
interest, any employee holding or intending'to hold outside employ-
ment shall file a statement listing the name and. address of the business
· or person for whom. the employee will work, the nature of the work,
and the time and hours to be worked. The determi.nation if outside
employment will interfere with city duties wil'l be'made by the Depart-
ment Head with the approval of the City Manager.
S.14.260 Conflict of Interest. Employees of the City of Bakersfield
shall not engage in business transactions or have undeclared financial
interest either direct or indirect which will impair fairness and
impartiality on matters subject to the employee's discre, tion.
S'.14.270 ' Change in Employee Status-Reports. Appointments, trans-
fers, promotions, demotions, suspension, terminations, change in salary
rates, sick leaves and vacation, or any other temporary or permanent
change in the status of employees of the City of Bakersfield will be
reported to the Personnel Office on a form prescribed by the City
Manager.
3.14.280 Service Award Pins. Service within the city shall be
recognized in the award of a ~in bearing the city seal for employees
who have given five, ten, fifteen, twenty years or more of total ser-
vice as a permanent employee for the City of Bakersfield. ..
3.14.290 Training. Training programs for employees of the City of
Bakersfield may be established as deemed necessary by the Department
Head with the approval of the City Manager.
3.14.300 Employee Grievance Procedure.
(a) Matters Subject to Grievance Procedure. All employees in
the city service shall have. the right to present a grievance rega'rd-
lng dissatisfaction with some phase of his job or relations with
others on the job which is outside his scope of control.
(b) Objectives of Grievance Procedur'e:
(1) To promote improved employee-employer relations by estab- ·
lishing grievance procedures on matters for which appeal or hearing
is not provided by Civil Service Board rules. ~
(2) To afford employees individually or through qualified
employee organizations, a systematic means of obtaining further con-
siderations of problems after every reasonable effort has failed to
resolve them through discussions.
(3) To provide that grievances shall be settled as near as
possible to the point of origin.
(4) Encouragement that grievances should be heard and
settled as informally as possible.
(c) Individual Informal Grievance Procedure. An employee who
feels he has a grievance Should attempt to resolve this grievance
by discussion with his immediate supervisor without undue delay.
If after such discussion,-the employee does not feel the grievance
has been satisfactorily resolved, he shall have the right to dis-
cuss the matter ~ith the Chain of Command including his Department
Head. Every effort should be made toresolve the grievance by infor-
mal means at the most immediate level of supervision. If the employee
is not in agreement with the decision reached through such informal
discussionS, he shall have the right to file a request for a formal
grievance in writing with his superior or Department Head. An
informal grievance shall not be taken above the Department Head.
(d) I~dividual Formal GPievance Procedure. After exhaustion of
the informal grievance procedure, the grievance shall be put in
writing and shall proceed on the following levels of review:
(1) Department or Division Review. The employee shall file
his.grievance in writing with'his Department Head who shall discuss
the grievance with the employee. The Department Head shall render
his decision and comments to the employee in writing within fifteen
(15) calendar days. If the employee does not agree with the decision
reached or if no answer is received from the Department Head within
fifteen (15) calendar days, he may present the grievance in writing
to the City Manager. Failure of the employee to take further action
within ten. (10) calendar days after receipt of the decision or
within a total of twenty-five (25) calendar days if no decision is
rendered, will constitute withdrawal of the grievance.
(2) City Manager Review. Upon receiving the grievance, the
City Manager or his designated representative shall discuss the
grievance wil:h the employee and all other appropriate persons. The
City Manager may appoint a.fact-finding co~ittee or an officer not
in the normal line of supervision to investigate and advise him con-
cerning the 8;rievance. The City Manager shall render a decision in
· writing to the employee within twenty (20) calendar days after
receiving the, grievance. The decision of the City ~anager shall be
final in all cases unless the grievance is subject to policy review
by the City Council. In such cases, the City Manager shall then refer
the matter to the appropriate Council Committee.
(e) Employee Organ'ization Grievance procedures:
(1)' A recognized official of an employee"organization may
submit written grievances on behalf of the. organization or an employee
to the appropriate Department Head with a copy filed with the City
Manager.
(2) The Department Head shall render a written decision'
within fifteen (15) calendar days within receipt of the written
grievance unless a mutually agreed upon' extensi6n of time is set.
A copy of the Department Head's decision will be filed with the
City Manager.
~3) If'the employee organization is not satisfied with tile
decision rendered by the Department Head, they may request a City
Manager Review of the grievance within ten (10) calendar days of
receipt of the Department Head's decision. Failure of the employee
organization to take further action within ten (10) calendar days
after receipt of the Department Head's decision or within a total
of twenty-five (25) calendar days if no decision is rendered, will
constitute withdrawal of the grievance. The City Manager shall render
his written decision within twenty (20) calendar days after receiving
the.grievance. The City Manager's decision shall be final in all
cases unless the grievance is subject to policy review of the City
Council. In such cases, the City Manager shall refer the matter to.
the appropriate Council Committee.
if) Conduct of Grievance Procedure:
(1) The time limits specified above may be extended by
mutual agreement of the employee or employee organization ~nd the
reviewer concerned.
(2) The employee may request the assistance of another per-
son of his own choosing in preparing his written grievance.
(3) Employees are assured freedom from reprisal for use of
grievance procedures.
3.14.310 Complaints Against Policemen.
(a) Statement to A~Pointive Authority~Investigation~Formal
Complaint--Report of Investigation. Any person, other than the
authority having the appointive power, believing that he has a
grievance against any member of the Police Department, shall, before'
any formal complaint is filed with the Civil Service Commission for
the Police Department, present a verbal or written statement of such
grievance to the authority having the appointive power of the person
allegedly causing such grievance. Upon receipt of such statement,
the appointive power shall at once investigate or cause to be inves-
tigated the allegations of the aggrieved, and if he finds sufficient
grounds to substantiate the charges, shall file or permit to be filed
.by the aggrieved, a formal complaint against, the accused with said
Civil Service, Commission. Should the appointive power find, upon
investigation, that the charges against the accused are unfounded or
untrue, or not within the jurisdiction of the Civil Service Commission,
no formal complaint shall be filed with said Commission, and the
appointive power shall inform the person claiming to be aggrieved of

the results of his investigation and of his determination in the
matter. In all other cases, complaints shall be filed by the
appointive power. .-
3.14.320 F. mployee Organizations.
(a) Purpose. By establishing the following procedures, it is
the purpose of the City of Bakersfield to strengthen its civil service
system based on the merit principle and to assure all. city employees
equitable and un'iform treatment in matters of salaries, benefits, and
working conditions.
(b) Employee's Right to Join 'or Abstain. Employees of the City
of Bakersfield, except as may be otherwise provided; shall have the
right to organize or participate in employee or labor organization
of their choice as provided in Sections 3500-3509 of the Government
Code of the State of California. Employees of the City of Bakersfield
shall also have the right to refuse to join or participate in the
activities of employee or labor organizations. Each employee has the
right to represent himself individually in his employment relations
with the city'.
.('c) Non-Discrimination/Section 3509/Government Code Applicability.
Employees shall not be discriminated against, granted prefe-rential
treatment, or have equitable treatment withheld because of either
........................ ~e~b'e'rShip or non-membership in employee or labor organizations, nor
shall membership in an organization be a condition of employment in
any city class or position. .~embership in a'n employee or labor'
organization, shall not conf.lict with the duties or responsibilities
of city employees. Employee or labor organizations shall recognize
that they shall not have the right to strike, slowdown, work stoppage,
or to..recognize a picket line of a labor organization while in the
course of. the performance of their duties.
(d) Certification of Employee or'Labor Organization. Each
..... employee or labor organization which seeks to represent employees in
....... their relations with the City. of Bakersfield shall file a statement
with the City' Nanager listing the following and such other pertinent
information as may be required:
(1) Name and address of the organization.
(2)' Objective of organization. Charter and/or constitution
and/or bylaws.
(3) A statement that the organization (a) recognizes that
the provisions of Section 923 of the Labor Code of the State of
California are not applicable to employees of this city, (b) affir-
matively supports tile constitutional form of government, in the
United States and of the State of California, (c) permits membership
without regard to.race, color, creed, national origin, or age, and

(d) agrees that no person, employee, .or organization has the right
to impede or halt a performance of the functions of government;
specifically including, but not limited to, stoppages slowdowns,
strikes, or picketing. '
(4) Names of the organization's principal officers and
representatives who are authorized to speak on behalf of the organi-
zation's members. '
(5) Names of those city employees, listed .by department or
division., who are members of and are being represented by the organi-
· zat ion.
Emch employee or labor organization, after original filing
of such application; shall, during the month of January each year,
reapply or file a statement certifying no change or those changes
that have occurred since the last filing. Such application shall be
executed unSer penalty of perjury by a duly authorized officer of
the organization. Upon verification of the information contained in
the statement, the City Manager shall certify the organization as
representing the employees listed.
(e) Representative of the City Under Govermnent Code Provisions.
For the purposes of Sections 3500 to 3509 of the Government Code of
the State of California, the City Manager is designated as the repre-
sentative of the City of Bakersfield who shall meet and confer with
the representatives of employee or labor organizations or individual
employees upon request, and who shall consider as fully as possible
such presentations prior to the establishing policy or course of
action authorized by the Charter, Municipal Code, or Administrative
Rules and Regulations.
(f) Meet and 'Confer... Upon request· of certified employee or
labor organizations or individual employees, the City Manager or
his authorized representative shall meet and confer on the matters
of salaries, benefits, and working conditions. The City Manager may
establish rules and. procedure for the conduct of such meetings as'
necessary and dates for submission of material r~lative to recommen-
dations of employee or labor organizations on salaries or employee
benefits. The City Manager shall forward such material and arrange
for meetings with the appropriate Council'Committee.
(g) Employee or Labor Organization--City Time and Facilities.
Employee or labor organizations which have as their primary purpose
the representation of city employees shall conduct' recruitment of
members, communications with members, collection of dues, and the
holding of meetings at times other than during working or duty hours.
Employee or labor organizations may post organizational material Or
bulletins on departmental bulletin boards as approved by Department
Heads. Such material shall relate to the general purpose of the
employee or labor organization. The City Manager may disapprove
material which does not relate 'to the general purpose of the employee
or labor organization.

(h) City Manager Authorized to Adopt Rules and Regulations. The
City Manager is authorized to adopt reasonable rules and regulations
for the administration or conduct of employee or labor organizations
or individual employees in their relations with the City of Bakers-
field. Such rules will be consistent with the Charter of the City of
Bakersfield and Policies of the City Council.
S.14.SS0 .Severability. If any section, subsection, clause, or
phrase of this. chapter is fo~ any reason held to be unconstitutional,
such decision shall not affect the validity of the remaining sections
of this chapter. The Council hereby declares that it would have
passed this chapter, and each section, subsection, clause, or phrase
thereof, irrespective of the fact that any one or more other sections,
subsections, clauses, or phrases be declared unconstitutional.

.3.18. 230 Severability.
3.18.010 Compensation for Boards or Commissions. The members
.of all boards or co~nissions of the City of Bakersfield shall serve
without compensation for their services unless otherwise provided.
The members of all boards and commissions may be reimbursed for
travel or other expenses incurred in the discharge of their duties
upon authorization of the Council of the City of Bakersfield.
3.18.020 Salary Plan. The general basis for allocating a
salary range or rate of pay to a class or position is to provide
"equal pay" for "equal work." This applies to the relationship
between jobs of comparable cities and those in the community, as
well as to the internal relationships among city positions.
(a) Administration. The City Manager shall administer the
Salary Plan and from time to time make recommendations on the
allocation of salary range to classes or positions to the Council
of the City of Bakersfield. The City Council shall set the salary
range for each class or position within the city service.
(b) Step Salary Plan. The Salary Plan shall consist of the
ranges listed in this section. Such ranges shall include an annual
salary with five steps of. rates of pay. The five steps.within a
salary range shall be administered in the following .way:
(1) Step 1. The first step of each range is the beginning
-salary level 'knd is the standard hiring rate' for a class or position.
(2) Step 2. Employees shall be advanced to Step 2 after six
(6) months of satisfactory service in Step 1 and after advancement
is recommended by the Department Head and approved by the City Manager.
(3) Step 3. Employees may be advanced to Step 3 of the.
' ' salary range allocated to their class or position after a minimum
time of one year of satisfactory work has been spent in Step 2, and
after a recommendation has been made by the Department Head and
approved by the City Manager.
(4) Step 4-Merit. This step is reserved for employees who
are considered to be fully qualified in their'class and who maintain
a cOnsistent :satisfactory standard of work performance. An employee
may be advanced to Step 4 after a minimum of one year's service in
Step 3, upon the recommendation of the Departmen't Head with the
approval of the City Manager. An employee advanced to Step 4 of
the pay range will retain such status so long as job performance
remains at the level required to attain this step.
(5) Step 5-Merit. This step is to be considered a further
and final step for employees who attain and maintain a thoroughly
sa'tisfactory standard of work performance. An employee may be
advanced to Step 5 after a minimum of one year's service in Step 4,
· upon the recommendation of the Department Head with the.approval of
the City Manager. An employee advanced to Step 5 of the pay range
will retain-such status as long as job performance remains at the
level required to attain this step.
(c) Merit Step Reduction. When an employee no longer meets the
sta'ndards-set for a merit step, the Department Head shall recommend
withdrawal of the merit step increase. Such recommendation shall
be made upon an Employee Performance Evaluation form with a copy fur-
nished to the employee sixty (60) days prior to the effective date of
proposed reduction. Re-evaluation of the withdrawal recommendation
on an Employee Performance Evaluation form with a copy fur'nished to
the employee shall be made by the Department Head thirty (30) days
prior to the effective date of action. If the withdrawal recommenda-
tion is maintained and approved by the City Manager, the employee
shall be reduced by one (1) merit step. Employees no longer meeting
standards established may be reduced from all merit steps following
the above procedur.e. Any employee reduced from a merit step will
again be eligible for advancement six (6) months after effective
date of reduction.
(d) Step Increases...No step increase shall be considered auto-
matic or subject to increase by reaso~ of time-in-service. Ail
increases shall be based upon increased service value'of'the employee,
performance record, and must be recommended by the Department Head
and approved by the City Manager. ~ithholding recommendation for
advancement to Merit Step 4 and 5 shall not be considered a disci-
plinary action.. Ail recon~endations for salary step increases shall
be submitted 1;o the City Manager'for approval thirty (30) days before
the effective date. Upon submission of satisfactory evidence and
recommendation of the Department Head and the qualifications of the
employee warrant, the City Manager may authorize employment to any
step. In computing length of service for Step advancement purposes,
service'begins accruing from date of appointment to the position.
If. an employee is. absent without pay in excess of thirty (30) days,
such time shall not be credited for step advancement purposes.
3.18.030 Basic Workweek. The standard workweek for permanent
full-time employees of the City of Bakersfield shall be forty (40)
hours for all classes of employment with the exception of Fire Depart-
ment personnel.. The Department Head, with the approval of the City
Manager, shall establish the workday for.employees.

3.18.032 Work Periods/Fire Department.
3.18.034 Work Periods/Sanitation Division: Employees of the
Sanitation Division of the .Department of Public Works in Sanitation
Crewman I and II classes who are assigned to routes shall work on an
incentive work period basis. The basic work period for the Sanitation
Division is determined to be eighty hours over a two-week period.
3.18.035 Work Periods/Transit Division. The Work period of
employees of 'the Transit Division in the Motor Coach Operator class
is determined to be eighty hours over a two-week period.
3.18.036 Stand-By/Police and Fire. Police and Fire personnel shall
be considered available for duty at all times and subject to orders
in case of need. ,
3.18.040 Attendance. Employees shall be in attendance at their
work or assigned duties at time and place prescribed by the depart-
ment or divisioh to which they are assigned.
Each department shall keep attendance records of all
employees and make necessary reports as established by the Adminis-
trative Rules .and Regulations.
3.18.050 Salary Ranges/Pay Periods. All employees of the City of
Bakersfield shall earn their wage based on an annual salary allocated
to their class or position. All employees shall be .paid on a semi-
monthly basis. The following salary ranges for various pay periods
are established:

3...18.080 School Crossing Guard--Temporary Status--Hourly Pay.
(1) The position of school Crossing guard in the Police Depart-
ment of the City of Bakersfield shall be temporary and seasonal only.
(2) Temporary and seasonal work performed by any person as school
crossing guard, shall not entitle the said person to any vacation cre-
dit or sick leave. No such school crossing guard shall attain any
civil service status because of such employment.
(3) School crossing guards employed as such on a temporary and
seasonal basis as provided herein, shall receive an hourly compensa-
tion of one dollar and sixty-five cents for each hour so worked as a
school crossing guard.
3.18.090 Computation of Salary. Ail employees of the City of
Bakersfield shall earn their wage based on an annual salary allocated
to their class or position as set'forth in 3.18.060. Wages for
employees paid at an hourly rate shall be computed at the annual salary
allocated to the class or position divided by two thousand and
eighty-eight (2,088) hours. Hourly rates shall be computed to the
one tenth (1/10) of a cent.
3.18.100 Promotion. Employees promoted from one class or position
to another having a higher salary range shall be adjusted to the
lowest step in the salary range of the new class or position which
is at least five percent (5%) higher than the rate received in the
employee's for~er class or position except that adjustment cannot be
greater than Step 5.
'3.18.110 Acting Appointments/Rate of Pay.
(a) Temporary Assignments of Permanent Employees. Department
Heads may assign some of the duties and/hr responsibilities of a
vacant position to a permanent employee for a temporary period of
time.
(b) Temporary Assignments/Firemen. When a prolonged absence
arises in the Fire Department above the class of Firefighter, the
Chief of the iFire Department may, with the approval of the. City
Manager, assign a member of the Department from the next lower class
to fill the'absent position until such time as.the absent member
shall return 'to duty or the vacancy is filled by appointment. The
member so assigned shall receive compensation at the range and step
next highest 'to his present rate of compensation.
'3.18.120 Temporary Employment/Rate of Pay. Employees holding
temporary appointments within the municipal service of the City of
Bakersfield shall be paid on an hourly rate for the actual time
worked, based on the annual salary allocated to the class or position
held.

3.18.130 Salary Adjustments.
(a) Effective Date. Salary adjustments shall be made effective
on the first day of the pay period following qualification of such
adjustment, provided, that if an employee qualified on the first day
of the pay period, the adjustment shall be effective immediately.
(b) Increment Date. Increment dates for permanent employees
of the City of Bakersfield shall be the last date of salary step
adjustment. When a class or position is allocated a new salary range,
employees holding such class or position shall have their existing
salary adjusted to the same step within the new salary range, and such
· adjustment shall not alter the increment date of the employee.
· 3.18.140 .Overtime.
(a) Policy. In case of emergency, or whenever-the public
interest requires, a Department Head may request an employee to per-
form overtime work. The'performance of overtime work by e~ployees
within, the municipal service shall be kept to the minimum and
authorized only when necessary for the efficient operation of the
departments and activities of the City of Bakersfield. Overtime
shall be authorized only under the rules and procedures established
in the Administrative Rules and Regulations or by directive of the
City Manager.
(b) Overtime Not Applicable. Overtime compensation provisions
shall not apply to Department Heads nor certain other positions desig-
nated by the number one.(1) in parentheses preceding each class title
of Section 3.18.060 Salary Schedule.
Such personnel are compensated on the basis of responsi-
bilities and characteristics of the duties performed and additional
time required for performance of their duties is not considered
overtime. In the event department operations require extraordinary
work assignments of an employee so designated, he shall be authorized
payment for .overtime worked at the hourly rate of pay for the emp!oyee"s
class or position, or equivalent time off with pay. Extraordinary
work assignments must be recommended by the Department Head and have
approval of the City Manager.
(c) Overtime/Tempora'ry Personnel. Temporary, seasonal, and
part-time employees shall be compensated, for all work performed at
their established rate of pay.
(d) Overtime Compensation/Fire Department. C6mpensation Will
be granted to Fire Department personnel under appropriate sections
of Fire Department rules and regulations as established by the
Administrative Rules and Regulations.

(e) Attendance at Meetings. Overtime shall not be granted to
any employee attending meetings of the City Council or any board or
commission of the city in the performance of his regular duties.
(£) Overtime/Accumulation. Overtime may be accumulated up to,
but not exceeding, a credit of fifty-six (56) hours at any one time.
Accumulation of more than fifty-six (56) hours will require prior
approval of the City Manager.
(g).Overtime Records. An accurate record of all authorized
· overtime shall be kept to the nearest half-hour.
· S.1S.150 .Overtime Compensation.
(a) ~pplicability. Only full-time permanent employees of
the City of Bakersfield, designated by the number two (2) in paren-
theses preceding each class title of Section S.15.060 Salary Schedule,
shall be eligible for compensatory time off or payment for overtime
worked.
(b) Compensatory Time. Overtime authorized for a permanent full-
time employee shall be compensated for by allowing the .employee equi-
valent time off during the employee's regularly scheduled work period
or paid'in accordance with Section S.18.50 (c). Such compensatory
time shall be taken when designated or approved by the Department Head
in accordance with procedures established in the Administrative Rules
and Regulations.
(c) Overtime Pay. When the Department Head determines it is in
the best interest for the operation of his department and the City of
Bakersfield, he may recommend payment for overtime worked at the hourly
rate of pay for the employee's class or position.
(d) Overtime Pay/Fire Department. Overtime compensation for
members of the Fire Department working an additional shif't or shifts.
shall be computed by dividing the regular annual salary rate allocated.
to such member by One hundred and forty-five and six tenths (145.6)
and multiplying the resulting quotient by the number of additional
shifts worked over and above the regular schedule of such member.
(e) Overtime Compensation/Pay Period' Basis. When overtime.pay
is' authorized, empl. oyees shall be compensated for' overtime work per-
formed on a pay period basis. Pay for overtime worked shall 'be
designated on the employee's pay warrant.
(f) Overtime Compensation/Termination. Any employee who has
authorized overtime accumulated at the time of his termination from
service with the City of Bakersfield shall receive cash compensation
for such overtime calculated upon his rate of pay at the time of ter-
mination.

3.18.160 Deduction from Wages.
(a).Shares and Savings in Credit Union and Employee Organization.
Employees may authorize deductions to be made from their salaries or
wages for shares and savings in the Bakersfield City Employees Federal
Credit Union, United States Savings Bonds, and for dues in any employee
organization, recognized by the City Council, of which they are a
member.
(b) Written'Authorization--Filing. Any employee desiring to
authorize deductions from his or her salary or wages for the purpose
aforesaid, shall file a written authorization with the Finance
Director. 'Authorization for deductions from salary or wages for dues
in employee organizations shall be filed annually. Such authorization
shall state the amount which is authorized to be deducted monthly from
the salary or wages of the officer or employee.' Such written autho-
rization shall be filed with the Finance Director not later than five
days prior to the expiration of the pay period from which the first
deduction so authorized is to be made.
(c) Duties'of the Finance Director. The'Finance Director is
hereby authorized and directed to recognize ~nd act upon authorization
for salary and wage deductions filed as herein provided, not later
than ten days after the close of the pay period, He shall execute
checks or warrants in the total amounts of such deductions for the
preceding pay period payable to the organization for whose benefit
deductions have been made from salaries and wages of.employees.
(d) Revocation of Authorization. Any'employee of the city who
authorizes any deductions from his salary or wages as aforesaid, may
revoke'said authorization at any time. Such revocation shall be in
writing, filed with the Finance Director.. No such'revocation shall
affect any deductions which the Finance Director has made in the
salary or wages due or payable to an employee so revoking for a pay
period which has expired prior to the filing of such revocation.
(e) Forms for Authorization and Revocation. For the purpose of
facilitating the operation.of this chapter, the Finance Director is
hereby authorized to prescribe forms to be used in filing authoriza-
tions to make the deduction herein provided for, and in revoking
authorizations previously.filed.
(f) Provisions of Chapter Not Compulsory. Nothing in this'
Chapter shall be Construed to require or compel, any employee of
the City of Bakersfield to authorize any deduction to. be made in
his salary or wages or require the Finance Director to make an
early payment of deductions.
3.18.170 Severance Pay. Whenever any permanent employee who has
not reached minimum retirement age shall cease to be employed by the
city by reason of the elimination of a department or of a position,

the employee shall be entitled to severance pay to be computed as
follows:
(a) One (1) to Five (5) Years. Employees who have been employed
by the city for one to five years shall be paid an amount equivalent
to fifty percent of their last full month's salary.
(b). ~{ore Than Five (5) Years. Employees who have been employed
by the city for more than five years.shall, in addition to the compen-
sation stated in subdivision (a), receive a~ amount equivalent to
five percent of their last full month's salary for each year of ser-
vice or major portion thereof in excess of five years.
3.18.180 Holidays.
(a) City Nanager to Designate. On the effective date of this
ordinance and in each December of every succeeding year, the City
Nanager, after consultation with each cert:ified employee association
or labor organization, shall submit a list of eight (8) holidays to
be observed by the City of Bakersfield to the City Council for
approval. In a~dition, holidays will be observed on every day.
appointed by the President or Governor for a public feast, thanksgiving
holiday, or day of mourning.
(b) Half-Day Holidays. In addition to the eight established
holidays, a one-half day holiday in the afternoon on Good Friday,
Christmas Eve (December 24), and New Year's .Eve (December 31) shall
be observed as holidays by the City of Bakersfield, provided, however,
no such one-half day shall be granted when Christmas and New Year's
Day fall on a Sunday or ~onday.
(c) Sunday Holiday Observance. In the event the holiday desig-
nated falls on Sunday, the following ~0nday shall be observed as
the holiday.
(d) Work on Holidays. Employees required to work on holidays
which are not part of their regular work schedules may be cOmpen-
sated with compensatory time off or at the hourly rate .of pay allocated
to the employee.
(e) Holidays on Day Off. In the event that a.holiday falls on
Zn employe'e's day off, he shall be compensated by leave of absence
with pay on another day, or he shall receive equivalent pay as deter-
mined by the Department Head.
(f) Employees Whose Work/Duty Schedule Normally Requires Holiday
Work. An employee whose work or duty schedule does not permit obser-
vance of holidays may be paid annually on December i of each year for
holidays not observed in the preceding twelve (12) months. Holidays
will be paid. to Fire Department shift personnel at the rate .6f two (2)
holidays per twenty-four (24) hour shift.

(g) Eligibility. Ail employees, except temporary or part-time,
of the city shall be entitled to eight (8) basic holidays per year
or compensatory time off or payment for'them~and', if applicable,
three (3) one-half day holidays when any of the three occur during
the employee's normally scheduled work period.
(h) Holidays at Termination. An employee leaving permanent city
service shall be allowed regular compensation for holidays due him'up
to the effective, date of termination.
3.18~190 Annual Vacation Leave. Vacations are provided for all
permanent employees and are designed to give the employee an oppor-
tunity for rest and relaxation. It is normally expected that the
employee will take a reasonable length vacation at least once each
year.
(a) Eligibility. Permanent, full-time employees shall earn
annual vacation leave for continuous service performed for each
calendar year or appropriate fraction thereof.
(b) Accrual:
(1) All departments (except Police & Fire) shall earn'and
take vacation on the basis of working days. Accrual of vacation leave
shall be at the following rate:
A. First Four (4) Years: 5/6 of a working day per month.
B. Five (5) through Nineteen (19) Years: l¼ working days
per month.
C. Twenty (20) Years or Nore: 1-2/3 working days per month.
(2) Police and Fire Departments shall earn and take vacations
on the basis of calenda~ days. Accrual of vacation leave shall be at
the following rate:
A. First. Four (4) Years: 1~ calendar days per month.
B. Five (5) through Nineteen (19) Years: 1-3/4 calendar days · per month.
C. ~renty (20) Years or Nore: .2-1/3 calendar days per month.
(c) Computing Vacations. Vacations shall be computed by multi-
plying the number of months and/or fraction thereof times the appro-
priate .rate. Vacation leave computed in this manner shall be rounded.
off to the nearest full day. Any vacation leave earned in a calendar
year may'not be taken until the next succeeding calendar year.
Cd) Absence Without Pay. .For the purpose of computing vacation
leave, an employee who is on a leave of absence without pay shall not
earn vacation during such absence.

(e) Credited. Vacation shall be credited to the employee on
January 1 of the calendar year following the year in which such
vacation is accrued.
(f) use 'of Vacation. No employee shall be entitled to his
vacation leave unless he has completed six months of continuous
employment. Vacation leave must be taken between January i and
December 31 of the calendar year following the year in which such
vacation has been earned. All accrued vacation must be taken at
one time unless under special circumstances or for the convenience
of the city, a lesser period is approved by the Department Head and
the City Manager.
(g) Determination of Vacation. The time at which an employee
may use his vacation leave shall be at the convenience of the city.
Wishes of the employee shall be.taken into consideration when possible.
(h) Def'erral of Vacation. In the event an employee is unable
to complete his vacation in the prescribed period for satisfactory
reason, he may defer his accrued vacation to the succeeding calendar
year with prior approval of the Department Head and' City Nanager.
When, at the convenience of the city, an employee is unable to take
or complete his vacation leave, compensation in an amount equivalent
to his regular salary may be paid upon recommendation of the Depart-
ment Head with approval of the City Manager. No employee'shall be
required to'.defer his vacation to a succeeding calendar year or
remain at work during a vacation period without his consent.
(i) Holidays on Vacation. In the event one or more municipal
holidays fall within an annual vacation leave, such holidays shall
not be charged as vacation leave, and the vacation leave may be
extended accordingly.
(j) Sick Leave During Vacation Period. Employees who become
seriously ill or disabled while on vacation are entitled to take
accumulated sick leave upon presentation of a certificate from a
licensed physician, or presentation of other proof satisfactory to
the Department'Head, showing the necessitY for such sick leave.
This certificate, or other proof, must be presented to the Department
Head concerned not later'than the date on which said'employee is
scheduled to return to duty, together with a request to reschedule
or extend his vacation leave for the period coVered by the illness.
(k) Loss for Non-Use. In the event an employee fails to use his
annual vacation leave and deferral is not recommended, by the Department
Head nor approved by the City Nanager, the vacation leave shall be
considered lost and no other compensation as recognition of the lost
vacation will be made'.
(i1) Vacation at Termination. An employee leaving.permanent
city service shall be allowed his regular compensation for any vacation
due on the effective date of termination.'

(m) Yacation Benefits for Deceased Employees. An employee who
is eligible for vacation leave and who dies while in the municipal
service shall have the amount of any accrued vacation paid to,his
estate within thirty (30) days. This proration will be computed at
his last regular rate of compensation.
3.18.200 Sick Leave.
(a) Policy. Sick leave shall not be considered as a right
which an employee may use at his discretion, but shall be allowed only.
in case'of necessity and actual personal sickness or disability. Med-
ical appointments qualify for sick leave.
(b) P~oof of Illness. .In order to receive compensation while
absent on ~£ck leave, the-employee shall notify his immediate super-
visor prior to the beginning of his daily duties as soon as possible.
The. employee may be required to be examined by the City Physician, a
registered nurse employed by the city, or file a physician's certifi-
cate stating the cause of absence upon reqdest of the Department Head.
Refusal to comply as herein required shall constitute sufficient
cause for waiver of sick leave, suspension, demotion, or dismissal
of the employee from city service.
(c) Eligibility. Permanent, full-time employees shall be eligible
to accrue and use sick leave.
Computation of Sick Leave. Ail permanent, full-time employees,
exceptdmembers of the Fire D~partment, after having been in the ser-
vice of the city continuously for six months, shall be allowed sick
leave with full pay, computed upon a basis of one full working day
allowed for each month or major portion thereof for service with the
city.
(e) Computation of Sick Leave/Fire Department. Each member of
the Fire Department assigned on a twent'y-four (24) hour shift basis,
after having been' in the service of the city continuously for six.
mont. hs~ shall be allowed sick leave with full pay, computed upon a
basis of seven twenty-four hour duty shifts per year.
(f) Sick Leave'Not Earned/Holidays.. No sick leave shall be earned
during leaves of absence without pay. When a holiday occurs while an
employee is absent from duty on sick.leave, such holiday shall not be
deducted from the employee's accumulated sick leave.
(g) Accumulation of Sick Leave. Sick leave may be accumulated
without lk'mit.
(h) DePletion of Sick Leave. Upon depletion of accuniulated
sick. leave, an employee will be deemed to be on medical leave of
absence without pay. The Department Head may recommend and the City
Manager approve, medical leave of absence without pay not to exceed

thirty (SO) days. Any medical leave of absence beyond thirty (SO)
days must be approved by the City Council. If further leave is not
granted, the employee's service with the city shall be considered
terminated.
S.18.210 Death in the Family. In case of death within the immed-
idate.family of an employee, the employee may, upon approval of the
Department Head, use up to three (S) days of any accumulated sick
leave, vacation'leave, or compensatory time off due him for overtime
worked, .to attend the funeral or memorial services. Additional time
· off for travel may be granted upon recommendation of the Department
Head and approval of the'City Manager. The immediate family shall
c.onsist of spouse, parents, grandparents, brothers, sisters, children,
grandchildren, monther-in-law, and father-in-law.
S.18.220 Leaves of Absence.
(a) Leave of Absence Without Pay. Leaves of absence without
pay, up to a period of thirty (SO) days, may be granted to an employee
upon the recommendation of the Department Head with the approval of the
City Manager. No leave of absence will be granted to allow an employee
to accept other employment on a trial basis. Leaves of absence for
periods of time longer than thirty (SO) days must be approved by the
City Council. Employees on authorized leave of absence without pay
will not be eligible for vacation or sick leave benefits .during such
leave.
(b) Absence Without Leave. Unauthorized leave of absence shall
be considered to be without pay, and reductions in the employee's
pay shall be made accordingly. Unauthorized leave of absence for
more than two (2) consecutive working days shall result in automatic
termination of employment.unless the employee can demonstrate that
such absence was due to circumstances beyond his control.
(c) Military Leave of Absence. Military leave shall be granted
in accordance with'the provisions of State law. All employees
entitled to military leave shall give the department' concerned an
opportunity, within the limits of military regulations, to determine
when such leave shall be taken.
(d) Leaves of Absence With Pay/Designated Personnel. Personnel
designated by the number one (1) in Section 3.18.060 Salary Schedule
· may be granted a leave of absence with pay by the Department Head
with the approval of the City Manager. Such leave granted at any
one time. shall not exceed three (3) working days. Extended leave
beyond three (3) working days must be approved by the City Council.'
(e) Jury Duty/Leave of Absence. Employees required to report
for jury duty shall be granted a leave of absence with pay from their
assigned duties until released by the Court. When on july duty, such
employee shall receive compensation equal to the difference between'

their regular salaries and. the amount received from such jury duty.
Employees released from jury duty before noon of. any day must report
for work as soon as possible the same day.
(f) Maternity/Leave of Absence. Not more than ten days of
accumulated sick leave may be used in cases of pregnancy, commencing
with the date of admittance to the hospital, provided, however, that
should any illness or condition arise necessitating medical care as.
a result of such. pregnancy or delivery, then in that event, additional
days of such accumulated sick leave may be used as may be necessary
· upon a written statement of a physician certifying to said illness or
condition.
(g) Community Service/Leave of Absence. Leave of absence with
pay, not to exceed one (1). full working day, may be granted an employee
upon the recommendation of the Department Head and with the approval
of the City Manager if such leave is determined to provide.a community
service and is in the best interests of the city.
(h) Discretion of the City Council. The City Council may, at
its discretion, upon good cause shown, grant leaves of absence other
than as provided for herein.
(i) Leaves of Absence/Effects. Employees shall not accrue vaca-
tion and sick leave benefits when on a leave of absence without pay.
This section shall have no effect upon reinstatement provisions of
the State Employees' Retirement System.
S.18.230 Severability. If any section, subsection, clause, or
phrase of this chapter is for any reason held to be unconstitutional,
such decision shall not'affect the validity of the remaining sections
of this chapter. The Council hereby declares that it would have
passed this chapter, and each section, subsection, clause, or phrase
thereof, irrespective of the fact that any one or more ot'her sections,
subsections, clauses, or phrases be declared unconstitutional.

3.22.010 Surety Bonds.
(a) RequirementmTerm and Renewal--Approval by City Attorney--
Premiums. All officers, commissioners, heads of departments, the
City Manager and any subordinates, deputies or employees required
by the City Council to execute surety bonds for the faithful perfor-
mance of their official duties, shall furnish a bond in the sum
designated by the City Council, the term of which bond shall not
exceed one year. Such ~fficers, commissioners, heads of departments,
City Manager, subordinates, deputies, or employees shall thereafter
continue the 'undertaking by furnishing like bonds annually. The City
Attorney shall be required to pass upon the sufficiency of each .....................
undertaking. The annual premiums for all such bonds shall be paid
by the City of Bakersfield.
(b) City Manager Authorized to Release Sureties Under Prior Bond.
In order to carry into effect the purposes and intent of the fore-
going section, the City Manager is hereby authorized and empowered'
to release from further liability, the principals and/or sureties upon
any bond or bonds of officers and employees of the City of Bakersfield
for any' acts of a principal occurring subsequent to the effective date
of a new approved bond covering such officer or employee of the City
of Bakersfield. The City Attorney shall prepare such form of release
to be executed by the City Manager.

3.22.020 Group Insurance.
(a) City Payment. The City of Bakersfield'shall contribute a
sum not to exceed Five and no/100 Dollars ($5.00) per month toward
the cost to each city officer or employee of the premium for city
employees group insurance, to be carried by any officer or employee
of the city.
(b) Who Covered. Contributions by city toward payment of pre-
miums of said. group insurance shall not be made on behalf of members
of boards and commissions, not full time salaried officer or employees
of said city, or temporary or part-time employees of said city, but
shall include all elective officers of said city.
(c) ~alary Deductions--City Contributions:
(1) Any officer or employee of the city electing to partici-
pate in said group insurance shall, in writing, authorize deductions
to be made from his or her salary by the Finance Director, which deduc-
tions shall be pa~d by said Finance Director to the carrier of said
group insuran, ce.
(2) The Finance Director is hereby directed to paz from the
funds of the city a sum not to exceed Five and no/100 Dollars ($5.00)
pgr month toward the premium for such group insurance for each
employee participating in said group insurance.
(3) Payments on said group insurance as provided for in
'~-s-u.b~ivisions (1) and (2) above, shall be made monthly to the insur-
ance'carrier by said Finance Director.
(d) Eligibility of Employees and Elected Officials. All elective
officials of the city shall be eligible to participate in said group
insurance on the first of the month following the date they assume
office. Appointed employees shall be eligible for said group insur-
ance on the first of the month following the completion of six months'
service with the city.
3.22.030 Workmen ' s Compensation. .'
(a) Compensation from City for Injury in Addition to Amount
Received from State--Approval of Application--Cessation of Payments.
If and when an employee shall have received compensation by .an award
of the Industrial Accident Commission of the State of California, or
shall receive compensation from the Insurance Fund of the State of
.California for any injury he has sustained while in the course of his
employment by' the City of Bakersfield, such employee may make applica-
tion to the City Manager on forms provided by the City of Bakersfield,
for additional compensation, payable by said city under the schedule
as ·follows:

(1) Full salary less the amount paid by Insurance Fund for
a.period of time not exceeding twelve months.
(2) Said payments to be made only upon the application of
the employee and approved by the City Manager, and to continue as
per schedule, provided, however, that in case.the City Manager refuses
to approve any application for additional compensation, then the
employee making said application may appeal to the Council, .and its
findings shall be final and conclusive, and provided, further, that
the City Council' may, at any time, discontinue payments as per said
.schedule or otherwise, when in its opinion said payments should stop,
and provided further that in no case shall said payments be con-
tinued after death of said employee or after payments shall have
Ceased by s~id Insurance Fund of the State of California.
(3) And provided 'further that there shall be deducted from
the. amount paid under the foregoing schedule any sum that may become
due and payable to said employee from the city pension fund during
the time that said employee is claiming extra compensation.
(b) Filing of Claim--Payments. Upon the filing and allowance
of any claim as above provided, the Finance Director shall, each
successive pay period as the same shall become due and payable, pay
the same out of the fund of the City of Bakersfield from which the
salary of the injured employee has formerly been paid.
(c) Notification of Termination of Other Compensation. It shall
be the duty of any employee claiming compensation hereunder to notify
the City Nanager and the Finance Director immediately upon the termi-
nation by the Insurance Fund of the State of California, or otherwise,
of his' compensation for such injuries.

3.30.010 Law Enforcement Officer Training.
(a) State Aid. The City of Bakersfield declares that it desires
to qualify to receive aid from the State of California under the pro-
visions of Chapter '1 of Title 4, Part 4 of the California Penal Code.
(b) Standards. Pursuant to Section 13522 of Chapter 1 of Title
4, Part 4 of 'the California Penal Code, the City of Bakersfield,
while receiving aid from the State of California pursuant to said
Chapter 1, will adhere to the standards for recruitment and training
established by the California Commission on Peace Officer Standards
and Training.
3.30.020 Police Reserve.
(a) Establishment of Police Reserve. A police reserve, hereinafter
called "Reserves," is hereby established as a voluntary organization
composed of persons appointed by the Chief of Police, hereinafter called
the "Chief," :said persons to serve gratuitously as a uni{ of the
Police Department of the City of Bakersfield to assist regular police

officers in law enforcement and the maintenance of peace and order
during the temporary congregation of large numbers of persons under
conditions which make it impracticable to furnish adequate police
protection solely by means of regular police officers.
(b) Authority and Control of Chief of Police. Subject to the
provisions of. this chapter, the Chief shall have complete authority
and control over the Reserves. He may appoint as members thereo£
any persons whom he deems to be qualified and he may reject any
application for ~embership. He shall provide for the training of
.candidates for membership and for the further training of members in
all fields of police activity and for that purpose may assign such
members to ~arious police duties. Membership in this organization
is open to both men and women. Whenever the male gender is used in
this chapter, it shall be construed to include both male and female.
(c) Method of Appointment. No person shall become a member of
the Reserves until he has taken the training and he is able to meet
all other requirements prescribed by the Chief. When so qualified
and selected, he shall then be sworn in by the Chief, or by the Chief's
representative, as a member of the Reserves.
(d) Rules and RegulationsmDuties. In order to effectuate the
purpose of the Reserves, the Chief may, by order, establish rules
and regulations to govern the Reserves, including the fixing of
specific duties of its members and the providing for the maintenance
of discipline. He may change such orders'from time to time.
(e) Identification Card and Insignia. An identification card,
badge, and cap piece, and such other insignia or evidence of identi-·
fication as the Chief may prescribe, shall be issued to each member
who must carry the card ·at all times. Each member must surrender
all city property issued to him upon the termination of h~membership.
(f) Removal from Membership--Resignation. The membership o£ any
person in the Reserves may be terminated by the Chief at any time,
and any such .member may resign from the Reserves at any time upon
notifying the Chief in writing of his resignation.
(g) Firearms and Police Baton. No.m~mber of the Reserves shall
carry any firearm until he.has qualified for, and received, a gun
permit signed by the Chief. All members of the Reserves shall carry
the regulation police baton.
(h) Power of Arrest--Authority to Direct Traffic. A member of
the ReserVes 'when on duty as assigned by the Chie.£, shall have the
authority given officers of the Police Department to direct traffic,
and shall have the same power of arrest granted a regular member of
the Police Department, subject to any limitations which the Chief
may impose.

(i) Regulating Size of Force. Subject to the provisions of
Section ('a), the Chief may, by order, diminish or expand the member-
ship of the Reserves as may be required.
(j) Impersonation Prohibited. It shall be a misdemeanor, punish-
able by imprisonment for no.t to exceed six months or by fine not to
exceed five hundred dollars, or both, for any person, not a member of'
the Reserves:
(1) To wear, carry or display a Reserve identification card,
· badge, cap piece or insignia.
(2~ In any manner to represent himself to be connected with
the Reserves.
(k) Uniform. The uniform for members of the Reserves shall be
similar to the uniform worn by members of the regular Police Depart-
ment, with an identifying insignia to be prescribed by the Chief of
Police.
S.S0.0S0 Special Officers in Police Department.
(a) "Special Officer" Rank Created. There is hereby created
within the Police Department of the City of Bakersfield the position,
rank, and title of Special Officer.
(b) Number of Special Officers. As many special officers as are
necessary to the protection of life and property within the City of
Bakersfield may be appointed by the Chief of Police.
(c) Remuneration. Special officers of the Bakersfield Police
Department shall receive, no compensation for their services from
the City of Bakersfield.
(d) Service at Pleasure of Chief of Police. All special officers.
shall serve at the.pleasure of the Chief of Police.
(e) Rules for Conduct. Special officers shall be governed in
their, conduct by such orders as are issued by the Chief of Police,
or those to whom such power is delegated.'
(f) Powers. Special officers shall have all the powers of a
peace officer.

1.24.010 Authorization. The City Manager is hereby authorized to
compose and ~ssue Administrative Rules and Regulations for use by
all departments of the city. Such rules and regulations shall con-
tain'procedures established by the City Manager and the various
departments for the efficient operation of the City's departments
and activities. Such rules and regulations shall be in harmony with
the Charter and Ordinances of the City of Bakersfield, and have the
force and effect of law.

Clerk and may be amended from time to time upon directive of the
City Manager.

1.40.010 State LawmAdoption by Reference. The Conservation and
Planning Law of the State of California, being Title 7 of the Govern-
ment Code, and amendments thereto, is hereby adopted by the City of
Bakersfield by reference to said Law, and all provisions therein con-
tained which are applicable to cities, and not in conflict with any
provisions of the Charter or Ordinances of the City of Bakersfield.
1.40.020 Appointment of Officers and Employees. Wherever said Con-
servation and Planning Law provides for the appointment of a director,
officers, employees, consultant, or other specialists, said appoint-
ment shall be made by the City Council or City Manager, as the case
may be, as set forth in the Charter or Ordinances of the city regulat-
ing employment of officers and/or employees of the city.
1.40.030 Creation of Planning Commission--Members. .There is hereby
created a Planning Commission of the City of Bakersfield which shall
consist of seven members who shall be appointed by the City Council.
Members shall serve for a term of four years. If a vacancy shall
occur, oth%r than by expiration of term, it shall be filled by appoint-
ment for the unexpired portion of the term.
1.40.040 Selection of ChairmanmRegular Meetings. The Commission
shall elect its Chairman among its appointed members for a term of
one year and, subject to other provisions of law, may create and fill
such other offices as it may determine. The Commission shall hold at
least one regular meeting in each month. It shall adopt rules for
transaction of business and shall keep a record of the resolutions,
transactions, findings, and determinations, whic'h record shall be a
public record.
1.40.050 Technical Advisors. The Director of Public Works and
the Chief Building Inspector of the City of Bakersfield shall attend
the meetings of the Planning Commission and shall serve as technical
advisors to said Commission. Each technical advisor may designate
one of his assistants or deputies to attend the meetings of the
Commission in his absence.
1.40.060 Coun'cilman ~.s Advisor. One member of the City Council
shall be designated by the City Council to attend the meetings of
the Planning Commission, in an advisory capacity, for a term of two
years.
1.40.070 Absence from Meetings.
(1) Should a member of the Planning Commission be absent for
three consecutive regular meetings of said Commission without cause,
the office ot! such member or appointee shall be deemed to be termi-
nated and thE; S.ecretary of the Planning Commission shall immediately
inform the City Council of such termination.
(2) An absence due to illness or an unavoidable absence from
the city and written notice thereof to the Secretary of the Planning
Commission on or before the day of any regular meeting by the said
Commission shall be deemed absence for cause.
'1.40.080 Present Commission and Board of Zoning Adjustment Members.
The Planning Commission and the Board of Zoning Adjustment created
prior .to the adoption of this ordinance, are hereby continued in
existence and operation as such Planning Commission and such Board of
Zoning .Adjustment of the City of Bakersfield, and the members of each
thereof, heretofore, and hereafter appointed shall be and constitute
the members of said Planning Commission and of said Board of Zoning
Adjustment, respectively, until the expiration of the terms for which
they were or shall be appointed.
1.40.090 Board of Zoning Adjustment Created--Membership~Terms--
Yacancies--Removal. There is hereby created a Board of Zoning Adjust-
ment of the C. ity of Bakersfield, which shall consist of three members,
which members~hip shall be selected on the basis of one member each
from the Public Works, Building, and Legal Departments of the City of
Bakersfield, and who shall be appointed by the City Council. One.
member shall be appointed to serve for a term which shall expire
December 1, 1960; one member shall be appointed to serve for a term
which shall expire December l, 1961; and one member shall be appointed
to serve.for a term which.shall expire December 1, 1962. At the
expiration of each of the terms so provided for, successors shall be
appointed fox' a term of three years. Vacancies on said Board shall

be filled in the same manner for the unexpired term. Members of the
Board of Zoning Adjustment may be removed in the same manner as mem-
bers of the Planning Commission, as provided by law.
1.40.100 Same--Duties. The powers and duties of the Board of
Zoning Adjustment shall be:
(1) To. administer the Zoning Ordinance insofar as the same per-
tains to conditional use permits, variances, modifications, and home
occupation permi'ts.
(2) To recommend to the City Council any additional uses which
may be included within the list of permitted uses.
(3) To determine whether plans submitted for uses in "P" (Park-
ing). and "W" (Oil well) Zones, respectively, are in harmony with the
provisions oil the Zoning Ordinance (Title 17), and meet the require-
ments therein set forth.
(4)' To conduct hearings and render decisions on applications for
conditional use' permits, variances, modifications, and home occupation
.permits, subject to the provisions of said Zoning Ordinance regulating
the granting of such permits.
(5) To exercise such other powers as may be granted by State
laws and local ordinances.
'(6) To ~.dopt rules of procedures necessary' to carry out the pur-
poses of this', section.
1.40.110 Planning Department--Duties. The Planning Department of
the City of Bakersfield shall act in an advisory capacity on all mat-
ters relating to conditional use permits, variances, and modifications,
and provide technical and secretarial services to said Board of Zoning
Adjustment.

1.50.010 Creation of Division. There is hereby established a
Division of Municipal Transit. The division shall take control of
the properties of former Transit Authority of the City of Bakersfield
and shall operate said equipment.
1.50.020 Office of Superintendent Created. There is hereby
created the Office of Superintendent of Transit of the City of
Bakersfield.
1.50.0S0 Appointment of Superintendent. The Superintendent of
Transit shalT be appointed by the City Manager, and the Sup&rinten-.
dent shall exercise control of the Division of Transit subject to the
sdpervision and approval of the City Manager. In the absence of
appointment of a Superintendent, the City Manager shall act as
Superintendent.
i.50.040 Duties of Superintendent. The duties of the Superinten-
dent of Transit of the City of Bakersfield shall be as follows:
(1) Supervise the preparation of bus schedules.
(2) Regulate the o~eration of buses and the working hours of
operators.
(3) Supervise the activities of all 'transit employees.
(4) Supervise servicing, maintenance, and repair work carried
out in the Transit'System Garage.
(5) Make studies and recommendations to the City Manager on fare
structures, zone limits, modification, extensions or reductions of
routes, and charter service.
(6) Subject to approval of the City Manager, determines routes,
schedules time points, work runs, schedule speeds for the entire
system.

(?) Supervises administrative and clerical work and prepares
division budget.
(S) Such other duties as the City Manager may from time to
time assign to. the Superintendent.
