HomeMy WebLinkAboutORD NO 1762 ORDINANCE NO. 1762 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED NORTHERLY OF 30TH STREET, WESTERLY OF "H" STREET, SOUTHERLY OF GOLDEN STATE AVENUE AND EASTERLY OF THE RELOCATED STINE CANAL EXTENSION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion of the Planning Commission to change the land use zoning of that certain property in the City of Bakersfield located northerly of 30th Street, westerly of "H" Street, southerly of Golden State Avenue and easterly of the relocated Stine Canal extension, and WHEREAS, the City Council has determined after due consideration of said motion and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which properties are shown on the mmp hereto attached and made a part hereof, as follows: Changing the zoning boundaries from a C-2 (Commercial) Zone to a C-2-D (Commercial - Architectural Design) Zone, of that certain property in the City of Bakersfield located northerly of 30th Street, westerly of "H" Street, southerly of Golden State Avenue and easterly of the relocated Stine Canal Extension, being more particularly described as follows: Beginning at the most northwesterly corner of Tract No. 1387, as per map recorded March 26, 1948, in Book 6 of Maps at page 104 in the Office of the County Recorder of said Kern County, thence westerly along the westerly prolongation of the north line of said Tract No. 1387, on a bearing of North 89© 44' 15" West (North 89© 59' 45" East record per map of Tract No. 1387) a distance of 1154.753 feet; thence North 19© 04' 40" East, 917.898 feet; thence North 55© 50' 50" East, 591.960 feet to the southwesterly right-of-way line of U. S. Highway 99, as shown on Sheet 7 of the highway construction plans for District VI, Kef Route 4, Section G, approved by the District Engineer March 17, 1947; thence southeasterly along said southwesterly right-of-way line the following six courses to intersect the current corporate boundary; thence South 47° 16' East, 714.56 feet; thence South 14© 45' West, 187.53 feet; South 63© 30' 22" East, 356.51 feet to the beginning of a tangent curve, concave to the southwest, having a radius of 472 feet; thence southeasterly along said curve through a central angle of 15© 00' 00", a distance of 123.57 feet to a point of tangency; thence South 48° 30' 22" East, 468.76 feet; thence South 47© 06' 22" East, 5.29 feet, more or less; thence westerly to the point of beginning.
