HomeMy WebLinkAboutORD NO 1795 OP~INANCE NO. 1795 NEW SERIES AN OI~DINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD ~ENDING CHAPTER 3.14 OF THE MUNICIPAL CODE BY ADDING NEW SECTION 3.14.050 (55) AND SECTION 3.14.321 AND BY AMENDING SECTI~S 3.14. 320(e), (f), (g), (h), AND AND A~ENDING CHAPTER 3.18 BY AMENDING SECTION 3.18. 060. BE IT ORDAINED by the Council of the City of Bakers- field as follows: SECTION 1. That Section 3.14.050 is muended by adding new number (55) to read as follows: (55) Grievance. A grievance is any dispute concerning interpretation or application of the Personnel and Compensation Ordinance or of rules or regulations governing personnel practices or working conditions, or of the practical consequences of the city's rights~ decision on wages, hours, and other ter~s or condi- tions of employment. SECTION 2. That Section 3.14.320 is muended by add~ng new section (e) to read as follows: (e) Police Organizations. For the purposes of Section 3508 of the Government Code, police officers of the City of Bakers- field may for~, join, participate in, and be represented by employee organizations of their own choosing for the purposes of representation on all matters of employer-employee relations as provided by this chapter, provided such employee organizations: (1) are composed solely of such police officers, (2) concern themselves solely and. ex~lusively with the wages, hours, working conditions, welfare programs, and advancement of the academic and vocational training in furtherance of the police profession, and (3) are not subordinate to any other organization. SECTION 3. That Section 3.14.320 is amended as follows: a. Section 3.14. 320(f) is amended to read as follows: (f) Representative of the City Under Government Code Provisions. For the purposes of Section 3500 to Section 3509 of the Government Code of the State of California, the Governmental Efficiency and Personnel Committee of the Council of the City of Bakersfield is designated as a representative of the City of Bakersfield which shall meet and confer with representatives of employee or labor organizations or individual employees upon request and which shall consider, as fully as possible, such presentations prior to the recoL~..~endation of establishing policy or course of action authorized by the Charter or the Municipal Code. b. Section 3.14. 320(§) is amended to read as follows: (g) Meet and Confer. Upon request of certified employee or labor organizations or individual employees, the Govern- mental Efficiency and Personnel Committee shall meet and confer on matters of salaries, benefits, and working conditions. The Govern- mental Efficiency and Personnel Committee may establish rules and procedures for the conduct of such meetings as necessary and dates for submission of material relative to recommendations of employee or labor organizations on salaries or employee benefits. The City Manager shall forward such material, arrange for meetings, and act as advisor to the Governmental Efficiency and Personnel Committee of the City Council. c. Section 3.14. 320(h) is amended to read as follows: (h) Employee or Labor Organization--City Time and Facilities. Employee or labor organizations which have as their' primary purpose the representation of city employees shall conduct recruitment of members, communications with members, collection of dues, and the holding of meetings at times other than during 2. · : ... '. working or duty hours. Employee or labor organizations may post organizational material or bulletins on departmental bulletin boards as approved by department heads. The material shall relate to the general purpose of the employee or labor organization. The City Manager 'may disapprove material which does not relate to the general purpose of the employee or labor organization. Employee or labor organization representatives shall be allowed reasonable time off without loss of compensation or other benefits when formally meeting and conferring with members of the Governmental Efficiency and Personnel Committee and/or the City Manager on matters of salaries, benefits, and working conditions. d. Section 3.14. 320(h) is renumbered (i). SECTION 4. Chapter 3.14 is amended by adding new Section 3.14.321 to read as follows: 3.14.321 City Rights. The rights of the City of Bakersfield include, but are not limited to, exclusive right to determine the mission of its constituent departments, commissions and boards; set standards of service; determine the procedures and standards of selection for employment and promotion; establish salary levels; direct its employees; take disciplinary action; relieve its employees from duty because of lack of work or for other legitimate reasons; maintain the efficiency of governmental operations; determine the method, means, and personnel by which government operations are to be conducted; determine the content of job classifications; take all necessary actions to carry out its mission in emergencies; and exercise complete control and discretion 'over its organization and the technology of performing its work. e SECTION 5. That Section 3.18.060 is amended to read as follows: 3.18.060 Salary Schedule.
