HomeMy WebLinkAboutORD NO 1794 ORDINANCE NO. 1794 NEW SERIES AN ORDINANCE OF THE CITY OF BAKERSFIELD AMENDING SECTION 7.52.070 OF THE MUNICIPAL CODE ALTERING THE LIMITS OF LIABILITY INSURANCE FOR TAXICABS IN THE CITY OF BAKERSFIELD. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Section 7.52.070 of the Municipal Code is amended to read as foliows: 7.52.070 Liability Insurance. It is unlawful for any owner to drive or operate or cause or permit to be driven or operated any taxicab or motor vehicle referred to herein, in the City of Bakersfield, until such owner shall have furnished the City of Bakersfield a good and sufficient policy of insurance securing the owner, as defined herein, and any other person using or responsible for the use of any such vehicle, with the consent, express or implied, of the owner, against loss from the liability imposed upon 'the owner by law for injury to, or death of, any person, or damage to property growing out of the maintenance, operation or ownership of any. such motor vehicle to the amount or limits as provided in Section 16500 of the Vehicle Code of the State of California for public liability and property damage resulting from accidents. The motor vehicle liability policy shall inure to the benefit of any and all persons suffering loss or damage, either to person or property, as herein provided, and the liability of the insurance carrier shall be in no manner abrogated or abated by the death of the tort feasor and/or the owner. The policy shall be'~ubject to ~he approval of the ~ity Manager and City Attorney of the City of Bakersfield. No policy shall be canceled except upon ten days written notice to the City Manager of intention to cancel. The motor vehicle liability insurance shall be a continuing liability up to the full amount thereof notwithstanding any recovery thereon, and the policy shall so certify. If the owner fails to replace said motor vehicle policy within the ten-day period with a good and sufficient policy as aforesaid, satisfactory to the City Manager and the City Attorney, the owner's permit issued hereunder shall be automatically suspended until such time as the requirement is complied with, and the Chief of Police shall enforce the suspension. SECTION 2. This ordinance shall become effective thirty days from and after the date of its passage. o0o.
