ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING VARIOUS SECTIONS OF
THE ZONING ORDINANCE SO AS TO ACCEPT
MINIMUM LOT SIZES LESS THAN 7,200 SQUARE
FEET WHEN DESIGNATED ON A FINAL SUB-
DIVISION MAP APPROVED BY THE CITY.
WHEREAS, it iS provided in the Subdivision regulations
that the Planning Commission may in its discretion reduce the
minimum lot size requirements therein when in its opinion such
reduction will not be detrimmntal to the public welfare or
injurious to the property or improvements of others, and
WHEREAS, the provisions for minimum lot area of the
zoning ordinances do not recognize reduced lot sizes that can
result from the approval of a subdivision map, and
WHEREAS, reasonableness of the law requires that a lot
size below the minimum of the zoning ordinance be acceptable when
established by a subdivision map approved by the Planning
Commission and the City Council.
NOW, THEREFORE, BE IT ORDAINED by the Council of the
City of Bakersfield as follows:
'~ECTION I.
Section 17.13.070 (Minimum Lot Area) be amended by the
addition of the following Subparagraph:
C. A lot may be of less than the minimum provided it
is a lot as shown on a recorded subdivision map approved by the
City of Bakersfield.
SECTION II.
Section 17.15.070 (Minimum Lot Area) be amended by the
addition of the following Subparagraph:
C. A lot may be less than the minimum provided it is
a lot as shown on a recorded subdivision map approved by the City
of Bakersfield.
SECTION III.
Section 17.17.070 (Minimum Lot Area) be amended by the
addition of the following subparagraph:
C. A lot may be less than the minimum provided it is a
lot as shown on a recorded subdivision map approved by the City of
Bakersfield.
SECTION IV.
Section 17.19.070 (Minimum Lot Area) be amended by the
addition of the following subparagraph:
C. A lot may be less than the minimum provided it is
a lot as shown on a recorded subdivision map approved by the ~ity
of Bakersfield.
SECTION V.
This ordinance shall become effective thirty days from
and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on the Mlst day of July, 1969, by the
following vote:
