AN ORDINANCE OF 'THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING CHAPTER 3.18 OF THE
MUNICIPAL CODE BY DELETING SECTION 3.18.110,
BY AMENDING SECTIONS 3.18. 130 AND 3.22.030,
AND BY ADDING SECTION 3.22. 040.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION I.
That Section 3.18.110 of the Municipal Code of the City
of Bakersfield is hereby deleted.
SECTION II.
That Section 3.18.130 of the Municipal Code of the City
of Bakersfield is hereby amended to read as follows:
3.18. 130 Salary Adjustments. (a) Effective date. Salary step
increases shall take effect immediately following qualification of
such advancement.
(b) Increment Date. Increment dates for permanent
employees of the City of Bakersfield shall be the last date of
salary step increase. When a class or 'position is allocated a new
salary range, employees holding such class or position shall have
their existing salary adjusted to the same step within the new
salary range, and such adjustment shall not alter the increment
date of the employee.
SECTION III.
That Section 3.22.030 of the Munici'pal Code of the City
of Bakersfield is hereby amended to read as follows:
3.22.030 Workmen's Compensation/Permanent Employees. Compensation
from City for Injury in Addition to Amount Received from State--
Approval of Application--Cessation of Payments. Whenever any
· permanent city employee, other than a city employee covered by
Section 4850 of the Labor Code of the State of California, is
disabled, whether temporarily or 'permanently, by injury or illness
arising out of and'in the course of his duties, he shall be entitled
to leave of absence while so disabled without loss of salary, for
the period of such disability as follows:
(1) Commencing at the same time as disability 'payments 'pursuant
to Labor Code 4650 begin, full salary less the amount paid for
temporary disability payments by the State Compensation Insurance
Fund on behalf of the city to said employee for a period of time
not exceeding one (1) year, or until said emp. loyee returns to work
or until such earlier date as said city employee is retired under
the Public Employees Retirement System or until temporary disability
'payments paid to said employee are terminated by the Insurance
Fund of the State of California, whichever event shall first occur.
SECTION IV.
That Section 3.22.040 is hereby added to the Municipa1
Code of the City of Bakersfield to read as follows:
3.22.040 Workmen's Compensation/Probationary and
Temporary Employees. Compensation for 'probationary and temporary
employees shall be in accordance with Sections 4650 and 4652 of
the State of California Labor Code.
SECTION V.
This ordinance shall become effective thirty days from
and after the date of its passage.
