HomeMy WebLinkAboutORD NO 1858 ORDINANCE NO. 18~8 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED NORTH OF PANORAMA DRIVE, WEST OF BOISE STREET AND EAST OF WENATCHEE STREET AND THAT PROPERTY KNOWN AS PARCEL #1 OF PANORAMIC HEIGHTS #3 ANNEXATION. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Cor~,~ission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain 'property in the City of Bakersfield located north of Panorama Drive, west of Boise Street and east of Wenatchee Street and that property known as Parcel #1 of Panoramic Heights #3 Annexation; and WHEREAS, the City Council has determined after due consideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries from an R-1 (Single Family Dwelling) Zone to an R-3-D (Limited Mulitple Family Dwelling - Archi- tectural Design) Zone, of certain property in the City of Bakersfield located north of Panorama Drive, west of Boise Street and east of Wenatchee Street, together with that certain property known as Parcel #1 of Panoramic Heights ~3 Annexation, being more · particularly described as follows, to wit: Those 'portions of Sections 10 and 15, T29S, R28E, M. D. B. M., in the City of Bakersfield, County of Kern, State of California, described as follows: The N 65 feet of the S 245.00 feet of the W 200.00 feet of the E 300.00 feet of the SW~ of the SE~ of said Section 10. The S 180.00 feet of the SW~ of the SE~ of said Section 10, EXCEPTING the W 305.00 feet and the E 100.00 feet thereof. ALSO EXCEPTING therefrom any portion of Tract No. 3256 'per Map Book 18 Pages 150 and 151 lying therein. All that portion of the NW~ of the NE~ of said Section 15, lying northerly of Tract No. 3256 per map book 18, 'pages 150 and 151, to~ether with zoning upon annexation of Parcel ~1 of Panoramic Heights ~3, being more 'particularly described as follows, to wit: A parcel of land situate in the County of Kern, State of California and being a portion of the SE~ of Section 10, T29S, R28E, M.D.B.M. Beginning at the 'point of intersection of the north line of south 180 feet of said Section 10 with the west line of the E~ of the SW~ of the SE~ of said Section 10, said intersection being also a point on the corporate boundary of the City of Bakersfield as defined by Ordinance No. 1792, New Series: Thence northerly departing from said corporate boundary along the last named west line to intersect the north line of the S~ of the SW~ of the SE~ of said Section 10; Thence easterly along the last named north line to intersect the west line of the east 550 feet of the SW~ of the SE~ of said Section 10; Thence northerly along the last named west line to a point which lies 400 feet south of the north line of the SW~ of the SE~ of said Section 10, as measured along said last named west line, said 'point being also a point on the corporate boundary of the City of Bakers- field as defined by said Ordinance No. 1792, New Series; Thence southeasterly, westerly, southerly and westerly along courses 5, 6, 7, and 8 of the last named corporate boundary to intersect the west line of the E~ of the SW~ of the SE~ of said Section 10, being the point of beginning, con- taining 5.14 acres, more or less. ..... o0o ..... --2-- I HEREBY CERTIFY that the foregoing Ordinance was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 20th day of April, 1970, by the following vote: CITY CLERK and Ex-Off~cio Clerk of the Council of the City of Bakersfield mPP~~~.~!.,........of m'pril, 1970 APPROVED: CITY.
