HomeMy WebLinkAboutORD NO 1880 ORDINANCE NO. 1880 NEW SERIES AN ORDINANCE APPROVING ANNEXATION OF A PARCEL OF UNINHABITED TERRITORY TO THE CITY OF BAKERSFIELD, CALIFORNIA, DESIGNATED AS "WILSON ROAD NO. 1", AND PROVIDING FOR THE TAXATION OF SAID TERRITORY TO PAY THE BONDED INDEBTEDNESS OF SAID CITY. WHEREAS, a petition was filed with the Council of the City of Bakersfield on the 6th day of July, 1970, requesting that certain uninhabited territory therein described be annexed to and incorporated within the City of Bakersfield, and WHEREAS, said petition was signed by the owners of one- fourth of the land, by area, and by assessed value as shown on the last equalized assessment roll of the County of Kern, and WHEREAS, the territory described in said petition is contiguous territory to be annexed, and WHEREAS, the said territory does not form a part of any other city, and WHiEREAS, prior to the date hereof there has been filed in the office of the City Clerk of the City of Bakersfield, a written consent, signed by the owners of more than two-thirds of the value of the territory, that said territory be subjected to taxation after the completion of such annexation equally with the property in the City of Bakersfield to pay the bonded indebtedness of said City therein described, as provided for in Ordinance No. 893, New Series, in Ordinance No. 950, New Series, in Ordinance No. 1752, New Series, in Ordinance No. 1229, New Series, in Ordinance No. 1364, New Series, and in Ordinance No. 1593, all of the City of Bakersfield, and any and all other indebtedness or liability of the City outstanding or authorized on and after the date of completion of said annexation, and this Council hereby determines that said consent is signed by the owners of more than two-thirds of the value of the territory, and complies in every respect with' the provisions of Section 35319 of the Government Code of the State of California, and WHEREAS, the Council of the City of Bakersfield did, on the 6th day of July, 1970, pass a Resolution being No. 46-70 in compliance with the provisions of the Annexation of Uninhabited Territory Act of 1939, and amendments thereto, being Title 4, Division 2, Part 2, Chapter 1, Article 5 of the Government Code of the State of California, specifically describing the boundaries of the territory so proposed to be annexed to the City of Bakersfield, and designating such territory by an appropriate name, and setting Monday, the 17th day of August, 1970, at the hour of 8:00 p.m. in the Council Chambers of the City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the day, hour and place when and where the City Council would hear protests made by any person owning real property within the aforesaid territory, and WHEREAS, said Resolution was published at least twice, but not oftener than once a week in the Bakersfield Californian, a newspaper of general circulation published in the City of Bakersfield, and also in The Shafter Press, a newspaper of general circulation published outside of the City of Bakersfield, but in the county where said territory is located, said publications having been completed at least twenty days prior to the da~ set for said hearing, in compliance with Section 35311 of the Government Code, and WHEREAS, the City Clerk of the City of Bakersfield has caused written notice of such proposed annexation to be given by ..m~$.!. at least twenty .days b.efore t.he pu~!ic..hearing on _said proposed annexation to the persons entitled thereto, in compliance with subdivisions (a) and (b) of Section 35311 of said Government Code, and WHEREAS, at the time set for hearing protests, a majority protest was not made against the proposed annexation by owners of property within the territory proposed to be annexed. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. That the City Council of the City of Bakersfield hereby approves the annexation to and inclusion within the incorporated limits of the City of Bakersfield, of that certain uninhabited territory designated as "Wilson Road No. 1"; and it is hereby further ordained that said territory be and the same is hereby annexed to said City; that said territory is described as follows: A parcel of land situate in the County of Kern, State of California, and being a portion of Section 11, Township 30 South, Range 27 East, M.D.B.& M. Beginning at. the intersection of the south line of the NE 1/4 of the NE 1/4 of said Section 11 with the east line of the west 30 feet of the NE 1/4 of the NE 1/4 of said Section 11, said intersection being the southwest corner of lot 67, Tract No. 2628, as said Tract No. 2628 is shown on a map recorded November 24, 1961 in Book 12 of Maps, at Page 105, records of said Kern County and said intersection also being a point on the Corporate Boundary of the City of Bakersfield as defined by Ordinance No. 1500, New Series; Thence (1) Easterly departing from said Corporate Boundary, along the last-named south line 950.74 feet, to intersect the west right-of-way line of U.S. Highway Route 99 (VI-KER-99), Bakersfield By-Pass, said intersection being the southeast corner of said Tract No. 2628 and being also a point on the Corporate Boundary of the City of Bakersfield as defined by Ordinance No. 1473, New Series; Thence (2) Southerly, 330 feet, more or less, along the last-named - right-of-way line also being along course (8) of the last-named Corporate Boundary to the southerly terminus of said course (8), said southerly terminus being a point on the Corporate Boundary of the City of Bakersfield as defined by Ordinance No. 1679, New Series; Thence (3) Southerly along courses 78, 77, 76, 75 and a portion of course 74 of the last-named Corporate Boundary to intersect the north line of the SE 1/4 of the SE 1/4 'of Said Section 11, said intersection also being a point on the north line of Lot 31, as said Lot 31 is shown on a map entitled "Sales Map of Lands of Kern County Land. Company_ in Section 11, T. 30 S., R. 27 E., M.D.B.& M., Kern County, Calzfornia", filed for record January 25, 1894 in the office of the Recorder of said Kern County, said intersection also me being the northeast corner of Lot 10, Tract No. 2605 as shown on a map recorded November 30, 1962 in Book 13 of Maps, at Page 91, records of said Kern County; Thence (4) N 89°35'07"W, along the last-named north line, being also along the north line of said Tract No. 2605, 671.678 feet, to the northwest corner of Lot 1, said Tract No. 2605; Thence (5) S 0°02'37"E, 110.02 feet, to the southwest corner of Lot 1, said Tract No. 2605; Thence (6)S8~°57'23"W, 29.99 feet, to the northwest corner of Lot "A", said Tract No. 2605; Thence (7) S 0°02'37"E, 172.50 feet, to the southwest corner of said Tract No. 2605; Thence (8) S 89°57'23"W, 240.00 feet, to intersect the east line of the west 40 feet of the SE 1/4 of the SE 1/4 of said Section 11, said intersection being also the northwest corner of Lot 1, Tract No. 2604, as said Tract No. 2604 is shown on a map recorded November 2, 1962 in Book 13 of Maps, at page 78, records of said Kern County; Thence (9) S 0°02'37"E, along the last-named east line, 972.125 feet, to the point of beginning of a tangent curve, said beginning of curve being a point on the west line of Lot 38, Tract No. 2570, as said Tract No. 2570 is shown on a map recorded October 17, 1961 in Book 12 of Maps, at page 81, Records of said Kern County; Thence (10) Southeasterly along the last-named curve, concave to the northeast with a radius of 20 feet, through a central angle of 89°35'35'' an arc distance of 31.274 feet to a point of tangency on the north line of the south 45 feet of said Section 11; Thence (11) Westerly along the last-named north line, 660.45 feet, more or less, to intersect the east line of the W 1/2 of the SW 1/4 of the SE 1/4 of said Section 11, said intersection being also the east line of Lot 29 of the aforesaid "Sales Map"; Thence (12) N 0°ll'05''E along the las t-named east line as shown on the map of Tract No. 3177 to a point which lies 1197.913 feet northerly of the south line of said Section 11 as measured along said east line, said point also being the northeast corner of Tract No. 3177 as said Tract No. 3177 is shown on a map recorded July 26, 19§§ in Book 16 of Maps, at page 130, Records of said Kern County; Thence (13) N 89°49'07"W, 615.487 feet, to intersect the east line of the west 45 feet of the SE 1/4 of said Section 11, said inter- section also being the northwest corner of Lot 1, said Tract No. 3177; Thence (14) N 0°10'53"E, along the last-named east line, 611.961 feet, to the southwest corner of Lot 57, Tract No. 2514, as said Tract No. 2514 is shown on a map recorded April 5, 1962 in Book 12 of Maps, page 173, records of said Kern County; Thence (15) S 89°49'07"E 615.523 feet to intersect the east line of the W 1/2 of the NW 1/4 o~ the SE 1/4 of said Section 11, said inter- section also being the southeast corner of said Tract No. 2514; Thence (16) N 0°ll'05"E, along the last-named east line, 320.00 feet, to the northeast corner of Lot 49, said Tract No. 2514; Thence (17) N 89°49'07"W, 615.542 feet, to intersect the east line of the west 45 feet of the SE 1/4 of said Section 11, said inter- section also being the northwest corner of Lot 41, said Tract No. 2514; Thence (18) N 0°10'53"E, along the last-named east line and northerly extension thereof, 565.54 feet, more or less to intersect the north line of the south 45' of the NE 1/4 of said Section 11, said inter- section also being a point on the easterly extension of the south line of Lot 18, Tract No. 2458, as said Tract No. 2458 is shown on a map recorded December 1, 1960 in Book 11 of Maps, at page 142, Records of said Kern County; Thence (19) S 89°18'10"E along the last-named north line to a point which bears S 89°18110"E, 435.00 feet and N 0°10'43"E, 45.002 feet from the southwest corner of the NE 1/4 of said Section 11, said point also being the intersection of the east line of Tract No. 2459 with the easterly extension of the south line of Lot 55, Tract No. 2459, as said Tract No. 2459 is shown on a map recorded May 12, 1961 in Book 11 of Maps, page 193, records of said Kern County; Thence (20) N 0°10'43"E, 615.948 feet; Thence (21) S 89°16'36"E, 232.00 feet; Thence (22) N 0°10'43"E, 660.844 feet to a point on the Corporate Boundary of the City of Bakersfield as defined by Ordinance No. 1500, New Series, said point also being the northeast corner of Lot 63, said Tract No. 2459; Thence (23) Easterly along the last-named Corporate Boundary, 297.763 feet, to the point of beginning, containing 137.84 acres, more or less. Said territory, and the property located therein, shall, upon the completion of the annexation of the same to the City of Bakersfield, be subjected to taxation equally with other property in the City of Bakersfield to pay the bonded indebtedness of the City of Bakersfield, described in the aforementioned consent of the owners of property, located therein, the issuance of bonds to represent said indebtedness being provided for in Ordinance No. 893, New Series, in Ordinance No. 950, New Series, in Ordinance No. 1752, N.ew._Ser. ies., in Ordinance No. 1229, New Series, in Ordinance No. 1364, New Series, and in Ordinance No. 1593, all of said City, and any and all other indebtedness or liability of the City outstanding or author- ized on and after the date of completion of said annexation. SECTION 2.
