HomeMy WebLinkAboutORD NO 1894 ORDINANCE NO. 1894 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING CHAPTER 16.24 OF THE MUNICIPAL CODE REQUIRING THE UNDBRGROUNDING 0F ALL UTILITIES IN NEW SUBDIVISIONS. WHEREAS, the Public Utilities Commission of the State of California in Case No. 8209 has found from the evidence derived from a series of public hearings that the general welfare of the people of this State demand for reasons of safety, reliability and aesthetic, the undergrounding of all private utility facilities in areas of new construction; and WHEREAS, it has been made clear from the record that electric and communications utilities, both privately and publicly owned, are aware of this demand and are willing to accommodate it, and WHEREAS, the Public Utilities Commission has promulgated rules and regulations by which the utilities and developers are to accomplish such undergrounding in new residential subdivisions; and WHEREAS, this Council has for many years supported the principle of undergrounding utilities; and WHEREAS, Section 16.24.010(B) of the Municipal Code of the City of Bakersfield now authorizes the Planning Commission to recommend and the City Council to require undergrounding in new subdivisions when in their judgment a necessity exists; and WHEREAS, the Council now desires to require as a standard improvement the undergrounding of all utilities in new subdivisions with certain exceptions. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield that paragraph (B) of Section 16.24.010 of the Municipal Code is hereby repealed. BB lIT FURTHER ORDAINED that Section 16.24.010 paragraph (A) be amended by adding an additional minimum improvement required designated: (11) All utility distribution facilities including cable television must be placed underground. Where applicable, such installation shall be in accordance with rules and regulations of the Public Utilities Commission of the State of California. Such require- ments for- a residential subdivision may only be waived by the Public Utilities Commission; in any other type of subdivision, the Planning Commission may waive such requirements upon a finding of conditions which make underground installations impractical. As amended Section 16.24.010 of the Municipal Code shall read as follows: 16.24.010 Street Improvements--Minimum Improvements--Underground Utility Wires. (A} The subdivider shall improve, or agree to improve, all streets, ihighways or ways in the subdivision. Improvements shall be installed to permanent line and grade and to the satisfaction of the City Engineer in accordance with standard specifications of the City of Bakersfield on file in the office of the City Clerk and the City Engineer. The minimum improvements which the subdivider shall make, or agree to make, prior to acceptance and approval of the final subdivision map by said City Council, shall be: (1) Grading, curbs and gutters, drainage and drainage structures necessary to the proper use and drainage of streets, highways and ways and/or to the public safety. {Z) Pavement of a width and quality suitable for the local neighborhood traffic. ($} Sidewalks, which shall be contiguous to the curb and shall be of a minimum width of four and one-half (4½) feet from the back face of the curb. (4) Water system with mains of sufficient size and having a sufficient number of outlets to furnish adequate domestic water supply for each lot of the subdivision and to provide adequate fire protection to meet local neighborhood needs. (S) Sanitary sewer facilities and connections for each lot where an outfall sewer is reasonably available. (6) Services from public utilities where provided and from sanitary sewers shall be made available for each lot in such manner as will obviate the necessity for disturbing the street pave- ment, gutter, culvert and curb, when service connections are made. (7) Street trees when required by the City Council, shall be planted of a type, size spacing, and at the time or within one year after the approval of the final map as specified by the City Engineer. (8) Street name signs shall be installed in accordance with the City of Bakersfield standards. (9) A chain link fence five (S) feet in height shall be installed between any subdivision and the right-of-way line of any irrigation canal. The fence shall be the standard design of the City of Bakersfield. (i0) Final soil report shall have been completed and approved by the Chief Building Inspector prior to the beginning of construction of any surface improvements. (11) Ail utility distribution facilities including cable television must be placed underground. ~here applicable, such installation shall be in accordance with rules and regulations of the Public Utilities Commission of the State of California.
