AN ORDINANCE APPROVING ANNEXATION OF A PARCEL
OF UNINHABITED TERRITORY TO THE CITY OF
BAKERSFIELD, CALIFORNIA, DESIGNATED AS
"CALIFORNIA AVENUE NO. 3," AND PROVIDING
FOR THE TAXATION OF SAID TERRITORY TO PAY
THE BONDED INDEBTEDNESS OF SAID CITY.
WHEREAS, a petition was filed with the Local Agency
Formation Commission on the 22nd day of December, 1970, requesting
that certain uninhabited territory therein described be annexed to
and incorporated within the City of Bakersfield; and
WHEREAS, said petition was signed by the owners of all
the land, by area, and by assessed value as shown on the last
equalized assessment roll of the County of Kern; and
WHEREAS, the territory described in said petition is
contiguous territory to be annexed; and
WHEREAS, the said territory does not form a part of any
other city; and
WHEREAS, prior to the date hereof there has been filed
in the office of the City Clerk of the City of Bakersfield, a
written consent, signed by the owners of the entire real property
constituting the entire value of the territory, that said territory
be subjected to taxation after the completion of such annexation
equally with the property in the City of Bakersfield to pay the
bonded indebtedness of said City therein described, as provided for
in Ordinance No. 893, New Series, in Ordinance No. 950, New Series,
in Ordinance No. 1112, New Series, in Ordinance No. 1229, New
Series, in Ordinance No. 1364, New Series, and in Ordinance No.
1593, New Series, all of the City of Bakersfield, and any and all
other indebtedness or liability of the City outstanding or authorized
on and after the date of completion of said annexation, and this
Council hereby determines that said consent is signed by the owners
of the entire real property constituting the entire value of the
territory, and complies in every respect with the provisions of
Section 35319 of the Government Code of the State of California;
and
WHER~AS, this ordinance is adopted pursuant to the pro-
visions of Section 35015 of the Government Code of the State of
California, providing for summary annexation of uninhabited territory
where all owners of said territory consent to said annexation; that
said annexation is pursuant to Chapter 1, Part 2, Division 2 of the
Government Code of the State of California; that the Local Agency
Formation Commission in Kern County has given its approval on the
9th day of February, 1971, to said proposed annexation pursuant to
Section 54797.1 of the Government Code of the State of California;
and that the boundaries of the territory so proposed to be annexed
to the City of Bakersfield are specifically described and set forth
in this ordinance.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield, as follows:
SECTION 1.
That the City Council of the City of Bakersfield hereby
approves the annexation to and inclusion within the incorporated
limits of the City of Bakersfield, of that certain uninhabited
territory designated as "California Avenue No. 3"; and it is hereby
further ordained that said territory be and the same is hereby
annexed to'said City; that said territory is described as follows:
A parcel of lgnd situate in the County of Kern, State of California,
and being a portion of E 1/2 of Section 34, Township 29 South,
Range 27 East, M.D.B.& M.
Commencing at the south one-quarter corner of said Section 34;
Thence (1) (using as a basis of-bearing the bearing of the west
line of the E 1/2 of said Section 34 as shown on the map of Tract
No. 2763, recorded November 23, 1962 in Book 13 of Maps, at page
87, Records of said Kern County) N 0°45'49'' E, along the west line
of the E 1/2 of said Section 34, 1216.00 feet, to the true point of
beginning for this description;
Thence (2) continuing N 0°45'49'' E along the last named west line,
2464 feet, more or less, to intersect the Corporate Boundary of the
City of Bakersfield;
Thence (3) easterly, southerly, southwesterly and westerly along
said Corporate Boundary to a point which is the westerly terminus
of Course 5 of the Corporate Boundary of the City of Bakersfield
as defined by Ordinance No. 1846, New Series, said westerly terminus
being a point on the east line of that certain parcel of land as
described in a deed recorded July 10, 1963 in Book 3623, Page 963,
official records of said Kern County, said point lying S 89 02'51" E,
700.901 feet and S 0o57'09'' W, 270.00 feet from the true point of
beginning for this description;
Thence (4) S 0°57'09'' W along the last named Corporate Boundary
and east line, 63.00 feet;
Thence (5) departing from said Corporate Boundary, N 89°02'51'' W,
30.00 feet;
Thence (6) N 0°57'09'' E, 313.00 feet to the beginning of a tangent
curve;
Thence (7) northerly and westerly along said curve, concave to the
southwest, with radius of 20 feet, through an angle of 90°00' an
arc distance of 31.416 feet to a point of tangency on the south line
of the north 30 feet of the parcel of land referenced by the above
course (3);
Thence (8) N 89Q02'51'' W, 650.901 to the true point of beginning,
containing 113.96 acres, more or less.
Said territory, and the property located therein, shall
upon the completion of the annexation of the same to the City of
Bakersfield, be subjected to taxation equally with other property
in the City of Bakersfield to pay the bonded indebtedness of the
City of Bakersfield, described in the aforementioned consent of
the owners of property, located therein, the issuance of bonds to
represent said indebtedness being provided for in Ordinance No. 893,
New Series, in Ordinance No. 950, New Series, in Ordinance No. 1112,
New Series, in Ordinance No. 1229, New Series, in Ordinance No. 1364,
New Series, and in Ordinance No. 1593, New Series, all of said City,
and any and all other indebtedness or liability of the City out-
standing-or authorized on a~d after the date Of 'completion of said
annexation.
SECTION 2.
This ordinance shall become effective thirty days from
and after the date of its passage.

I []~REBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 22nd day of March, 1971, by the following
vote:
