HomeMy WebLinkAboutORD NO 1926 ORDINANCE NO. 1926 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 12.28. 020 OF CHAPTER 12.28 OF THE MUNICIPAL CODE REQUIRING REMOVAL OF OVERHEAD UTILITY FACILITIES AND COMPLETION OF UNDERGROUND INSTALLATION IN ACCORDANCE WITH SCHEDULE. WHEREAS, the City Council has made the following determinatioms: 1. That at least forty per cent (40%) of the total work has been completed in accordance with the schedule set forth in Chapter 12.28 of the Municipal Code. / 2. That it is in the best interests of the~ City of Bakersfield 'to extend by five years the time within which such Chapter requires that at least sixty per cent (60%) of the-work be completed. 3. That it is in the best interests of the City of Bakersfield 'to extend by five years the time within which such Chapter requires that at least eighty per cent (80%) of the work be completed. 4. That it is in the best interests of the City of Bakersfield 'to extend by five years the time within which such Chapter requires that one hundred per cent (100%) of the work be completed. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 12.28.020 of Chapter 12.28 of the Municipal Code is hereby amended to read as follows: 12.28. 020 Overhead Wires - When Prohibited - Removal. (a) After three hundred sixty (360) months from January 7, 1959, the effective date of this Chapter, it shall be unlawful for any person to maintain, use, continue to use, operate, or continue to operate or install, any overhead utility lines or wires, poles, or other similar overhead utility facilities on any public street, way, alley, or thoroughfare within said Electric Underground District. (b) In order to provide for the orderly removal of existing overhead utility lines and appurtenances within the three hundred sixty (360)'months specified, each utility subject to this Chapter shall complete the underground installation of its facilities within the District in accordance with the following schedule: (1) By June 30, 1963, at least twenty per cent (20%) of said utility's total overhead facilities. (2) By June 30, 1968, at least forty per cent (40%) of said utility's total overhead facilities. (3) By June 30, 1978, at least sixty per cent (607o) of said utility's total overhead facilities. (4) By June 30, 1983, at least eighty per cent (80%) of said utility's total overhead facilities. (5) By June 30, 1988, one hundred per cent (1007o) of said utility's total overhead facilities. The computation of the percentage of the work completed and to be completed as set forth in the above schedule shall be based upon the footage of the overhead facilities in existence on December .8, 1958. (c) Within thirty (30) days after each of the dates shown in the preceding paragraph, each utility subject to this Chapter shall report t° the City Engineer the work accomplished toward replacement of' over-head facilities with underground facilities during the preceding five (5) years, and the percentage relationship of the total underground installation accomplished to the total amount required to be completed on or before June 30, 1988. SECTION 2.
