AN ORDINANCE OF THE COUNCIL OF THE CITY
OF BAKERSFIELD REPEALING VARIOUS CHAPTERS
OF THE MUNICIPAL CODE RELATING TO FIRE
PREVENTION AND ADOPTING THE UNIFORM FIRE
(;ODE WITH ITS NATIONALLY RECOGNIZED
STANDARDS AS HEREINAFTER AMENDED.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.

That: Chapter 14.01 Uniform Fire Code is hereby added to
the Municipal Code of the City of Bakersfield as follows:

UNIFORM FIRE CODE

14.01.010 Adoption of Uniform Fire Code. Except as hereinafter
modified, that certain Fire Code known and designated as the "Uniform
Fire Code," 1967 Edition, which was reco~tended and adopted by the
California Fire Chiefs' Association in 1961 and the nationally
recognized standards incorporated therein by Section 1.25 of that
code, three copies of which are filed in the Office of the City Clerk
of the City of Bakersfield, for use and examination by the public, as
directed by Section 50022.6 of the California Government Code, is
hereby adopted as modified and amended in this title and is declared
to be the Fire Prevention Code of the City of Bakersfield for the
purpose of prescribing regulations governing conditions hazardous to
life and property from fire and explosion within the incorporated
limits of the City of Bakersfield.
14.01.020 Deletions From the Uniform Fire Code. The following
sections and articles of the Uniform Fire Code, 1967 Edition, are
not adopted as part of this ordinance and are hereby deleted:

Uniform Fire Code is amended to read:
h. The investigation of the cause and origin of fire.
14.04.020 Section 1.17 Investigations of the Uniform Fire Code
is amended to read: The Chief of the Fire Department shall investi-
gate the cause and origin of each and every fire occurring in the
City in which property has been destroyed or damaged and if it appears
to the officer making the investigation that such fire is of suspicious
origin, he shall preserve the physical evidence and notify the proper
authority designated by law to make the investigation of such matters
and on request: shall further cooperate with them in the collection of
evidence and in the prosecution of the case.
14.04.030 Section 1.18 Right of Entry is amended to read:
a. The Chief of the Fire Department or his authorized represen-
tative may, with the consent of the person in lawful possession, enter
any building, structure, or premise within the corporate limits of the
City of Bakersfield for the purpose of making an inspection or investi-
~gation relative to the~enforcement ~f .t~is Code._~.~ould_~dmittanc~~
be denied, an appropriate search warrant shall be obtained from the
Municipal Court under the direction of the City Attorney.

b. In the event of an emergency posing an immediate threat to
the safety of the area, the Chief or his authorized representative
shall have the authority to enter any building, structure or premise
for the purpose of extinguishing or controlling any fire, performing
any rescue operations, investigating and surpressing the existence of
suspected or reported fires, gas leaks, or other hazardous conditions.
14.04.040 Section 1.20 Service of Orders and Notices is amended
to read: Any order or notice authorized or required by this Code
shall be given, or served upon the owner, operator, occupant or other
person responsible for the conditions or violations by delivering the
same to and leaving it with some person of suitable age and discretion
upon the premises, or if no such person is found on the premises, by
affixing a copy thereof in a conspicuous place on the door to the
entrance of said premises and by mailing a copy thereof to such person
by registered mail to his last-known address.
14.04.050 Section 1.21 Compliance and Contents of Notice or
Order~is amended to read:
a. Any order or notice issued or served as provided in this
Code shall be complied with by the owner, operator, occupant or other
person responsible for the condition or violation to which the order
or notice applies. In case of extreme danger to persons or property,
immediate compliance shall be required. If the building or other
premises is owned by one person and occupied by another under lease
or otherwise, and the order or notice requires addition or change in
the building or premises such as would i~m~ediately become real estate
and be the property of the owner of the building or premises, such order
or notice shall be complied with by the owner unless the owner and
occupant have otherwise agreed between ~hemselv~s in which ev~nt'th~
occupant shall comply.
b. Every notice or order shall set forth the exact nature of
the defect and the corrective measure required; the time allowed for

compliance depending upon the hazard and danger created by the
violation; the parties right to an appeal; and the name of the
person to be contacted for more particulars.
14.04.060 Section 1.36 Revocation of Permits is amended to read:
Any permit or certificate issued under this Code may be suspended or
revoked when it is determined after a hearing by the Housing Advisory
and Appeals Board that:
a. It is used by a person other than the person to whom
the permit or certificate was issued.
b. It is used for a location other than that for which
it was issued.
c. Any of the conditions or limitations set forth in the
permit or certificate have been violated.
d. The permittee fails, refuses or neglects to comply
with any order or notice duly served upon him under
the provisions of this code within the time provided
therein.
e. There has been any false statement or misrepresentation
as to a material fact in the application or plans on
which the permit or application was based.
14.04.070 Section 1.63 Vapor Pressure is amended to read:
Vapor pressure shall mean the pressure, measured in pounds per square
inch (absolute) exerted by a volatile fluid as determined by the
"Standard Method of Test for Vapor Pressure of Petroleum Products"
(Reid Method) A.S.T.M. D-323.
14.04.080 Section 2.07 Buffing Machines is added to read:
There shall be installed one sprinkler head connected to the City
water system over each buffing machine. The water supply pipe shall
be not less than three-fourths inch (3/4").
14.04.090 Section 3.02 Permit Required is amended to read:
No person shall conduct or maintain any wrecking yard, junk yard or
waste material-handling plant without a permit.
14.04.100 Article 5 Cellulose Nitrate Motion Picture Film is
amended to read: Cellulose Nitrate Film.
14.04.110 Section 5.01 Scope is amended to read: This Article
applies to the storage and handling of cellulose nitrate film,
hereinafter referred to as "nitrate film". Film having a cellulose
acetate or other approved slow-burning base, marked safety film,
is exempt from these provisions.
14.04.120 Section 5.02 Permit Required is amended to read:
a. No person shall store, keep or have on hand more than 25
pounds (for 35 ~mL~. film about 5,000 feet) of nitrate film without
a permit.
b. No person shall sell, lease or otherwise dispose of any
nitrate film to any person not having a permit to handle, use or
display such film.
14.04.130 Section 5.03 Storage of Film is amended to read:
Storage of nitrate film, not in process or being worked on, shall
be in accordance with the following:
a. Except as provided in paragraph c. of this section, amounts
in excess of 25 pounds (5 standard rolls) but not in excess of 1,000
pounds (200 standard rolls) shall be kept in approved cabinets or in
vaults.
b. Amounts in excess of 1,000 pounds shall be kept in vaults.
c. Unexposed nitrate film enclosed in the original, unbroken,
shipping cases, conforming to I.C.C. regulations shall be kept in a
sprinklered room. If the amount exceeds 750 pounds (150 standard
rolls) it shall[ be stored in a room used for no other purpose.
14.04.140 Section 8.08 Storage and Use of Cylinders is amended
to read: All compressed gas cylinders in service or in storage shall
be adequately secured'to prevent falling or being knocked over. This
shall be accomplished by the installation of sa~e~y chains o2 suitable
size.
14.04.150 Section 9.03(3) General Requirements is amended to
read: Smoking and the carrying of matches, the use of heating or
other devices employing an open flame, or use of any spark-producing
equipment is prohibited in areas containing dust-producing or dust-
agitating operations. Artificial lighting in such areas shall be by
electricity with all wiring and electrical equipment installed in
accordance wit'h the provisions of the National Electric Code.
14.04.160 Section ll.08d Transportation of Explosives is amended
to read:
d. Every vehicle when used for transporting explosives shall
be equipped with not less than one approved type fire extinguisher
with a minimum rating of 2A, 20B, C, or two approved type fire
extinguishers, one of which shall have a minimum rating of 2A and the
other a minimum rating of 20B, C. Extinguishers shall be so located
as to be readily available for use.
14.04.170 Section 12.02b Manufacture~ Sale and Discharge of
Fireworks is amended to read: Except as hereinafter provided, it
shall be unlawful for any person to possess, store, to offer for sale,
expose for sale, sell at retail, or use or explode any fireworks,
provided that the Chief shall have power to adopt reasonable rules
and regulations for the granting of permits for supervised public
display of fireworks by the municipality, fair association, amusement
parks, other organizations or for the use of fireworks by artisans in
pursuit of their trade. Every such use or display shall be handled
by a competent operator approved by the Chief, and shall be of such
character and so located, discharged or fired as in the opinion of
the Chief after proper investigation so as not to be hazardous to
property or endanger any person.
Nothing in this Article shall be construed to prohibit
possession and use of model rockets and model rocket engines as they
are defined and regulated under the provisions of California
Administrative Code, Title 17, Article 14 (Sections 1062-1087). The
possession and use of model rockets and model rocket engines shall
be pursuant to a permit issued by the Chief under such rules and
regulations as he may adopt in accordance with the provisions of
California Administrative Code, Title 19, Article 14, February 25,

14.04.180 Section 13.02 Interference With the Fire Department
is amended to read: No person or persons shall knowingly obstruct
or otherwise interfere with the operations of the Fire Department in
connection with extinguishing any fire, or other emergency, or dis-
obeying any reasonable order of the Chief or officer of the Fire
Department who may be in charge at such a scene, or any part thereof,
or any peace officer assisting the Fire Department.
14.04.190 Section 13.27 Unsafe Buildings is amended to read:
All buildings and structures which constitute a fire hazard or are
otherwise dangerous to human life by reason of inadequate maintenance,
dilapidation, obsolescence or abandonment, are for the purpose of this
section declared to be unsafe buildings. Such buildings are hereby
declared to be public nuisances and shall be abated by repair,
rehabilitation., demolition or removal, in accordance with the pro-
cedures specified in the Uniform Building Code, Vol. I~ Dangerous
Buildings.
14.04.200 Section 13.45 Water Supply is amended to read:
a. It shall be the duty of any person, supplying water to the
City of Bakersfield and its inhabitants through hydrants located
upon streets, alleys or public places within the City of Bakersfield,
whenever ~y reason of repairs or work, or from any cau§~ ~he'-Water~is
to be turned off from such hydrants, to notify the Fire Chief of said
City thereof, when hydrants are placed out of service and again when
service is restored and in case of an alarm of fire in the City, it
shall be the duty of such person, firm or corporation to turn into
all the mains and hydrants all the water necessary or available.
b. In case such person be engaged in work upon any line of pipe
necessitating the turning off of water, no such line of pipe shall be
left open or empty during the night, or when work is not actually
going on therein and if any line of pipe be opened at the time of
quitting work or when a-n alarm of fire is given a cap or thimble shall
i~m~ediately be placed closely over the mouth of such pipe and the water
left in as far as possible for the use of the Fire Department. Any
person, having charge or control of any pipe or hydrants, in doing
or ordering work done in or upon the same who shall violate any pro-
vision of this section shall be guilty of a misdemeanor.
c. It shall be unlawful for any driver of any vehicle to drive
or cause the same to be driven over any hose while said hose is being
used by the Fire Department.
14.04.210 Section 14.22h Spray Booths is amended to read:
When spraying areas are illuminated through wire glass panels or other
transparent materials, only fixed lighting units shall be used as a
source of illumination. Panels shall effectively isolate the spraying
area from the area in which the lighting unit is located and shall
be of noncombustible material of such a nature or so protected that
breakage will be unlikely. Panels shall be so arranged that normal
accumulations of residue on the exposed surface of the panel will
not be raised to a dangerous temperature by radiation or conduction
from the source of illumination.
14.02.220 Section 14.40c(5) Equipment Type and Location is
amended to read: Hand electrostatic equ~p~nent shall be interlocked-
with the ventilation system for the spraying area so that the equip-
ment cannot be operated unless the ventilating system is in operation.

14.04.230 Section 14.45 Automobile Undercoatin8 is added to read:
Automobile undercoating spray operations, conducted in areas having
adequate natural or mechanical ventilation, may be exempt from the
provisions of division 2 of this article, on approval by the Chief
of the Bureau of Fire Prevention, when using undercoating materials
which are not more hazardous than kerosene, or undercoating materials
using only solvents having aflash point in excess of 100° F.
14.04.240 Section 15.102a & f Definitions is'amended to read:
a. "Boiling Point" shall mean the boiling point of a liquid
at a pressure of 14.7 psia (760mm). Where an accurate boiling point
is unavailable for the material in question, or for mixtures which
do not have a constant boiling point, for purposes of this classifi-
cation, the tea per cent (10%) point of a distillation performed in
accordance with the Standard Method of Test for Distillation of
Petroleum Products ASTM D-86 may be used as the boiling point of the
liquid.
f. The flash point of liquids having a flash point at or below
175~ F. (79° C.), except for fuel oils and certain viscous materials,
shall be determined in accordance with the Standard Method of Test
for Flash Point by the Tag Closed Tester, ASTM D-56.
The flash point of liquids having a flash point above 175°F.,
except for fuel oils, shall be determined in accordance with the
Standard Method of Test for Flash Point by the Cleveland Open Cup
Tester, ASTM D~92.
The flash point of fuel oil, and certain viscous materials
having a flash point at or below 175°F., shall be determined in
accordance with the Standard Method of Test for Flash Point by the
Pensky-Martens Closed Tester, ASTM D-93. ~-
14.04.250 Section 15.103 Permits Required is amended to read:
A person shall obtain a permit for the following:

a. Storage, handling or use of Class I fla~able liquids in
containers exceeding one pint (16 fluid ounces) in individual capacity
and one gallon in aggregate capacity in a dwelling or other place of
hUman habitation; or in excess of one gallon in any other building or
other occupancy, or in excess of one gallon outside of any building,
provided that no permit shall be required for the following:
(1) For the storage or use of flammable liquids in the fuel
tank of a motor vehicle, aircraft, motor boat, mobile power plant or
mobile heating plant.
(2) For the storage or use of paints, oils, varnishes or
similar flammable mixtures when such liquids are stored for mainten-
ance, painting or similar purposes for a period of not more than 30
days.
b. Storage, handling or use of Class II or III liquids in excess
of 25 gallons in a commercial or manufacturing building; or in excess
of 60 gallons outside of a commercial or manufacturing building except
for fuel oil used in connection with oil-burning equipment.
c. Construction, installation and use of equipment and premises
for the storage, handling, use or sale of flammable or combustible
liquids as herein stipulated. The required permit shall be obtained
prior to the commencement of any work.
14.04.260 Section 15.104 Containers~ Tanks~ Equipment and
Apparatus is amended to read: Containers, tanks, equipment, and
apparatus used. or intended to be used for the storage, handling, use
or sale of flammable or combustible liquids shall be of an approved
type. Glass containers shall not be approved except where contamina-
tion is a factor. Samples of not to exceed one quart individual
-capacity may be taken in-glass containers for-co~mL~ercial reference
or testing.
14.04.270 Section 15.202a Location With Respect to Buildings and

Property Lines is amended to read:
a. The location of aboveground tanks for the storage of
flar~m~able and combustible liquids with respect to buildings, property
lines, and public ways shall be in accordance with the following
provisions:
(1) Tanks for the storage of flaLmnable or combustible
liquids, except those liquids with boilover characteristics and
unstable liquids, operating at pressures not in excess of 2.5 psig
and equipped with emergency venting which will not permit pressures
to exceed .2.5 psig shall be located in accordance with Table I.

*Protection for exposures shall mean fire protection for structures on
property adjacent to tanks. When accepta'ble to the Chief of the
Bureau of Fire Prevention, such structures located (1) within the
jurisdiction of any public fire department or (2) within or adjacent
to plants having private fire brigades shall be considered as having
adequate protection for exposures.
(2) Every aboveground tank for the storage of flammable or
combustible liquids, except those liquids operating at pressures
exceeding 2.5 psig and equipped with emergency venting which will

14.04.280 Section 15.207b & d(3) Design and Construction of
Tanks Operating at Substantially Atmospheric Pressure is amended to
read:
b. Field Erected Vertical Tanks. Vertical tanks erected in
the field shall be built in accordance with the following specifica-
tions:
Current AP1 Standard No. 12A, September, Specification for Oil
Storage Tanks with Riveted Shells;
Current AP1 Standard No. 12B, September, with Supplement
Specifications for Bolted Production Tanks;
Current AP1 Standard No. 650, Specification for Welded Steel
Tanks for Oil Storage;
Current AP1 Standard No. 12D, Specification for Large Welded

d. (3) Tanks shall be welded or riveted and caulked or
otherwise made tight in a workmanlike manner. The roof of the'tank
shall be securely fastened to the top ring of the shell with a joint
having the same tightness as the joints between rings. The joint
between roof and shell shall be weaker than any other joints in the
shell of the tank. Joints in the roof shall be welded or riveted or
made tight by other process satisfactory to the Chief of the Bureau
of Fire Prevention. Roofs of tanks shall have no unprotected openings.
NOTE: Tanks built in accordance with the current AP1 Standard
No. 650, 'Welded Steel Tanks for Oil Storage," may be
considered as meeting the requirements of this paragraph.
14.04.290 Section 15.218b Design and Construction of Inside
Storage Rooms is a~e~d~ t~_read:
b. Electrical wiring and equipment located in inside storage
rooms shall be in compliance with the State Electrical Safety Orders
and the National Electric Code.
14.04.300 Section 15.301a Materials and Design is amended to
read:

a. Piping, valves and fittings for flanm~able and combustible
liquids shall be designed for the working pressures and structural
stresses to which they may be subjected. They shall be of steel or
other material suitable for use with the liquid being handled. Pipe
wall thicknesses shall be determined in accordance with nationally
recognized good practice, except that carbon steel pipe shall not
be thinner than standard wall thickness pipe. Pipe wall thickness
shall be determined according to the provisions of ASA B-31.3,
Petroleum Refinery Piping with addenda and current ASA B-31.4, Oil
Transportation. Piping with addenda. All threaded joints and connec-
tions shall be made up tight with suitable lubricant or piping
compound. These provisions shall apply to all piping for fla~m~able
or combustible liquids which fall within the scope of this Article.
14.04.310 Section 15.406a(6) & b Loading and Unloading Facilities
is amended to read:
a. (6) Fencing. Each loading rack or property upon which a
loading rack is located shall be surrounded by a fence not less than
6 feet in height, constructed of wire mesh, solid metal sheathing or
masonry. No person shall load or unload, or permit the loading or
unloading of a tank vehicle unless such vehicle is entirely within
such enclosure. No person shall drive or permit the driving of any
tank vehicle into or from the premises of a bulk plant except while
traveling in a forward direction. In existing installations, when
determined by the Chief that adequate public safety exists because
of isolation, natural barriers, or other factors, the requirements
of this subsection may be waived.
b. Tank Car Racks. Class I flammable liquids shall not be
discharged from or loaded into tank cars unless protection against
stray currents has been provided and is used. Protection shall be
designed and installed in accordance with N.F.P.A. 77 Static
Electricity.

14.04.320 Section 15.409 Fire Control is amended to read:
Approved portable fire extin§uishers shall be provided for the
extinguishment of fires as designated in N.F.P.A. No. 10 "Portable
Fire Extinguishers." An extinguisher shall be provided and main-
tained having a minimum classification of 20 B at the loading rack.
Suitable fire control devices such as small hoses, portable fire
appliances shall be available at locations where fires are likely
to occur.
14.04.330 Section 15.503b & c Dispensing Devices is amended to
read:
b. Automatic Dispensing Devices. The use of any device which
permits the dispensing of Class I flammable liquids when the hand of
the operator of the discharging nozzle is removed from the nozzle
control lever:, is hereby prohibited except when using an automatic
nozzle as provided in this subsection.
(1) On any service station dispenser a~cessible to the
public a listed automatic-closing type nozzle with latch-open device
is permitted only when all dispensing of Class I liquids is to be
done by the service station attendant. Such a nozzle shall have
the latch-open device as an integral part of the assembly and shall
shut off the liquid reliably and positively when the gasoline tank
is filled, when it falls from the filling neck of an automobile tank,
when it is subject to rough usage such as dropping or lack of proper
lubrication or when an automobile is driven away while the nozzle is
still in the tank.
(2) If the dispensing of Class I liquids at a service
station available and open to the public is to be done by a person
other than the service station attendant, the nozzle shall be a
listed automatic-closing type without a latch-open device.
(3) Approved special dispensing devices such as, but not

limited to, card-operated and remote preset types are permitted at
service stations, provided that dispensing of Class I liquids is
under the observation and control of a competent attendant at all
times and provided that emergency controls are installed at a
location acceptable to the Chief of the Fire Prevention Bureau.
c. Location.
(1) Dispensing devices at automobile service stations
shall be located at minimum distance of 10 feet from a property line
and so located that all parts of a vehicle being serviced will be
on private property.
(2) Dispensing devices at automobile service stations
shall be located not less than 10 feet from any building which is
not of fire resistive construction. Such dispensing devices shall
also be located so that the nozzle, when hose is fully extended,
shall not reach within 5 feet of any building opening.
(3) All dispensing devices shall be protected against
physical damage from vehicles by bblting said device to a concrete
island of a minimum of six inches in height. Alternate methods of
providing equivalent protection may be permitted when approved by
the Chief.
14.04.340 Section 15.503.5 Self-Service Gas Station is added to
read: The general construction and operation of self-service gas
stations and the storage and handling of flammable or combustible
liquids at such location shall be in accordance with the provisions
of this Section.
a. Definitions:
(1) SELF-SERVICE STATION shall mean and include any
gasoline filling station, public garage, or any
other place where flammable liquids are sold or
dispensed to the public by any manner or method
other than by the personal service and actual
direct dispensing of said liquids solely by the
owner or operator thereof, his agents or employees.

(2) PERSON shall mean and include persons, firms,
partnerships, corporations, unincorporated
associations, and any combination of persons,
by whatever name designated.
(3) PERMITTEE shall mean the holder of a permit to
operate and maintain a self-service station,
granted pursuant to the provisions of this Chapter.
b. Permit required. No person shall operate or maintain a
self-service station in the City of Bakersfield without first
obtaining a permit to do so from the Chief of the Fire Department.
Applications for permits shall be made on forms provided by the
Chief of the Fire Department, and shall give the names of the
operators of Said proposed self-service station, the location thereof
and such other pertinent information regarding the facilities and
manner of operation of said station as may be required by the
Chief of the Fire Department. Any person now operating or maintain-
ing a self-service station shall obtain a permit, and, except as
herein otherwise provided, shall comply with all the provisions of
this Chapter within thirty (30) days after the effective date hereof.
c. Revocation of Permit. The Chief of the Fire Department shall
revoke any permit issued under the terms of this chapter when he finds
either:
(1) That said permit is being used by any person other
than the person to whom the permit was issued, his agents or employees,
or
(2) That the conditions or limitations set forth in said
permit have been violated, or
(3) That the violations of this chapter or of any other
ordinance of the City of Bakersfield or law of the State of California
regulating or pertaining to the permittee's operations, set forth
in any written notice served upon the permittee by the Chief of the
Fire Department, have not been corrected within the time required by
said notice, or

(4) That said permit is being used on any premises or at
any location other than that for which it was issued.
It shall be unlawful for any person to operate or maintain
a self-service station in the City of Bakersfield after his permit
shall have been revoked.
d. Selfmservice stations prohibited in fire districts. No
permit shall be issued for the operation of a self-service station,
and no self-service station shall be operated or maintained within.the
limits of Fire Limits District Number 1, or Fire Limits District
Number 2, as said Districts are established by this Code.
e. Operating Regulations. The following regulations shall
apply to all self-service stations operated or maintained in the
City of Bakersfield:
(1) A control room shall be provided and so located that
the operator has an unobstructed view of all pumps and operations.
At least one of the two required doors to said control room shall
be not less than twenty-five (25) feet from the nearest pump and
shall open on a different side of the control room from where any
pump is located. Pumps shall not be located on more than three
sides of said control room. This section shall have no application
to a self-se~ice station operated or maintained as such on the
effective date of this chapter, except that any alterations or
additions hereafter made to said station shall conform to this
section.
(2) Telephone facilities, if and when available, shall
be provided on the premises of the station, if located more than
three hundred (300) feet from a street fire alarm box. Telephone
facilities, if provided, and pump control switches, shall be located
in the control room. The use of skates or other artificial means
of locomotion shall be prohibited.

(3) No building shall be located within twenty-five (25)
feet of any pump unless such building be of type I, II or III con-
struction as defined by the Uniform Building Code, or any other
building code hereafter adopted by the City of Bakersfield. Every
pump shall be not less than ten (10) feet from any property line;
provided, that adjacent streets or alleys may be considered as part
of such ten (lO) feet; and further ~provided, that the Chief of the
Fire Department in his discretion may allow deviations from this
latter requirement when and for such length of time as he finds that
such deviation will not seriously endanger buildings and operations
on adjoining premises.
(4) When portions of the station are closed to the public
for the delivery of gasoline, these portions shall be so designated
by adequate signs.
(5) Not more than five (5) vehicles, within an undivided
area of not to exceed-1600 square feet, and serviced from not more
than three (3]) adjacent islands in said area, shall be serviced by
any one attendant at any one time. At the time any vehicle is being
serviced in said area, the attendant in charge of said area shall
be engaged in no activity other than attending the vehicle or vehicles
being serviced.
(6) There shall be not less than (1) attendant, over the
age of 18 years on duty for each six (6) pump islands, or fraction
thereof, open to the public. All such attendants shall be instructed
in the use of first aid and fire fighting appliances.
(7) It shall be the duty of all attendants to prevent
persons from smoking within twenty-five (25) feet of any pump, or
filling operations. Service shall be refused and pumps shall be
shut off when patrons do not follow instructions, or are under the
influence of intoxicants.

(8) Each pump shall be equipped with manually operated
shut-off switch or lever which can be operated both at the pump or
by remote control from the control room.
(9) All filling nozzles shall be equipped with automatic
control valves and/or vacuum-operated overflow check valves, or other
valve or similar fixture approved by the Chief of the Fire Department.
'(10) All pumps and/or facilities for delivery of gasoline
shall be locked or other effective provisions shall be made to pre-
vent public access to supplies of gasoline when the station operators,
employees or authorized representatives are absent. During no time
shall coin-operated self-service gasoline facilities be permitted.
(11) There shall be installed and maintained in good working
order on the premises of each station such portable hand fire extin-
guishers as may be directed by the Chief of the Fire Department.
Said extinguishers shall be located as directed by the Chief of the
Fire Department.
(12) "NO SMOKING" and "STOP YOUR MOTOR" signs, with red
letters not less than four (4) inches in height on white background,
shall be placed at each pump island in unobstructed and clear view
from both sides of the island.
(13) No open flame devices shall be located or permitted
within twenty-five (25) feet of any pump.
(14) No combustible materials, except materials for cleaning
glass, shall be stored or displayed within twenty-five (25) feet of~any
pump.
(15) No oily or greasy mops or rags shall be permitted to
be stored within twenty-five (25) feet of any pump.
(16) Class I~ and II fla~Lm~able liquids-shall be dispensed
only into tanks of motor vehicles or into metal containers. The
use of glass or other fragile containers for such liquids shall be
prohibited.

14.04.350 Section 15.504f(5) Marine Service Station is amended
to read: Fire extinguishers each having a 30-B, C rating shall be
provided as follows: One on each float and one on the pier of wharf
within 25 feet of the head of the gangway to the float, except that
where the office is within 25 feet of the gangway or is on the float,
and an extinguisher is provided thereon; the extinguisher at the head
of gangway need not be provided.
14.04.360 Section 15.506c Safety Rules is amended to read:
In accordance with nationally recognized good practice, Class B extin-
guishers of a minimum classification of 10-B, C shall be provided and
so located that no pump, dispenser or fill-pipe opening shall be a
greater distance than 75 feet from such extinguisher.
14.04.370 Section 15.508b Electrical Equipment is amended to
read:
b. All installations of electric wiring and equipment shall be
reasonably safe to persons and property. For Class I liquids where
electrical wiring and equipment are installed, evidence that such
wiring and e~ipment are of the type approved for use in the hazardous
locations as set forth in Table 15.508-b~ and that such wiring and
equipment have been installed in accordance with the applicable
standards specified for this Section 15.508-b in State Electrical
Safety Orders and the National Electric Code shall be evidence that
such wiring and equipment are reasonably safe to persons and property.
14.04.380 Section 15.804 Fired and Unfired Pressure Vessels is
amended to read:
a. Fired pressure vessels shall be constructed in accordance
with the current Code for Fired Pressure Vessels, Section I of the
A.S.M.E. Boiler and Pressure Vessel Code.
b. Unfired pressure vessels shall be constructed in accordance
with the current edition of the Code for Unfired Pressure Vessels,
Section VIII.

14.04.390 Section 15.1011 Fire Control is amended to read:
A minimum of two fire extinguishers shall be maintained at all well
locations where drilling, servicing or repair work is being conducted.
Each such extinguisher shall have a minimum classification of 30-B,
as set forth in N.F.P.A. No. 10 "Portable Fire Extinguishers."
14.04.400 Section 19.01 Scope is amended to read: This Article
shall apply to materials not otherwise covered in this Code which are
highly flammable, or which may react to cause fires or explosions,
or which by their presence create or augment a fire or explosion'
hazard; or which because of the toxicity, fla~m~Lability, or liability
to explosion render fire fighting abnormally dangerous or difficult;
also to flammable or combustible liquids which are chemically unstable
and which may spontaneously form explosive compounds, or undergo
spontaneous reactions of explosive violence or with sufficient
evolution of heat to be a fire hazard. Hazardous chemicals shall
include such materials as fla~m~able solids, corrosive liquids,
radioactive materials, oxidizing materials, potentially explosive
chemicals, highly toxic materials, unstable (reactive) chemicals,
and poisonous gases, as defined in Article I, Div. IV.
14.04.41(I Section 19.05.5 Unstable Chemicals is added to read:
Unstable chemicals shall be located, stored and handled in accordance
with the following provisions:
a. Storage location for unstable chemicals, shall be subject
to approval by the Chief of the Bureau of Fire Prevention with
respect to nearness to dwellings, places of assembly, educational
occupancies, institutional occupancies, railroads and public highways.
Limitations on storable quantities shall be conSidered with regard
to proximity of these exposures and congested commercial or industrial
districts.

b. Unstable chemicals shall be stored away from all incompatible
chemicals and contaminating and sensitizing materials. Such chemicals
shall be kept away from all heat-producing appliances and electrical
devices and shall be protected from external heat, fire and explosion.
Unstable reactive chemicals shall not be stored in the same building
with or in close proximity to explosives and blasting agents except
that ammonium nitrate may be stored with explosives and blasting
agents in accordance with Article II. Good housekeeping shall be
maintained. Uncontaminated contents of broken or cracked bags,
packages or other containers shall be transferred to new and clean
containers before storing. Other spilled materials and discarded
containers shall be promptly gathered up and destroyed in an approved
manner. All electric bulbs shall be equipped with guard to prevent
breakage. Open lights or flames and smoking shall be prohibited in
or near storage areas. Internal combustion motor vehicles or lift
trucks shall not be parked or stored in the room or compartment where
such chemicals are located.
c. Unstable chemicals that are unstable (reactive) liquids,
such as organic peroxides and nitromethane shall in addition to
complying with the applicable provisions of this Article 19 shall
comply with the applicable provisions of Division II of Article 15.
14.04.420 Section 20.02a Permits and Reports of Installation
is amended to read: No person shall install or maintain any LP gas
containers, or operate any tank vehicle which is used for the
transportation of LP gas without a permit. Where a single container
or the aggregate of interconnected containers is over 1,200 gallons
water capacity, the installer shall submit plans to the Chief.
14.04.430 Section 21.03e Operational Fire Hazards in Lumber
Yards is added to read: All operations shall comply with current
N.F.P.A. Pamphlet No. 664.

14.04.440 Section 26.17 Fire Drills is added to read: It shall
be the duty of the Chief to require teachers of public, private and
parochial schools and educational institutions to have one fire drill
each month and to keep all doors and exits unlocked during school
hours.
14.04.450 Section 27.01 Bonfires and Outdoor Rubbish Fires is
amended to read:
a. It shall be unlawful for any person to build, light, main-
tain, or cause or permit to be built, lighted, or maintained, any
open or outdoor fire; use or cause or permit to be used, any fire for
clearing land;, burn or cause or permit to be burned, any brush, trash,
rubbish, stubble, or other flammable or combustible material.
b. The above prohibition does not apply to:
(1) Hospitals
(2) Veterinarian hospitals
(3) Mortuaries
(4) Crematoriums
(5) Barbecue pits and fireplaces as long as such are not
used for the disposal of rubbish.
c. Excepting for barbecue pits and fireplaces none of the
above exceptions shall be applicable unless such burning is done
in a multiple-chamber incinerator approved by the Air Pollution
Control District.
14.04.460 Section 27.05d Accumulation of Waste Material is
added to read:
d. In all cases where there are gratings or slatted openings
in the sidewalk, or over any opening leading into the basement of a
building, a wire netting of not over one-half (½) inch mesh shall
be placed beneath such grating or slats so as to prevent rubbish
from falling through. -~
14.04.470 Section 27.06 Handling Readily Combustible Materials
is amended to read: No person making, using, storing or having in
charge, or under his control any shavings, excelsior, rubbish, sacks,
bags, litter, hay, straw or combustible waste materials shall fail

or neglect at the close of each day to cause all such materials to
be removed from the interior of buildings located in Fire Zones 1
and 2 of the City of Bakersfield, the same to be placed in approved
type rubbish containers, in locations approved for such containers.
14.04.480 Section 27.07c Storage of Readily Combustible Materials
is amended to read:
c. Where the storage or accumulation of combustible waste
matter used in stores, apartment buildings, factories or other
similar places is a hazard or menace of fire, said storage of such
materials shall be removed at the close of each working day.
14.04.490 Section 27.09c Use of Open Flame or Light Restricted
is added to read:
c. All arc lights or incandescent lights in show windows shall
be covered with globes or reflectors. No goods of any kind or
description shall be displayed, placed, hung or suspended within
six (6) inches of any such globe or reflectors used as covering for
any arc light or incandescent light in show windows.
14.04.500 Section 27.14 Types and Construction of Incinerators
is amended to read: Every incinerator constructed or used shall
meet the minimum requirements of the Air Pollution Control District.
14.04.510 Section 27.31 Asphalt Kettles is amended to read:
It shall be unlawful to transport or permit to be transported any
asphalt kettle beneath which is maintained any open fire, heated
coals or ashes over any highway, road or street. Asphalt kettles
shall not be used inside of or on the roof of any building. There
shall be at least one approved fire extinguisher of a minimum 20-B,
C classification within 30 feet of each asphalt kettle during the
period such kettle is in use, and one additional 20-B,C classification
fire extinguisher on the roof being covered.
14.04.520 Section 27.36 Alleys to be Kept Clean is added to read:

It shall be unlawful for any person occupying or owning property
fronting on any public alley in the City of Bakersfield to fail,
refuse or neglect to keep the portion of such alley between the
center line thereof and the property line of such property free from
garbage, rubbish or combustible material.
14.04.530 Section 30.09b Fire Extinguishers and Other Fire

a. In the performance of welding and cutting operations only
approved equipment such as blowpipes, torches, regulators, acetylene
generators, and electric arc welding equipment that have been
examined and tested and found to be safeguarded as far as practicable,
shall be used.
14.04.570 Section 31.15 Electric Arc Welding and Cutting is
added to read:
a. The frame.or case of the welding machine except internal
combustion engine-driven machines shall be grounded. Ground connec-
tions shall be mechanically strong and electrically adequate for the

b. Welding current return circuits from the work to the machine
shall have proper electrical contact at all joints and periodic
inspection shall be made to ascertain that proper electrical contact

c. When electric arc welding or cutting is to be discontinued

occur, and the machines shall be disconnected from~the power source.
14.04.580 Section 32.04b Protection Booth is amended to read:
b. There shall be installed and maintained ready for use in
every projection booth, not less than two approved first aid fire
appliances of at least a 5-B, C rating.
14.04.590 Section 33.13 Portable Fire Extinguishers is amended
to read: Portable fire extinguishers suitable for flammable liquid
and electrical-type fire shall be provided as specified herein.
a. Every vehicle used for towing aircraft and every welding
apparatus shall be equipped with at least one fire extinguisher
having a minimum 5-B, C classification, as designated in N.F.P.A.
No. 10 "Portable Fire Extinguishers."
b. Every aircraft refueling vehicle shall be equipped with a
minimum of two 20-B, C fire extinguishers as designated in N.F.P.A.
"Portable Fire Extinguishers." A fire extinguisher shall be readily
accessible from either side of the vehicle.
c. At every aircraft service station there shall be at least
one fire extinguisher having a minimum 10-B, C classification, as
designated in N.F.P.A. No. 10 "Portable Fire Extinguishersi' and
shall be so located that no pump or dispenser shall be more than
75 feet from one such extinguisher.
d. Use of any fire extinguisher equipment under any circum-
stances shall be reported to the Airport Manager and the Fire

14.04.600 Section 33.30 Regulations Not covered is amended to

14.04.610 Section 34.05e Storage of Raw Materials and Finished
Products is amended to read:
e. Tank cars for flar~f~able liquids shall be unloaded so as to
be reasonably safe to persons and property. Evidence that such tank
cars have been unloaded in accordance with current MCA Sheet TC-4,
shall be evidence that such tank car unloading is reasonably safe
to persons and property.
14.04.620 Section 35.05c Sprinkler Systems is amended to read:
c. The design and installation of sprinkler systems shall
conform to the very latest N.F.P.A. specification available except
as herein provided.
14.04.630 Section 35.06b Roof Vents and Venting Ratios is
amended to read:
b. The design and installation of vents shall conform to
N.F.P.A. #204, except as herein provided.
SECTION 4.
That Chapter 14.08, Duties a~d Organization of the Bureau
of Fire Prevention of the Municipal Code of the City of Bakersfield,
is enacted to read as follows:

DUTIES AND ORGANIZATION OF THE BUREAU OF FIRE PREVENTION

14.08.010 Duty to Enforce the Code. The Uniform Fire Code shall
be enforced by the Bureau of Fire Prevention in the Fire Department
of the City of Bakersfield and shall be operated under the super-
vision of the Chief of the Fire Department.
14.08.020 Organization of the Fire Prevention Bureau. The Chief
of the Fire Department shall appoint any member of the Fire Depart-
ment as the head of the Fire Prevention Bureau who shall be known
as the Fire Marshal. The Chief may detail such other members of
the Fire Department as inspectors as shall, from time to time, be
necessary and may recommend to the City Manager the employment of
technical inspectors who shall be selected through examination to
determine their fitness for the position. The examination shall be
open to members and nonmembers of the Fire Department.
SECTION 5.
That Chapter 14.12, Fire Zones, is hereby added to the
Municipal Code of the City of Bakersfield as follows:

14.12.010 Establishment of Fire Zones. Fire zones as hereinafter
described in this Chapter designate areas within the City of
Bakersfield in. which the storage of inflammable, combustible, explosive
liquids, solid, or gaseous substances, are prohibited. Storage
facilities for such substances constructed prior to the enactment of
this Code may remain in such zones provided their construction and
maintenance are in substantial compliance with the provisions of this
Code.
14.12.020 Zone I Prohibiting Above-Ground Storage of Flammable
or CombuStible Liquids.
a. The limits of the district referred to in Section 15.201
of the Uniform Fire Code in which storage of flammable or combustible
liquids in outside, above-ground tanks is prohibited are hereby
established as follows: Fire Zones 1 and 2 and the closely built
commercial and. residential areas of Fire Zone 3 as said zones are
defined in Chapter 13.08 of the Municipal Code of the City of
Bakersfield.
b. The limits of the district referred to in Section 15.401
of the Uniform Fire Code in which new bulk plants for flammable or
combustible liquids are prohibited as described as follows: Fire
Zones 1 and 2 and the closely built co~Lm~ercial and residential areas
of Fire Zone 3 as said zones are defined in Chapter 13.08 of the
Municipal Code of the City of Bakersfield.
14.12.030 Zone II Prohibiting the Bulk Storage of Liquefied
Petroleum Gases. The limits of the zone referred to in Section
20.05a of the Uniform Fire Code in which bulk storage of liquefied
petroleum gas is restricted are hereby described to be: Fire Zones
1 and 2 and the closely built commercial and residential areas of
Fire Zone 3 as said zones are defined in Chapter 13.08 of the
Municipal Code of the City of Bakersfield.

14.12.040 Zone III Prohibiting the Storage of Explosives and
Blasting Agents. The limits of the zone referred to in Section
ll.06b of the Uniform Fire Code in which storage of explosives
and blasting agents is prohibited, are established as follows:
Fire Zones 1 and 2 and the closely built conm~ercial and residential
areas of Fire Zone 3 as said zones are defined in Chapter 13.08 of
the Municipal Code of the City of Bakersfield, and then only in
accordance with Table 11.07 of this Code. This prohibition shall
not include the storage of allowable quantities of gunpowder as
specified in Section 11.16.
SECTION 6.
That Chapter 14.16 Appeals From the Uniform Fire Code of
the City of Bakersfield is enacted to read as follows:

APPEALS FROM THE UNIFORM FIRE CODE OF THE CITY
OF BAKERSFIELD

14.16.030 Procedures
14.16.010 Board of Appeals. The Board of Building and Housing
Appeals of the City of Bakersfield as created by Section 13.04.120 (a)
of the Municipal Code, composed of five members, is hereby designated
as the Board of Appeals referred to in the Uniform Fire Code. When
meeting in this capacity, the Chief of the Fire Department shall sit
as a nonvoting member of the Board ex-officio and shall act as
secretary of the Board.
14.16.020 Duties of the Board. The Board shall resolve all
questions relating to alternative methods, techniques, or materials
arising under this title and shall determine reasonable interpreta-
tions of the programs of the Uniform Fire Code. They shall hear any
person aggrieved by action of the Fire Department in refusing or
revoking a permit required under this Code. The Board shall adopt

reasonable rules and regulations, consistent with the purpose of this
Code, for conducting its hearings and investigations; it shall render
written findings and decisions signed by its chairman and secretary
and serve a copy on the appellant.
14.16.030 Procedures. (a) Whenever the Chief of the Fire Depart-
ment or a member of the Fire Bureau shall disapprove an application
or refuse to grant a permit applied for; or when it is claimed by
an affected party that the provisions of the Code do not apPly or
that the true intent and meaning of the Code have been misconstrued
or wrongly interpreted or that a permit has been wrongfully revoked,
the affected party may appeal from the decision of the Chief or member
of the Fire Prevention Bureau to the Board of Appeals.
(b) Within 30 days of the date of the decision the affected
party shall request in writing a hearing before the Board of Appeals
stating therein his name, address and telephone number~ the nature of
the decision being appealed and the date it was rendered.
(c) Upon receipt of such request the Board of Appeals shall set
a date for public hearing at its earliest convenience, notifying the
affected party by registered letter to the address noted in the
request.
(d) At the hearing the Board of Appeals must hear all relevant
evidence presented by the affected party and the Bureau and from such
evidence make findings of fact and render therefrom a final conclusive
decision as to the matters submitted.
(e) Within 10 days of the conclusion of the hearing written
findings and decision of the Board of Appeals shall be mailed to the
affected party.
SECTION 7.
That Chapter 14.20, Violations of the Municipal Code of
the City of Bakersfield is enacted to read as follows:

14.20.010 Violations. (a) Any person, firm or corporation who
violates, causes, permits or allows the violation of any of the
provisions of this Code or violates or fails to comply with any
order made thereunder, or who shall build in violation of any detailed
statement or plans submitted and approved thereunder, or any certifi-
cate or permit issued thereunder and from which no appeal has been
taken or who fails to comply with 'such an order as affirmed or
modified by the Board of Appeals shall be guilty of a misdemeanor.
Such person is guilty of a separate offense for each day or portion
thereof he permits, causes or allows a violation to continue.
(b) Any structure, installation, business, or event that is
undertaken or permitted to continue in violation of any provision
of the Unifor~ Fire Code is a public nuisance and may be abated by
the Chief of the Fire Department in accordance with the law.
14.20.020 Penalty for Violation. Any person, firm or corporation
convicted of violating any of the provisions of this Code, or for
failing to con~ly with any notice or order given pursuant hereto,
shall be punishable by a fine of not more than Five Hundred Dollars
($500) or by imprisonment in the County jail for a period of not
more than six (6) months, or by both such fine and imprisonment.
SECTION 8.
That Chapter 14.24 Severability of the Municipal Code of
the City of Bakersfield is enacted to read as follows:

clause, or phrase of this title is for any reason held to be uncon-
stitutional, such decision shall not affect the validity of the
remaining portions of this title. The City Council hereby declares
that it would have passed this title and each chapter, section,
subsection, sentence, clause and phrase thereof irrespective of the
fact that any one or more chapters, sections, subsections, sentences,
clauses, or phrases be declared unconstitutional.
SECTION 9.
This ordinance shall become effective thirty (30) days
from and after the date of its passage.
