HomeMy WebLinkAboutORD NO 1940 ORDINANCE NO. 1940 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL ~ CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED EAST OF ASHE ROAD, SOUTH OF SUNNYDALE, WEST OF NEW STINE AND STINE ROAD AND NORTH OF WHITE LANE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield located east of Ashe Road, south of Sunnydale, west of New Stine and Stine Road and north of White Lane; and WHEREAS, the City Council has determined' after due consideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12. 020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries from an "A" (Agricultural) Zone, R-2-MH (Two Family Dwelling - Mobile Home Park) Zone and from an R-1 (Single Family Dwelling) Zone to an R-1 (Single Family Dwelling), or more restric- tive, Zone; to an R-2-MH-D (Two Family Dwelling - Mobile Home Park - Architectural Design), or more restrictive, Zone and to an R-2-D (Two Family Dwelling - Architectural Design), or more restrictive, Zone, of that certain property in the City of Bakersfield located east of Ashe Road, south of Sunny- dale, west of New Stine and Stine Road and north of White Lane, being more particularly described as follows: To an R-1 (Sinsle Family Dwellin~ or more ..r...e.s.trictiye; Zone: Ail that portion of Sections 3 and 10, T30S, R27E, M.D.M., more particularly described as follows: Beginning at the intersection of the east line of Ashe Road with the south line of Tract No. 2562 as recorded in Book 13 of Maps, at Page 11, Official Records of Kern County; thence southerly on and along the east line of Ashe Road and its southerly prolongation, the align- ment of which is shown on that certain set of construction plans prepared for the Broad- view Sanitation Co., titled "Ashe Road Trunk and Connectors" and approved and signed by the Office of the County Surveyor of the County of Kern on July 19, 1961, to the nor- therly line of Ming Avenue as shown on the "Map of the Official Plan of that Portion of Ming Road within Section 10, T30S, R27E, M.D.M. and New Stine Road between Sundale Avenue and Fraser Road" as passed by Reso- lution on October 26, 1965, by the Board of Supervisors of the County of Kern; thence easterly on and along said northerly line to the most westerly line of that certain parcel deeded to Rosewood Baptist Estates by Deeds recorded in Book 3957 of Deeds, at Page 130 and Book 4026 at Page 47; thence northerly, north- easterly, northerly and westerly on and along said westerly line to the most easterly line of Tract No. 3434 as recorded in Book 20 of Maps, at Page 74; thence southerly along said easterly line to the boundary of the Kern City Golf CoUrse; thence southerly, westerly and northerly, on and along said boundary to southerly line of Tract No. 2562, hereinbefore described; thence westerly, on and along said southerly line to the east line of Ashe Road and the Point of Beginning, City of Bakersfield, County of Kern, State of California.
