AN ORDINANCE OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING TITLE 14 OF THE MUNICIPAL
CODE OF THE CITY OF BAKERSFIELD BY ALLOWING
BURNING WHEN PERMITTED BY THE CHIEF OF THE FIRE
DEPARTMENT.
WHEREAS, the Kern County Air Pollution Control Regulations
provide for burning in some circumstances; and
WHEREAS, the Chief of the Fire Department has determined
that some circumstances may require burning.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield as follows:
SECTION 1.
There is hereby added to Chapter 14.04 of the Municipal
Code Section 14.04.451, which reads as follows:
14.04.451 Section 27.02 Burning Permitted by the Chief of
the Fire Department. The prohibition against burning specified
in Section 14.04.450 Section 27.01 does not apply if such burning
is in accordance with Rule 4.3(a)(1) of Regulation IV of t~he Rules
and Regulations of the Air Pollution Control District of Kern
County, wherein t'he Chief of the Fire Department of the City of
Bakersfield shall have the authority to issue permits which would
allow burning when, in his opinion, it is necessary for the purposes
of the prevention of a fire or health 'hazard Which cannot be abated
by any other n~ans.
SECTION 2.
This ordinance shall become effective thirty days from
and after the date of its passage.

I HEREBY CERTIFY that the foregoing Ordinance was
passed and adopted by the Council of the City of Bakersfield
at a regular meeting thereof held on the 28th day of June,
1971, by the following vote:
