HomeMy WebLinkAboutORD NO 1941 ORDINANCE NO. 1941 NEW SERIES AN ORDINANCE AMENDING SECTION 17.12.020 OF CHAPTER 17.12 (ZONING MAP) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a motion to zone certain property now being annexed to said City, and WHEREAS, the City Council has determined after due con- sideration of the motion and recommendation of the Planning Commission, herein on file, together with the reasons advanced at the hearing for the zoning of said property, that said zoning should be authorized upon annexation of said property to the City. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. That Section 17.12.020 of Chapter 17.12 (Zoning Map) of the Municipal. Code of the City of Bakersfield, be and the same is hereby amended by extending the boundaries of said map to include those certain, properties in the County of Kern located between Wilson Road and White Lane and between Stine Road and Wible Road, known as AKER.S #1 ANNEXATION, in an R-1 (Single Family Dwelling) Zone, or more restrictive, Zone; in an R-2-MH-D (Two Family Dwelling - Mobile Home Park-Architectural Design), or more restrictive, Zone; in an R-2-D (Two Family Dwelling-Architectural Design), or more restrictive, Zone; in an R-3-D (Limited Multiple Family Dwelling- Architecutral Design), or more restrictive, Zone; in a C-1-D (Limited Commercial-Architectural Design), or more restrictive, Zone; and in an '~" (Agricultural), or more restrictive, Zone, upon the annexation of said property to the City of Bakersfield, the boundaries of which property are shown on the map hereto attached and made a part of this ordinance, and are more specifically described as follows: All the following parcels are situate in the County of Kern, State of California and being a portion of Sections 11, 13 and 14, T30S, R27E, M.D.M., and more particularly described as follows: To an R-1 (Single Family Dwelling) Zone~ or more restrictive: Beginning at the intersection of the north line of south 55 feet of the N~ of said Section 14 with the east line of the W½ of the SW~ of the NE~ of said Section 14, said intersection also being the north right-of-way line of White Lane (formerly County Road No.. 2247) and said intersection also being a point on the Corporate Boundary of the City of Bakersfield as defined by Ordinance No. 1799, New Series; Thence (1) westerly, northerly and easterly along courses 60 through 68 of the last named Corporate Boundary to the easterly terminus of said course 68, said easterly terminus also being a point on the south line of the north 30 feet of the SW~ of said Section 11; Thence (2) departing from said Corporate Boundary, easterly along the last named south line, 391 feet, more or less, to intersect the west line of the east 600.31 feet of the NW~ of the SW~ of said Section 11; Thence (3) southerly along the last named west line, 270 feet, more or less, to intersect the south line of the north 300 feet of the SW~ of said Section 11; Thence (4) easterly along the last named south line, 100 feet, more or less, to intersect the west line of the east 500.31 feet of the NW~ of the SW~ of said Section 11; Thence (5) southerly along the last named west line, 80 feet, more or less, to intersect the south line of the. north 380 feet of the SW~ of said Section 11; Thence (6) easterly along the last named south line, 307.31 feet, more or less, to intersect the west line of the east 193 feet of the NW~ of the SW~ of said Section 11; Thence (7) northerly along the last named west line, 335 feet, more or less, to intersect the south line of the north 45 feet of the SW~ of said Section 11; Thence (8) easterly along the last named south line, 853.32 feet, more or less, to intersect the east line of the W~ of the E~ of the SW~ of said Section 11, s~id intersection also being a point on the west line of Tract No. 2508, as said Tract is shown on a map recorded December 21, 1961, in Book 12 of Maps, Page 113, Records of said Kern County; Thence (9) (using as a basis of bearing the bearing of the west line of said Tract No. 2508) S 0°10'41'' W, 1711.854 feet, along the west lines of said Tract No. 2508 and Tract No. 2566 as said Tract No. 2566 is shown on a map recorded June 8, 1962, in Book 12 of Maps, Page 192, Records of said Kern County, being also along the last named east line, to a point which is the southwest corner of said Tract No. 2566; Thence (10) S 89°24'15'' E along the south line of said Tract No. 2566, 395.450 feet, to a point which is the northwest corner of Tract No. 2650, as said Tract No. 2650 is shown on a map recorded November 8, 1963, Book 14 of Maps, Page 13, Records of said Kern County; Thence (11) S 0°10'41" W along the west line of said Tract No. 2650, 845.365 feet, to intersect the north line of the south 45 feet of said Section 11; Thence (12) easterly along the last named north line, 2831.72 feet, more or less, to a point which lies 20.138 feet westerly as measured along the last named north line from the west line of the east 55 feet of said Section 11, said point also being the beginning of a tangent curve concave to the northwest and having a radius of 20 feet; Thence (13) easterly and northerly along said curve, concave to the northwest, with a radius of 20 feet through an angle of 90o23'40'', an arc distance of 31.555 feet to a point of tangency on the west line of the east 55 feet of said Section 11, said point of tangency also being a point on the Corporate Boundary of the City of Bakersfield as defined by Ordinance No. 1679, New Series; Thence (14) southerly, easterly, southerly, westerly and southerly along the Corporate Boundary of the City of Bakersfield to the Point of Beginning and containing 367.29 acres, more or less. EXCEPTING THEREFROM all the following parcels with the requested zoning as indicated: To an R-2-MH-D (Two Family Dwelling-Mobile Home Park-Architectural Design), or more restrictive~ Zone: Parcel #1: Beginning 365.03 feet south of the'north- west corner of the SW~ of the NW~ of said Section 14, - thence south 959.57 feet on and along the west line of said Section 14 to the southwest corner of said SW~ of the NW~; thence S 89039' E, 622.41 feet; thence N 30o09' W, 100.46 feet; thence N 39019' W, 158.16 feet; thence N 10059' W, 395.52 f~et: thence N 28© 34'30" W, 60.45 feet; thence N 46 10~ W, 451.64 feet; thence west 41.66 feet to the point of beginning. EXCEPTING the property that lies southerly of the north right-of-way line of White Lane. To an R-2-D (Two Family Dwelling-Architectural Design)~ or more restrictive~ Zone: Parcel #1: The east 865 feet of the west 1320 feet of the south 660 feet of said Section 11. EXCEPTING the east 695 feet of the north 445 feet. Parcel #2: The south 115 feet of the north 375 feet of the E~ of the E½ of the E½ of the NW~ of said Section 14. Parcel #3: The south 265 feet of the north 525 feet of the west 814 feet of the NE~ of said Section 14. Parcel #4: The south 220 feet of the north 745 feet of the west 990 feet of the NE~ of said Section 14. Parcel #5: The east 471 feet of the north 1320 feet of said Section 14. EXCEPTING the east 261 feet of the north 1120 feet. To an R-3-D IiLimited Multiple Family Dwelling-Architectural Design), or more restrictive~ Zone: Parcel #1: The north 330 feet of the south 660 feet of the west 455 feet of said Section 11. Parcel #2: The north 260 feet of the E~ of the E~ of the E~ of the NW~ of said Section 14. Parcel #3: The north 260 feet of the west 814 feet of the NEk of said Section 14. Parcel #4: The south 620 feet of the north 1120 feet of the east 261 feet of said Section 14. To a C-1-D (Limited Commercial-Architectural Design)~ or more restrictive~ Zone: Parcel #1: The west 455 feet of the south 330 feet of said Section 11. Parcel #2: The east 261 feet of the north 500 feet of said Section 14.
