HomeMy WebLinkAboutORD NO 1965 ORDINANCE NO. 1965 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED NORTH OF STOCKDALE HIGHWAY AND WEST OF CALIFORNIA AVENUE; AND SOUTH OF STOCKDALE HIGHWAY AND EAST OF NEW STINE ROAD. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Co~m~ission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield located north of Stockdale Highway and west of California Avenue; and south of Stockdale Highway and east of New Stine Road; and WHEREAS, the City Council has determined after due consideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries of those certain properties in the City of Bakersfield located north of Stockdale Highway and west of California Aw~nue; and south of Stockdale Highway and east of New Stine Road,'being more particularly described as follows: From a C-1-D (Limited Commercial-Architectural Design) Zone to an R-3-D (Limited Multiple Family Dwelling - Architectural Design)~ or more restrictive~ Zone: Commencing at the intersection of the center- line of California Avenue with the south line of Section 34, T29S, R27E, M.D.M., thence N 00°03'57,' W, on and along said centerline, 1245.60 feet to the beginning of a tangent curve, concave to the southeast, having a radius of 2800 feet; thence northerly, on and along said curve and centerline, through a central angle of 27042'53'', an arc distance of 1354.40 feet to the True Point of Beginning; thence con- tinuing on and along said curve and centerline, through a central angle of 13°39'18"~ an arc distance of 667.31 feet; thence N 48 41'46" W, 305.00 feet to a point on a nontangent curve, concave to the southeast, concentric to last named curve, of radius 3105 feet, from which the radial point of said curve bears S 48041'46'' E; thence southerly, on and along said curve, th[ough a central angle of 13°39'18"~ an arc distance of 740.00 feet; thence S 62 21'04" E, 305.00 feet to the True Point of Beginning. EXCEPTING THEREFROM that portion lying within the right-of-way of California Avenue. From a C-O-D (Professional Office - Architectural Design) Zone and a C-1-D (Limited Co~mnercial - Architectural Design) Zone to a ~-O-D (Professional Office Architectural Design), or more restrictive~ Zone: Commencing at the intersection of the centerline of California Avenue with the south line of Section 34, T29S, R27E, M.D.M., thence N 00° 03'57" W, on and along said centerline, 1245.60 feet to the beginning of a tangent curve, concave to the southeast, having a radius of 2800 feet; thence northerly, on and along said curve and centerline, through a central angle of 8° 30'00", an arc dis- tance of 415.39 feet to the True Point of Beginning; thence continuing on and along said curve and centerline, through a central angle of 19° 12'53", an arc distance of 939.01 feet; thence N 62° 21' 04" W, 305.00 feet to a point on a nontangent curve, concave to the southeast, concentric to last named curve, of radius 3105 feet, from which the radial point of said curve bears S 62° 21'04" E; thence southerly, on and along said curve, through a central angle of 19° 12'53"~ an arc distance of 1041.29 feet; thence S 81 33'57" E, 305.00 feet to the True Point of Beginning.
