The meeting was called to order by Mayor Payne, followed by the Pledge of Allegiance. The City Clerk called the roll as follows: Present: Mayor Absent: None Payne. Christensen, Smith, Ratty, Moore, Dickerson, Salvaggio HEARINGS Th~s Is the time set for a public hear- ing before the Council for hearing pro- tests by property owners on the amount of assessment or the fairness of the benetlt formula to be borne by all par- cels of property within Maintenance Districts 1 through 17, which provides the bases for the benefit assessments for maintaining certain local improve- ments within each District. Maintenance District No. 1: Generally extending west from Gosford Road to the eastern boundary ot the Arvin-Edison Canal and the area extending south from Stockdale Highway to Ming Avenue. Correspondence has been received from Mr. and Mrs. Horaclo Asbun, 8009 Kroll Way, No. 75, dated June 1, 1987, in opposition to Maintenance District No. 1. Mayor Payne declared the protest hearing open for public participation. No protests or objections being received, Mayor Payne closed the public portion of the protest hearing for Council deliberation and action. Adoption of Resolution No. 94-87 of the Council of the C~ty of Bakersfield for Maintenance District No. 1, approving and adopting the 1987-88 budget, levying assessments, reserving the right to per- form maintenance work by City forces and authorizing collection of assessments by the Kern County Tax Collector. Public Works Director Hawley gave a brief overview of Maintenance District No. 2. Mayor Payne declared the protest hearing open for public participation. Fraley, 8200 Sargent Way, in opposition to Maintenance District No. 3. Public Works Director Hawley gave a brief overview of Maintenance District No. 3. Mayor Payne declared the protest hearing open for public participation. Robert Samples, 8220 Sargent Way, spoke in opposition to assessed taxes for Maintenance District No. 3. Glenn Wick, garding ass~essed taxes Public Works Director 8209 Sargent Way, made several in Maintenance District No. 3, Hawley responded. inquiries to which James Fraley, 8200 Sargent Way, spoke in opposition to assessed taxes for Maintenance District No. 3. re- City Manager concerning percentage nance District. Correspondence has also been received from Irsfeld, Itsreid ~ Younger, Attorneys for Barbara Ann Jurgensmeier, 100 West Broadway, Suite 9U0, Glendale, dated June 5, 1987, in opposi- tion to Maintenance District No. 8. Fred Torres, 4401 Blossom Valley Lane, patio structure on his property in regard to the Maintenance Distr~ct No. 14. inquired about a assessment on Public Works Director Hawley indicated he would meet with Mr. Torres to d~scuss the matter. Upon a motion by Councilmember Dickerson, Resolution No. 107-87 of the Council of the City of Bakersfield was adopted by the following vote: Ayes: Noes: Absent: Councilmembers Childs, Smith, Ratty, Moore, Councilmembers Christensen, Salvaggio None Dickerson Councilmember Dickerson clarified his vote, stating that the recordants ~n Maintenance District No. 14 were surveyed and voted in excess of two-thirds in Favor of establishing a Mainte- nance D~str~ct. Upon a motion by Councilmember Dickerson, Resolution No. 108-87 of the Council of the City of Bakersfield was adopted by the following vote: Ayes: Noes: Absent: Councilmembers Childs, Smith, Ratty, Moore, Dickerson Councilmembers Christensen, Salvagg~o None Councilmember Dickerson clarified his vote, stating that Maintenance District No. 15 is a commercial area and the assessed costs will inevitably be passed on to the community through the purchase of vehicles or other services, thereby setting up a fair distribution of the tax or fee. Maintenance District No. 16: Generally bounded by Norris Road on the north, Rosedale Highway on the south, Calloway Drive on the west, and Coffee Road on the east. Public Works Director Hawley reminded the Council of his previous request for Council to provide a liaison to work with the committee that will review the maintenance services and possi- ble formation of a city-wide maintenance district. vaggio as Committee Councilmember Christensen nominated Councilmember Sa]- Council liaison to the proposed Maintenance District Mayor Payne stated Councilmember Christensen's nomina- tion as a motion and called for the vote. Councilmember Ratty nominated Councilmember Childs as Council l~alson to the proposed Maintenance District Committee. Mayor Payne stated that Councilmember Chr~stensen's nom- ination was a motion, therefore, Councilmember Ratty's nomination would De a substitute motion. Councilmember Childs withdrew his name from nomination as l~alson to the proposed Maintenance District Committee. Councilmember Childs called for the question. Mayor Payne stated the call for the question is to vote on Councilmember Chr~stensen's motion to appoint Councilmember Salvagglo as Council l~alson to the p}oposed Maintenance District Committee.
