HomeMy WebLinkAboutORD NO 1985 ORDINANCE NO. 1985 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD REPEALING SECTION 6.20.010(h) (10) OF THE MUNICIPAL CODE AND AMENDING SECTIONS 6.20.220, 6.20.400 AND 6.20.700 OF THE MUNICIPAL CODE RELATING TO THE BUSINESS LICENSE TAX. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Section 6.20.010(h) (10) of Chapter 6.20 of Title 6 of the Municipal Code of the City of Bakersfield is hereby deleted and repealed. SECTION 2. That Section 6.20.220 of Chapter 6.20 of Title 6 of the Municipal Code of the City of Bakersfield is hereby amended to read as follows: 6.20.220 Business Tax - How and When Payable. Unless otherwise specifically provided, all annual business taxes, under t'he provisions of this chapter shall be due and payable in advance on the first day of July of each year; provided that business taxes covering new operations, commenced after the first day of July, may be prorated for the balm~ce of the business period. Except as otherwise 'herein provided, business taxes, other than annual, required hereunder shall be due and payable as follows: (a) Semi-annual business taxes, on the first day of January and the first day of July of each year; (b) Quarterly business taxes, on the first day of January, April, Julyand October of each year; (c) Monthly business taxes, on the first day of each and every month; (d) Weekly flat-rate business taxes on Monday of each week in advance; (e) Daily flat-rate business taxes each day in advance; (f) Other flat-rate business taxes are payable in advance on t~he first day of business and thereafter on the first day of any applicable period. SECTION 3. That Section 6.20.400 of Chapter 6.20 of Title 6 of the Municipal Code of the City of Bakersfield is hereby amended to read as follows: 6.20.400 Rules and Resulations. The collector may promulgate rules and regulations consistent with the provisions of this chapter as may be necessary or desirable to aid in the interpretation and enforcement of the provisions of t'his Chapter. The collector is specifically authorized to promulgate rules and regulations govern- ing t~he rate of t'he business license tax on gross receipts attribut- able to selling activities in the City of Bakersfield where various extraterritorial events contribute to such gross receipts. SECTION 4. That Section 6.20.700 of Chapter 6.20 of Title 6 of the Municipal Code of the City of Bakersfield is hereby amended by adding Classes No. 1, 90 and 91 thereto, and by changing Classes No. 31, 60 and 78, to read as follows: Class No. Quarterly Annually 1. Producing oilwells, in addition to other business licenses required, each producing well within the City: 1st 100 wells (per well) $ 20.00 2nd 100 wells (per well) 10.00 In excess of 200 wells (per well) 5.00 Class No. 0uarterly Annually 90. Administrative office and/or other similar quarters of business not subject under this chapter to a business license tax by the City of Bakersfield other than for oilwells, storage and warehousing space, each 100 square feet or portion thereof of usable floor space within the City ($10 minimum). $ 1.00 91. Storage and warehousing by businesses, not subject under this chapter to a business license tax by the City of Bakersfield other than for oil- wells and administrative office quarters, each 100 square feet or portion thereof of floor space or open yard storage space within the City ($10 minimum).
