HomeMy WebLinkAboutORD NO 1999 EMERGENCY ORDINANCE NO. 1999 NEW SERIES AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD ADDING SECTION 11.17.075 TO CHAPTER 11.t7 OF THE MUNICIPAL CODE PROVIDING FOR BICYCLE PARKING RACKS IN THE PARKING MALL. WHEREAS, t~he use of bicycles as a means of transportation is encouraged by the City Council to promote and increase the healt~h, comfort and convenience of residents; and WHEREAS, bicycle traffic in the central business district of t'he City is increasing and will probably continue to increase; and WHEREAS, the lack of parking facilities for bicycles in the central business district 'has resulted in unattended bicycles being laid up against buildings and glass windows or being laid on the side- walk, to t'he detriment of all; and WHEREAS, the City Council desires to alleviate-the problem -of parking bicycles in the central business district. NOW~ THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Section 11.17.075 is added to Chapter 11.17 of the Municipal Code to read as follows: 11.17.075 Bicycle Racks on Sidewalks. 1. Whenever the Traffic Authority designates limited area upon any sidewalk within a parking mall as a bicycle rack location, it shall be lawful to place and maintain a bicycle rack at such lo- cation for the purpose of parking and securing of bicycles by the public, provided that such placement and maintenance meets all of the following requirements: (a) Such bicycle racks, Which shall not exceed forty (40) inches in width, shall be provided without cost or expense to the City. (b) Such bicycle racks shall be placed in a secure manner by the City in places deemed by the Traffic Authority to be the safest and most convenient locations for bicycle parking, for pedestrians on the sidewalk, and for automobile parking. (c) The ~esign and color of said racks shall be subject to the approval of the Traffic Authority. (d) There shall not be placed more than two bicycle racks per block on each side of any street. (e) The person, firm, business or corporation originally providing the racks shall remain the owner thereof and responsible for maintaining them in good condition and repair. (f) The Traffic Authority shall have the right to remove such racks and deliver them to the owner whenever they are not being maintained in proper condition and repair. (g) The Traffic Authority shall have the right to remove such racks whenever it is determined that the use of such racks is not sufficient to warrant the retention of such racks. SECTION 2.
