HomeMy WebLinkAboutORD NO 2006 ORDINANCE NO. 2006 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED SOUTH OF PACHECO ROAD AND WEST OF SOUTH UNION AVENUE. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Co~mL~ission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield located south of Pacheco Road and west of South Union Avenue; and WHEREAS, the City Council has determined after due consideration, of said petition and the reco~mnendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries from an R-2-MH-D (Limited Multiple Family Dwelling Mobile Home Park - Architectural Design) Zone; from an R-2-D (Limited Multiple Family Dwelling - Architectural Design) Zone; and from an R-1 (Single Family Dwelling) Zone to an MH (Mobile Home Park), or more restrictive, Zone affecting that certain property in the City of Bakersfield located south of Pacheco Road and west of South Union Avenue, being more particularly described as follows: Portions of Lots 1, 2 and 3 of ]Kern County Sales Map ~1 of Lands of J. B. Haggin, filed on May 3, 1889, in the office of the County Recorder of Kern County and being in the N~ of the NEk of Section 19, T30S, R28E, M.D.B.M. and being more particularly described as follows: (For purposes of 'this legal the north line of said lots 1 and 3 and the east line of said lots 1 and 2 coincides witlh the centerlines of Pacheco Road and South Union Avenue respectively). The W~ of said Lots 1 and 2 and the E½ of said Lot 3 along with the east 300.00 feet of the west 958.0 feet of the south 462 feet of said Lot 2. EXCEPTING THEREFROM the right-of-way for Pacheco Road along with the following parcels: A. The west 538 feet of the east 610 feet of the north 200 feet of said Lot 3. B. The east 442 feet of the west 660 feet of the north 200 feet of said Lot 1. C.
