HomeMy WebLinkAboutORD NO 2019 ORDINANCE NO. 9~019 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING SECTION 3.18. 180(a), (b), AND (i) (HOLIDAYS) AND SECTION 3.18.200(g), (ACCUMULATION OF SICK LEAVE AND ADDITIONAL VACATION IN LIEU OF ACCUMU- LATION OF SICK LEAVE) OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That Section 3.18.180(a), (b) and (i) of the Municipal Code of the City of Bakersfield is hereby amended to read as follows: 3.18. 180 Holidays. (a) The holidays in this City are as follows: 1. January 1 - New Year's Day.. 2. February 12 - Lincoln's Birthday. 3. Third Monday in February - Washington' s Birthday. 4. Last Monday in May - Memorial Day. 5. July 4 - Independence Day. 6. First Monday in September - Labor Day. 7. September 9 - Admission Day. 8. Second Monday in October - Columbus Day. 9. Fourth Monday in October - Veterans' Day. 10. Thanksgiving Day. 11. December 25 - Christmas Day. Whenever a holiday falls on a Sunday, the following Monday shall be observed. Whenever a holiday falls on a Saturday, none of the above shall be observed as a holiday. (b) Half-day holidays. In addition to the holidayS set forth in Section 3.18.180(a), one-half day holidays (four (4) hours) shall be observed as holidays by eligible city employees normally in the afternoon on Good Friday, Christmas Eve (December 24), and New Year's Eve (December 31), except Police and Fire safety employees, provided that no such one-half day holiday shall be granted when Christmas and New Year's Days fall on a Sunday or Monday. (i) Holiday Work--Police and Fire Departments. 1. Police Department Employees. Eligible Police Depart- ment employees who are required to work on a shift basis and whose schedule does not allow observance of holidays shall be paid at their regular hourly rate of pay for the designated holidays of the current_fiscal year. One payment for all such holidays not observed shall be made on the first payday in June of each year. All other eligible Police Department employees who do not work on a shift basis shall observe holidays in accordance with Section 3.18.180(e). 2. Fire Department Employees. Eligible Fire Department Employees who are required to work on a 24-hour duty shift basis and whose schedule does not allow observance of holidays shall be granted compensatory time off in lieu of designated holidays at the rate of one-half (~) of a 24-hour duty shift per holiday during each year. Such time off shall accrue as the holidays occur and shall be scheduled by and for the convenience of the Fire Department. All other eligible Fire Department employees who do not work on a 24-hour duty shift basis shall observe holidays in accordance with Section 3.18.180(e). SECTION 2. That Section 3.18.200(g) of the Municipal Code of the City of Bakersfield is hereby amended to read as follows: 3.18.200 Sick Leave. - (g) Accumulation of Sick Leave and Additional Vacation in Lieu of Accumulation of Sick Leave. Sick leave may be accumulated up to a maximum of one hundred and twenty working days. Additional vacation time shall be credited in conjunction with unused sick leave earned as hereafter provided. Such accumulation and additional vacation is to be interpreted for police and fire in the same manner as otherwise set forth in this Chapter. 1. 0-60 Days Unused Accumulated Sick Leave. Up to sixty days (60) unused sick leave will be accumulated with no additional vacation allowed. 2. 60-120 Days Unused Accumulated Sick Leave. Accumulated sick leave in this category with additional vacation time will be accumulated in the calendar year as follows: In any calendar year six (6) days of unused sick leave will be accumulated. Fifty per cent (50%) of the remaining unused sick leave will be credited to additional vacation and fifty per cent (50%) will be accumulated sick leave. 3. 120 Days or Over Unused Accumulated Sick Leave. All unused sick leave earned during the calendar year over one hundred and twenty days accumulated will be converted into additional vacation time at fifty per cent (50%) of the unused balance. 4. Those employees who on July 10, 1972, have a total of more than one hundred and twenty days (120) accumulated sick leave will retain their accumulated sick leave but will not be credited with any further accumulated sick leave, but in lieu thereof, shall be entitled to one-half day vacation for every day of sick leave earned subsequent to July Lq 1972. Such vacation shall be taken in the calendar year following the earned sick leave. 5. Absence on account of illness occurring to any employee in 4 above shall be deducted first from that portion of accumulated sick leave exceeding the one hundred twenty days accu- mulated sick leave. SECTION 3.
