HomeMy WebLinkAboutORD NO 2062 ORDINANCE NO. 2062 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED ON THE NORTH SIDE OF BRUNDAGE LANE BETWEEN MIL}~M DRIVE AND BLISS STREET. WHEREAS, in accordance with the procedure set forth in the provision~ of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield located on the north side of Brundage Lane between Milham Drive and Bliss Street; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows:' Changing the zoning boundaries from an R-1 (One-Family Dwelling) Zone to a C-1-D (Limited Commercial - Architectural Design), Zone, of that certain property in the City of Bakersfield located on the north side of Brundage Lane between Mil~ham Drive and Bliss Street, ~eing more particu- larly described as follows: Beginning at the southeast corner of the south- west quarter of the southwest quarter of Section 32, T29S, R28E, M.D.B.M., running thence east along the south line of said southwest quarter a distance of 165.125 feet to the true point of beginning, thence at right angles north a distance of 331.04 feet to a point thence at right angles east and parallel with the south section line to a point on the east line of the southwest quarter of the southeast quarter of the southwest quarter of said Section 32, said point also being the northwest corner of Lot 7, Block 2 of Milham Gardens Subdivision thence at right angles south along the west line of said block and subdivision a distance of 330 feet to a point on the south line of Section 32, T29S, R28E, thence at right angles west along said section line to the true point of beginning. EXCEPTING THEREFROM the southerly 45 feet of the above-described parcel. ALSO EXCEPT that portion of the herein-described property described as follows: Beginning at the southeast corner of the southwest quarter of the southeast quarter of the southwest quarter of said section, running thence west along the south line of said southwest quarter, a distance of 100 feet; thence at right angles due north a distance of 200 feet to ~a point; thence at right angles east and parallel with the south line of said southwest quarter, a distance of 100 feet more or less to a point on the east line of said southwest quarter of the southeast quarter of the southwest quarter of said section 32; thence at right angles due south and along the last mentioned east line a distance of 200 feet, more or less to the point of beginning, City of Bakersfield, County of Kern, State of California. o0o I HEREBY CERTIFY that the foregoing Ordinance was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the llth day of December, 1972, by the following vote: AYES: COUNCILMEN BLEECKER, HEISEY, MEDDERS, REES, RUCKER, THOMAS, WHI'rrEMORE NO~S: COUNCILMEN: ~ AB.~TAIN iNG COUNCILMEN: CITY 'CLERK and Ex'Offic-~° Clerk of the Council of the City of Bakersfield APPROVED this llth of December, 1972 APPROVED: CITY ATTORNEY~~ 0 _j C-I C-I ' B R U N D A G E L N.
