HomeMy WebLinkAboutORD NO 2077 ORDINANCE NO. 2077 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE~CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THAT CERTAIN PROPERTY IN THE CITY OF BAKERSFIELD LOCATED NORTHERLY OF WEST COLUMBUS STREET FROM EASTERLY OF "0" STREET TO EASTERLY OF SAN DIMAS STREET, TOGETHER WITH A PARCEL ON THE SOUTHEAST CORNER OF WEST COLUMBUS STREET AND SAN DIMAS STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and Ci6y Council have held hearings respectively, on a petition to change the land use zoning of that certain property in the City of Bakersfield located northerly of West Colum'bus Street from easterly of "0" Street to easterly of San Dimas Street, together with a parcel on the southeast corner of West Columbus Street and San Dimas Street; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the-land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries from a C-2-D (Commercial - Architectural Design) Zone, a C-O-D (Professional Office - Architectural Design) Zone, an R-3-D (Limited Multiple Family Dwelllng - Architectural Design) Zone, and an R-1 (One Family Dwelling) Zone to an MH (Mobile Home Park), Zone, and from an R-1 (One Family Dwelling) Zone to an R-3 (Limited Multiple Family Dwelling) Zone of that certain property in the City of Bakersfield located northerly of West Columbus Street from easterly of "0" Street to easterly of San Dimas Street, together with a parcel on the southeast corner of West Columbus Street and San Dimas Street, being more particularly described as follows: PARCEL 1: To an MH (Mobile Home Park) Zone: Those portions of the North half of Section 19 and of the South half of Section 18, T29S, R28E, M.D..M., being more particularly described as fo 1 ]_ows: Commencing at the intersection of the centerline of "O" Street with the centerline of Columbus Street (42nd Street); thence S 89°58'08"E, 217.95 feet to the True Point of Beginning; thence continuing along said centerline of West Col~bus Street (42nd Street) S 89°58'08"E, 821.56 feet; thence along a tangent circular curve concave to the Southwest, having a radius of 1100 feet, through a central angle of 18a21'39J', an arc distance of 352.50 feet to a point on the centerline of San Dimas ("S" Street); thence S 0()~01'44'~, along the centerline of San Dimas ("S" Street), 1253.23 feet; thence S 89°58'16"E, 756.36 feet: thence N 20°57'56'~, 1776.96 feet; thence N 04a58'48'~, 72.70 feet; thence N 01°20'58"E, 157.14 feet; thence N 12~24'26"E, 74.18 feet more or less to a point on the easterly prolongation of the North line of Block 694 shown on a map entitled '~ap of the City of Bakersfield, Kern County, California," filed November 25, 1898, in the Office of the County Recorder of said County, said point also on the corporate boundary of the City of Bakersfield as defined by Ordinance No. 1823, New Series; thence N 89°58'08'~ along last-named easterly prolongation and North line of Block 694, 477.54 feet to an angle point in said corporate boundary of the City of Bakersfield, thence N 20° 36'00'~, 615.12 feet to an angle point in said corporate boundary of the City of Bakersfield, said point being the termination *of Course No. (14) as described in the City of Bakersfield annexation description of San Dimas No. 3; thence along said Corporate Boundary and said Course (14) S 64~11'30'~, 674.04 feet; thence S 0° 01'52'~, 933.64 feet to the True Point of Beginning. EXCEPTING THEREFROM that portion that lies southerly of the North R/W line of said West Columbus Street. PARCEL 2: To an R-2-D (Limited Multiple Family Dwelling - Archi- tectural Design) Zone: Those portions of the North half of Section 19 and of the South haf of Section 18, T29S, R28E, M.D.M., more particularly described as follows: Commencing at the intersection of the centerline of "0" Street with the centerline of West Columbus Street (42nd Street); thence S 89°58'08"E, along said centerline of West Columbus Street, 1039.51 feet; thence along a tangent circular curve concave to the Southwest, having a radius of 1100 feet; through a central angle of 18°21'39'', an arc distance of 352.50 feet to a point on the center- line of San Dimas Street ("S" Street), being the True Point of Beginning; thence S 00°01'44'' W..along said centerline of San Dimas Street (~'S" Street), 1253.23 feet,othe, nc,e, S 89°58'16'' E, 756.36 feet, thence N 20 57 56 West to the Nort.h R/W line of said West Columbus Street; thence Northwesterly along said North R/W line of West Columbus Street to the centerline of San Dimas Street; thence S 0°01'44'~, along said ce~_terline of San Dimas Street to the True Point o~ Beginning.
