AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE
MIRqICIPAL CODE OF THE CITY OF BAKERSFIELD BY
CHANGING THE 1AND USE ZONING OF THAT CERTAIN
PROPERTY IN THE CITY OF BAKERSFIELD LOCATED
AT THE NORTHWEST CORNER OF FRASER ROAD AND
STINE ROAD.
WHEREAS, in accordance with the procedure set forth in
the provisions of Title 17 of the Municipal Code of the City of
Bakersfield, the Planning Commission and City Council have held
hearings respectively, on a petition to change the land use zoning
of that certain property in the City of Bakersfield located at the
northwest corner of Fraser Road and Stine Road; and
WHEREAS, the City Council has determined after due
consideration of said petition and the recommendations of the
Planning Commission herein on file, together with the reasons advanced
at the hearings for a change of zoning of said property, that a
zoning change should be authorized.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City
of Bakersfield as follows:
That: Section 17.12.020 (Zoning Map) of the Municipal Code
of the City of Bakersfield, be and the same is hereby amended by
changing the land use zoning of certain property in said City, the
boundaries of which property are shown on the map hereto attached
and made a part hereof, as follows:
Changing the zoning boundaries from an A (Agri-
cultural) Zone to an R-1 (One Family Dwelling)
Zone, and to an R-2-D (Limited Multiple Family
Dwelling - Architectural Design) Zone of that
certain property in the City of Bakersfield
located at the northwest corner of Fraser Road
and Stine Road, being more particularly described
as follows:
From an A (Agricultural) Zone to an R-1 (One
Family Dwell{ng) -Zone:
Ail that portion of the southeast quarter of Section
10, Twp. 30 S., Rge. 27 E., M.D.M., being more
particularly described as follows:
Commencing at the southeast corner of Section 10,
thence North 89035'29'' West, on and along the
South line thereof, 671.349 feet; thence leaving
said section line North 08°23'22'' East, 45.44
feet to'the point of intersection of the easterly
line of the Stine Canal with the northerly line of
Fraser Road, and the True Point of Beginning; thence
continuing northeasterly along said easterly line of
the Stine Canal the following courses North 08023'22''
East, 898.199 feet; thence North 83°55'30'' East,
20.65 feet; thence North 08023'22'' East to the
north line of the S~ of the SE~ of said Section
10; thence leaving said easterly line of the Stine
Canal North 89°39'04'' West 2070.06 feet; thence
South 00°04'20'' East, 827.822 feet; thence South
89035'29'' East, 334.995 feet; thence South 00°04'20''
East, 450.00 feet to said northerly line of Fraser
Road.; thence South 89°35'29'' East along said
northerly line of Fraser Road, 1524.585 feet to
the True Point of Beginning.
Containing 54.11 acres, more or less.
From. an A (Agricultural) Zone to an R-2-D
Limited Multiple Family Dwelling - Architectural
Design Zone:
All that portion of the southeast quarter of Section
10, Twp. 30 S., Rge. 27 East, M.D.M., being more
particularly described as follows:
Parcel #1: Commencing at the southeast corner
of Section 10, thence North 89035'29'' West, on
and along the South line thereof, 752.021 feet;
thence North 08023'22'' East, on and along the
westerly line of the Stine Canal, 1337.787 feet;
thence North 89°39'04'' West, 1969.066 feet to the
True Point of Beginning; thence continuing North
89039'04" West, 130.004 feet to the easterly line
of the southerly extension of Wilson Road; thence
South 00004'20'' East, on and long said Easterly
line 827.686 feet; thence South 89°35'29'' East,
130.005 feet; thence North 00°04'20'' West, 827.822
feet, more or less, to the True Point of Beginning.
Containing 2.47 acres, more or less.
Parcel #2: Commencing at the Southeast corner of
said Section 10, thence along the South line of
said Section 10 and the centerline 6f F~aser Road,
North 89°35'29'' West, 671.349 feet; thence North
08~23'22'' East, 45.440 feet to the North line of
Fraser Road and the True Point of Beginning; thence
continuing North 08°23'22'' East, 898.199 feet;
thence North 83°55'30'' East, 479.732 feet to a
point on the West line of Stine Road, being also
a point on a nontangent curve, concave to the
Southwest, having a radius of 2645.00 feet, from
which the radial point of said curve bears South
89°08'01'' West; thence southeasterly along said
curve and said West line of Stine Road through
a central angle of 0°47'14'', an arc distance of
36.34 feet; thence continuing along said West
line, south 00°04'45'' East, 887.196 feet to the
begi~nning of a tangent curve, concave to the
Northwest, having a radius of 20.00 feet; thence
southwesterly, along said curve, through a central
angle of 90°29'16'', an arc distance of 31.59 feet
to a point on the North line of Fraser Road; thence
along said North line of Fraser Road, North 89°
35'29" West, 589.484 feet, more or less, to the
True Point of Beginning.
Containing 11.39 acres, more or less.
I HEREBY CERTIFY that the foregoing Ordinance was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 26th day of March, 1973, by the following
vote:
