HomeMy WebLinkAboutORD NO 2103 ORDINANCE NO. 2103 NEW SERIES AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD BY CHANGING THE LAND USE ZONING OF THOSE CERTAIN PROPERTIES IN THE CITY OF BAKERSFIELD LOCATED ON THE EAST SIDE OF SAN DIMAS STREET, AND SOUTH OF WEST COLUMBUS STREET. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission and City Council have held hearings respectively, on a petition to change the land use zoning of those certain properties in the City of Bakersfield located on the east side of San Dimas Street, and south of West Columbus Street; and WHEREAS, the City Council has determined after due con- sideration of said petition and the recommendations of the Planning Commission herein on file, together with the reasons advanced at the hearings for a change of zoning of said property, that a zoning change should be authorized. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: That Section 17.12.020 (Zoning Map) of the Municipal Code of the City of Bakersfield, be and the same is hereby amended by changing the land use zoning of certain property in said City, the boundaries of which property are shown on the map hereto attached and made a part hereof, as follows: Changing the zoning boundaries from an R-2-D (Limited Multiple Family Dwelling - Architec- tural Design) Zone to a C-0-D (Professional Office) Zone to a C-1-D (Limited Commercial) Zone of 'those certain properties located.on the east side of San Dimas Street and south of West Columbus Street, being more particu- larly described as follows: All those portions within Sections 18 and 19, Twpo 29 S., R28E., M. D. M., in the City of Bakersfield, County of Kern, California, being more particularly described as follows: Changing the zoning from an R-2-D (Limited Multiple Family Dwelling - Architectural Design) Zone to a C-1-D (Limited Com.~Lercial) Zone: Beginning at a point of intersection of the south line of West Columbus Street (42nd Street) with the west line of the Pacific Gas and Electric Company Easement described in deed recorded May 2, 1950 in Book 1784, Page 258, said point being on a 1045.00-foot radius non-tangent curve, a radial from said point to the center of said curve bears N 29° 25' 29" E.; thence easterlyoalong said curve through a central angle of 7 54' 45", an arc distance of 144.31 feet; thence S 20° 36' 00" E., parallel with and 100.04 feet east as measured at right angles to said Pacific Gas and Electric Company west line, 109.70 feet; thence N 89© 58' 16" W, 292.91 feet to the east line of San Dimas Street; thence alon~ said east line the following courses: N 0u 91' 44" E, 140~00 feet to the beginning of a 170.00--foot radius tangent curve concave easterly; thence northerly along said curve through a central angle of 27© 07' 22" an arc distance of 80.48 feet; thence N 27° 09' 06" E, 8.35 feet to the point of intersection of said east line of San Dimas Street with said south line of Col~nbus Street, said point being on a 955.00-- foot radius non-tangent curve, a radial from said point to the center of said curve bears S 29° 17' 03" W; thence along said south line the following courses: easterly along said curve through a central.angle of 2° 01' 29", an arc distance of 33.75 feet; thence S 58° 41' 28" E., 50.00 feet to the beginning of a 1045.00--foot radius tangent curve concave northerly; thence easterly along said curve through a central angle of 1° 53' 03", an arc distance of 34.36 feet to the point of beginning. Containing 0.995 acres more or less. Changing the zoning from an R-2-D (Limited Multiple Family Dwelling - Architectural Design) Zone to a C-0-D (Professional Office) Zone: Commencing at the point of intersection of the south line of West Columbus Street (42nd Street) with the west line of the Pacific Gas and Electric Company Easement described in deed recorded May 2, 1950 in Book 1784, Page 258; thence S 20° 36' 00" E along said west line, 777.92 feet to the true point of beginning; thence S 89° 58' 16" E, 106.90 feet; thence S 20° 36' 00" E, 378.33 feet; thence N 89° 58' 16" W, 638.30 feet to the east line of San Dimas Street; thence N 0° 01' 44" E, along said east line 354.07 feet; thence S 89v 58' 16" E, 398.11 feet to the true point of beginning.
