HomeMy WebLinkAboutORD NO 2158 ORDINANCE NO. 2158 iNEW SERIES AN ORDINANCE OF THE COUNCIL 'OF THE CITY OF BAKERSFIELD AMENDING THE FIRST PARAGRAPH AND SUBPARAGRAPH (1) OF SECTION 3.22.030 OF THE MUNICIPAL CODE, PROVIDING FOR EMPLOYEE SALARIES WHILE ABSENT DUE TO INJURY IN COURSE OF DUTIES. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That the first paragraph and subparagraph (1) of Section 3.22.030 of Chapter 3.22 of Title 3 of the Municipal Code of the City of Bakersfield is hereby amended as follows: 3.22.030 Salaries While Absent Due to Injury In Course of Duties--Approval of Application--Cessation of Payments. Whenever any permanent City employees, other than a City employee covered by Section 4850 of the Labor Code of the State of California, is disabled by injury or illness arising out of and in the course of his duties, he shall be entitled to leave of absence while so disabled without loss of salary for the period of such disability as follows: (1) Commencing at the same time as disability payments pursuant to Labor Code Section 4650 begin, full salary to said employee for a period of time not exceeding one (1) year, during the time he is absent from duty on account of such injury and until his employment with the City is terminated or he is retired for disability or service under the Public Employees Retirement System or until said employee's rights to temporary disability are terminated by the Compensation Insurance Fund of the State of C.alifornia, whichever event shall first occur; provided, that such employee shall pay over to the City an amount equal to such payments as shall be received by him from such Fund for temporary disability for the time he is so absent from duty. SECTION 2. That this ordinance is not intended to change existing city law or practice providing for the payment of salaries to certain employees who are absent from work due to injury arising out of and in the course of employment but it is intended by this amendment to clarify Section 3.22.030 of this code and thereby continue such salary benefits in accordance with existing law and practice. SECTION 3.
