HomeMy WebLinkAboutORD NO 2151 ORDINANCE NO. 2151 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING THE BAKERSFIELD MUNICIPAL CODE BY REPEALING CHAPTER 7.14 AND SUBSTITUTING IN LIEU THEREOF A NEW CHAPTER 7.14, PROVIDING FOR REGULATIONS CONCERNING PRIVATE PATROL OPERATORS. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That the Bakersfield Municipal Code is hereby amended by repealing Chapter 7.14 of Title 7, and substituting in lieu thereof a new Chapter 7.14, to read as follows: Chapter 7.14 "PRIVATE PA,TROL OPERATORS" Sections: 7.14.010 "Private Patrol Operator" defined. 7.14.020 "Person" defined. 7.14.030 Unlawful to Wear Uniform Similar to Police or Firemen--Approval of Uniform. 7.14.040 Unlawful to Wear Badge Similar to Police or Firemen--Approval of Badge. 7.14.050 Color Scheme and Insignia on Vehicles. 7.14.060 Return of Identification Cards. 7.14. 070 Penalty for Violations. 7.14.010 "Private Patrol Operator" defined. A private patrol operator, or operator of a private patrol service, within the meaning of this Chapter, is a person who, for any consideration whatsoever: agrees to furnish, or furnishes, a watchman, guard, patrolman, or other person to protect persons or property or to prevent the theft, unlawful taking, loss, embezzlement, misappropriation, or concealment of any goods, wares, merchandise, money, bonds, stocks, notes, docu- ments, papers,, or property of any kind; or performs .the service of such watchman, guard, patrolman, or other person, for any of said purposes; or makes investigation or investigations that are incidental to the theft, loss, embezzlement, misappropriation, or concealment of any property, or other thing enumerated in this section, which he has been hired or engaged to protect, guard, or watch. The exemptions set forth in Section 7522 of the California Business and Professions Code apply hereto. 7.14.020 "Person" defined. For the purposes of this Chapter, the word "person" shall be held and construed to mean and include natural persons of either sex, firms, associations, partnerships and corporations. The singular shall include the plural and the masculine shall include the feminine. 7.14.030 Unlawful to Wear Uniform Similar to Police or Firemen-- Approval of Uniform. It shall be unlawful for any person to wear, or cause or permit to be worn, any uniform in the operation of a private patrol business that is so similar to the uniform used by the members of the Bakersfield Police or Fire Departments,- that such uniform could reasonably be mistaken for either. No uniform shall be worn by any private patrol operator in the City unless the same shall have been first approved by the Chief of Police as meeting the requirements of this section. 7.14.040 Unlawful to Wear Badge Similar to Police or Firemen-- Approval of Badge. It shall be unlawful for any person to wear or display, or cause or permit to be worn or displayed, any badge or insignia so similar in design to that used by members of the Bakersfield Police or Fire Department~ that such badge or insignia could reasonably be mistaken for either. No badge or insignia shall be worn~ displayed or used in any manner unless the same shall have been first approved by the Chief of police as meeting the requirements of this section. 7.14.050 Color Scheme and Insignia on Vehicles. It shall be unlawful for any private patrol operator to paint any vehicle used in his operation with such a color scheme that is similar in design or color of vehicles used by the Bakersfield Police Department, the California Highway Patrol, or the Kern County Sheriff's Department. No painted badges, stars or decalcomania of badges, stars or other insignia will be affixed on such vehicles used by a private patrol operator unless such badges, stars or insignia have first been approved by the Chief of Police. 7.14.060 Return of Identification Cards. All operators of private patrol systems shall forthwith return to the Bakersfield Police Department all identification cards issued to merchant patrol employees by the City. 7.14.070 Penalty for Violations. Any person violating any of the provisions of this Chapter shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine of not more than $500.00, or by imprisonment in the County Jail for a period of not more than six (6) months, or by both such fine and imprisonment. SECTION 2. This ordinance shall become effective thirty days from and after the date of its passage. o0o !
