HomeMy WebLinkAboutORD NO 2168 ORDINANCE NO. 2168 , NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD PROVIDING THE TIMING FOR PRESENTING PETITIONS FOR NOMINATION FOR THE SPECIAL MUNICIPAL ELECTION TO BE HELD IN THE SEVENTH WARD OF THE CITY ON JUNE 4, 1974, FOR THE PURPOSE OF FILLING THE VACANCY IN THE OFFICE OF CITY COUNCILMAN FOR THE REMAINDER OF THE UNEXPIRED TERM. WHEREAS, under Section 23302 of the Elections ~Code, providing for consolidation of City elections with statewide elections, it is required that the City file with the Board of Supervisors a resolution requesting consolidation, at least seventy-four (74) days prior to the date of election, and that the City file with the County Clerk the names of the candidates to appear upon the ballot no later than sixty-seven (67) days prior to the election; and WHEREAS, under Chapter 4.10 of the Municipal Code of the City of Bakersfield, providing for Special Elections, amend- ment or supplementation of nominating petitions may be as late as forty-five (45) days before the date of a special election; and WHEREAS, it is necessary to make special provision in the election procedure of the City, consistent with the Charter, in order that the names of the candidates to appear upon the ballot for Councilman may be filed with the County Clerk no later than sixty-seven (67) days prior to the election, which date is March 29, 1974. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Application of Ordinance This ordinance shall apply only to the Special Municipal Election to be held in the Seventh Ward of the City of Bakersfield on June 4, 1974. SECTION 2. Time For Presenting Petition For Nomination and Requirements The petition for nomination, in the form set forth in Section 69 of the City Charter, consisting of not less than twenty-five (125) nor more than fifty (50) individual certificates may be presented to the City Clerk's Office, not earlier than March 7, 1974, and not later than March 22, 1974. An employee of the City Clerk's Office shall endorse thereon the day, hour and minute when the petition was presented to such office. Each certificate must be a separate paper. Ail certifi- cates must be of a uniform size, as determined by the Clerk. Each certificate must contain the name of one signer thereto and the name of but one candidate. Each signer must be an elector, entitled to vote for the candidate named, and must not, at the time of signing a certificate, have signed any other certificate for the same office. In case an elector has signed two (2) or more conflicting certificates, all except the one first presented shall be rejected. Each signer must sign his name in the presence of the verification deputy, who must take oath before an employee of the City Clerk's Office, who shall be authorized to administer and certify oaths that the signatures thereto and each thereof, were made in his presence, and are genuine. It shall be the duty of the Clerk to furnish, upon application, a reasonable number of forms of individual certificates. In accordance with Section 68 of the City Charter, the candidate, not later than the first presentation to the Clerk of his petition of nomination, and not earlier than thirty (30) days before such presentation, shall file with the Clerk a declaration of his candidacy, in the form set forth in said Section 68 of the Charter. me SECTION 3. Examination of Petitions by City Clerk - Additional Nominating Petitions When a petition of nomination is presented for filing to the Clerk, he shall forthwith examine the same and ascertain whether it is sufficient under the provisions of the Charter. The Clerk shall attach to said petition his certificate, showing the result of said examination and forthwith deliver a copy of said certificate to the person seeking a nomination. If the petition be found insufficient, such certificate of the Clerk shall designate each individual certificate found to be defective and the defect therein. If the petition be insufficient, it may be amended or supplemented by the presentation of an additional nominating petition or petitions containing additional nominating certificates, not later than twelve o'clock noon on March 29, 1974, which is sixty-seven (67) days before the date of the Special Municipal Election. No amendments or supplementation shall be permitted after such hour and day. If the amended petition is found to be insufficient, and it is not possible to further amend or supple- ment prior to the deadline fixed herein, the petition shall be returned to the person seeking a nomination and his name shall not be placed on the ballot as a candidate. SECTION 4.
