HomeMy WebLinkAboutORD NO 2165 ORDINANCE NO. 2165 NEW SERIES AN ORDINANCE APPROVING ANNEXATION OF A PARCEL OF UNINHABITED TERRITORY TO THE CITY OF BAKERSFIELD, CALIFORNIA, DESIGNATED AS "SAN DIMAS NO. 4," AND PROVIDING FOR THE TAXATION OF SAID TERRITORY TO PAY THE BONDED INDEBTEDNESS OF SAID CITY. WHEREAS, a petition was filed with the Local Agency Formation Commission on the 6th day of August, 1973, requesting that certain uninhabited territory therein described be annexed to and incorporated within the City of Bakersfield; and WHEREAS, said petition was signed by the owners of all the land, by area, and by assessed value as shown on the last equalized assessment roll of the County of Kern; and WHEREAS, the territory described in said petition is contiguous territory to be annexed; and WHEREAS, the said territory does not form a part of any other city; and WHEREAS, prior to the date hereof there has been filed in the office of the City Clerk of the City of Bakersfield, a written consent, signed by the owners of the entire real property constituting the entire value of the territory, that said territory be subjected to taxation after the completion of such annexation equally with the property in the City of Bakersfield to pay the bonded indebtedness of said City therein described, as provided for in Ordinance No. 893, New Series, in Ordinance No. 950, New Series, in Ordinance No. 1112, New Series, in Ordinance No. 1229, New Series, in Ordinance No. 1364, New Series, and in Ordinance No. 1593, New Series, all of the City of Bakersfield, and any and all other i~debtedness or liability of the City outstanding or authorized on and after the date of completion of said annexation, and this Council hereby determines that said consent is signed by the owners of the entire real property constituting the entire value of the territory, and complies in every respect with the provisions of Section 35319 of the Government Code of the State of California; and WHEREAS, this ordinance is adopted pursuant to the pro- visions of Section 35015 of the Government Code of the State of California, providing for s~m~ary annexation of uninhabited territory where all owners of said territory consent to said annexation; that said annexation is prusuant to Chapter 1, Part 2, Division 2 of the Government Code of the State of California; that the Local Agency Formation Commission in Kern County has given its approval on the llth day of September, 1973, to said proposed annexation pursuant to Section 54797.1 of the Government Code of the State of California; and that the boundaries of the territory so proposed to be annexed to the City of Bakersfield are specifically described and set forth in this ordinance. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield, as follows: SECTION 1. That the City Council of the City of Bakersfield hereby approves the annexation to and inclusion within the incorporated limits of the City of Bakersfield, of that certain uninhabited territory designated as "San Dimas No. 4," and it is hereby further ordained that said territory be and the same is hereby annexed to said City; that said territory is described as follows: A parcel of land situate in the County of Kern, State of California, and being a portion of the southwest quarter of'Section 18, Township 29 South, Range 28 East, M.D.B.& M., and more particularly described as follows: Commencing at the centerline intersection of West Columbus Street, formerly 42nd Street, and Chester Avenue, said intersection bears N 75°19~38"E, 769.88 feet from the southwest corner of said Section 18, as shown on a map entitled '~etropolitan Recreation Center Proposed Lease To The Junior Baseball Association," being a map number 9 P1 MRC .le MI, as filed in the Office of the County Surveyor of said Kern County, thence N 00°17'12"E along the center- line of said Chester Avenue and northerly prolongation thereof, 651.75 feet; thence S 89°42'48"E 57.75 feet, to intersect the east right-of-way line of said Chester Avenue, said last-named point being the northwest corner of Block 699, Northern Division, as shown on a map entitled, "Northern Division of the Town of Bakersfield," filed April 26, 1889, in Book 1 of Maps, at Page 21, Kern County Records, said last-named point being in the Corporate Boundary of the City of Bakersfield and also the true point of beginning; Thence (1) departing from said Corporate Boundary, N 00°17'12"E, along the east right-of-way line of said Chester Avenue, 240.02 feet; Thence (2) departing from said east right-of-way line S 69°55'24"E, 403.14 feet; Thence (3) S 31°44'58"E, 57.97 feet; Thence (4) S 54°40'22'~, 88.5 feet, more or less, to intersect the Corporate Boundary of the City of Bakersfield; Thence (5) westerly, along the said Corporate Boundary, to the true point of beginning; Containing 1.49 acres, more or less. Said territory, and the property located therein, shall, upon the completion of the annexation of the same to the City of Bakersfield, be subjected to taxation equally with other property in the City of Bakersfield to pay the bonded indebtedness of the City of Bakersfield, described in the aforementioned consent of the owner§ of property, located therein, the issuance of bonds to represent said indebtedness being provided for in Ordinance No. 893, New Series, in Ordinance No. 950, New Series, in Ordinance No. 1112, New Series, in Ordinance No. 1229, New Series, in Ordinance No. 1364, New Series, and in Ordinance No. 1593, New Series, all of said City, and any and all other indebtedness or liability of the City out- standing or authorized on and after the date of completion of said annexation. SECTION 2.
