HomeMy WebLinkAboutORD NO 2180 ORDINANCE NO. 2180 NEW SERIES AN ORDINANCE OF THE COUNCIL OF THE CITY OF BAKERSFIELD AMENDING THE MUNICIPAL CODE BY REPEALING CHAPTER 7.32 AND SUBSTITUTING IN LIEU THEREOF A NEW CHAPTER 7.32 PROVIDING iREGULATIONS FOR PUBLIC POOL ROOMS IN THE CITY. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. That the Bakersfield Municipal Code is hereby amended by repealing Chapter 7.32 of Title 7, and substituting in lieu thereof a new Chapter 7.32, to read as follows: Chapter 7.32 PUBLIC POOL HALLS Sections: 7.32.010 Closing Hours 7.32.020 Permit; Application 7.32. 030 Revocation of Permit 7.32.040 Permitting Minors Where Alcoholic Beverage Sold Prohibited 7.32.050 Minors Prohibited Where Alcoholic Beverage Sold 7.32,060 Card Playing and Card Tables 7.32.~070 Penalty For Violations 7.32. 080 Severability 7.32.090 Posting Copy of Chapter 7.32.010 Closing Hours. It shall be unlawful for the owner, manager, employee or other person having charge of any public pool hall or room (defined as any place open to the public where billiards or pool is played), to keep the same open or allow or permit the same to be kept open or allow any of the games or amusements to be played or carried on therein between the hours of two a.m. and six a.m. of any day, or to allow any person, except the owner, manager, employee or person in charge thereof, to be or remain therein between the hours aforesaid. 7.32.020 permit; Application. No license to conduct, manage or carry on a public pool hall shall be issued to any person, firm or corporation, until a permit in writing therefor shall have been granted by the City Manager of the City of Bakersfield and filed with the City Clerk. No such permit shall be granted except upon the written application of the person, firm or corporation desiring the same, filed with the City Manager, stating the place where the billiard table or room, pool table or room is to be located, and no permit shall be granted to conduct, manage or carry on a public pool hall, which is not established and being conducted at the time this chapter takes effect, unless there shall be filed with the City Manager the written consent to the granting of the permit, of owners or tenants of a majority in frontage of property fronting on both sides of the street on which the establishment is to be located between the nearest intersecting streets. 7.32.030 Revocation of Permit. If at any time the City Council of the City of Bakersfield finds that any public pool hall is not conducted in such a way as may be proper and necessary for the maintenance of public order, or that such a place is not conducted in a lawful and orderly manner or that acts of any character con- trary to the proper police regulations or to the provisions of this Chapter, are permitted or are not prevented therein, the Council ma~ after notice given to the holder of said permit, or his authorized agent, cancel and revoke said permit and such decision shall be final and conclusive. 7.32.040 Permittin~ Minors Where Alcoholic Beverage Sold Prohibited. It shall be unlawful for any permittee, or any person, firm or corporation, his or their employees, servants or agents having charge, control or management of any public pool hall in the City of Bakersfield, wherein any alcoholic beverage is sold or served, to suffer or permit any person under the age of eighteen (18) years, except when in pursuit of some necessary business, to be in or remain in, enter or visit such pool hall. 7.32.050 Minors Prohibited Where Alcoholic BeVerage Sold. It shall be unlawful for any person under the age of eighteen (18) years to visit, enter or remain in or about any public pool hall where any alcoholic beverage is sold or served, except when in pursuit of some necessary business. 7.32.060 Card Playing and Card Tables. It shall be unlawful for any person, firm or corporation keeping, operating, maintain- ing or conducting any public pool hall, to have or permit any card tables or card playing of any description whatsoever, or to have, permit or allow any entrance to or from any place or room where card tables or card playing is permitted or carried on. 7.32.070 Penalty for Violations. Any person, firm or corpora- tion violating any of the provisions of this chapter shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be punished by a fine not to exceed Three Hundred Dollars ($300.00), or.by imprisonment in the County Jail of Kern County not to exceed ninety (90) days, or by both such fine and imprisonment. 7.32.080 Severability. If any section, subsection, sentence, clause or phrase of this chapter is for any reason held to be unconstitutional or invalid, such decision shall not affect the remaining portion of this chapter. The City Council hereby declares that it would have passed this chapter and each section and sub- section thereof, irrespective of the fact that any one or more of the sections, established, created, declared to be and shall be declared unconstitutional or invalid. 17.32.090 Postin8 Copy of Chapter. A copy of this chapter shall be kept posted in at least two (2) conspicuous places in every public pool hall in the City of Bakersfield. SECTION 2.
