AN EMERGENCY ORDINANCE OF THE COUNCIL OF THE
CITY OF BAKERSFIELD AMENDING SECTION 14.40.040(a)
OF THE MUNICIPAL CODE OF THE CITY OF BAKERSFIELD
CONCERNING APPLICATION REQUIREMENTS FOR SALE OF
SAFE AND SANE FIREWORKS.
BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
That subsection (a) of Section 14.40.040 of Chapter
14.40 of Title 14 of the Municipal Code of the City of Bakersfield
is hereby amended to read as follows:
(a) Any application for a permit shall be filed by an officer
of an eligible nonprofit organization or corporation or the operator
or authorized ~mployee of an eligible retail business establishment,
with the City Finance Director, hereinafter called the collector,
in person and in writing, between March 15 and May 15 of each year.
SECTION 2.
This ordinance is hereby declared to be an emergency
ordinance under Section 24 of the Bakersfield City Charter, for
the immediate preservation of the public health, peace, property
and safety. The facts giving rise to said emergency are as follows:
Several eligible nonprofit organizations and retail business
establishments which have previous experience in selling fireworks
under Chapter 17.40 of the Municipal Code have failed to complete
their applications, which failure would result in loss of revenue
for such charitable organizations and business establishments;
extension of the time for filing applications would enable present
and future eligible applicants more time to work out the details of
their individual projects and provide a more orderly procedure for
the application for and the granting of permits to sell safe and sane
fireworks within the City.
SECTION 3.
This emergency ordinance shall become effective immediately
upon its passage.

was passed and adopted by the Council of the City of Bakersfield at
a regular meeting thereof held on the 6th day of May, 1974, by the
