BE IT ORDAINED BY THE COUNCIL OF THE CITY OF BAKEP~F~, as
follows:
SECTION 1.'
The Council of the City of Bakersfield hereb~ Erants
to THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, a cox~pora-
tlon organized and i~corporated under the laws of the State of
Kansas, its successors and assigns, a permit to relocate, lay
down, construct~ maintain and operate trackage of standard
gauge for a railroad spur, being known and designated as Track
No. 9, along Truxtun Avenue in the City of Bakersfield, County
of Kern~ Sta~e of California. The cen~er lir~ of said track in
the p~oposed locatlon is described as follows, to wit~
commencing at a point on the northerly street
line of realigned Truxtu~ Avenue 343.92 feet
westerl~ f~om the southeasterl~ col~er of Block
142, said corner bein~ the northwesterly cor~er
of the intersection of Kex~ Street and realigned
Truxtun Avenue, thence southeaster12
along center line of proposed track 110.~6 feet
to point of curve~ thence eas~erl~ along a
6°05~1¥~ curve to the left 192.~5 feet to a
point in the southerl~ l~e of ~ealig~ed Truxtun
Avenue, thence easterly alone said aoutherl~
line of ~ealig~ed Truxtun Avenue 19.13 feet
~o the westerly line of Ker~ Street produced.
SEC~PION 2,
~at said permit and privilege is gra~ed
(a) To the use of said railroad trac~ for the
portation of freight for hire.

(b) That said railroad track must be laid to conform to
the grade of the street over which it passes, and the work must
be done to the satisfaction of the City Engineer of the City of
Bakersfield, and must be kept and maintained in good condition
and repair to the satisfaction of said City Engineer.
(c) That it must be operated under such restrictions
as not to interfere with the use of said street by the public.
(d) That this permit shall be revocable at the pleasure
of the City Council of the City of Bakersfield.
(e) To the provisions of the Charter of the City of
Bakersfield.
(f) To such regulations and conditions as may be
scribed from time to time by the Council of the City of Bakers,
field.
SECTION 3.
Ordinance No. 695, New Series, approved ~anuary 14,
1946, is hereby revoked.

and adopted by the Council of the City of Bakersfield, at a regu-
