HomeMy WebLinkAboutRES NO 66-98RESOLUTION NO. 6 6" 9 8 A RESOLUTION MAKING FINDINGS, APPROVING NEGATIVE DECLARATION AND ADOPTING PROPOSED AMENDMENT TO THE LAND USE ELEMENT OF THE METROPOLITAN BAKERSFIELD 2010 GENERAL PLAN (LAND USE ELEMENT AMENDMENT CASE NO. P97- 0216). WHEREAS, the Planning Commission of the City of Bakersfield, in accordance with the provisions of Section 65353 of the Government Code, held a public hearing on MONDAY, DECEMBER 15 and THURSDAY, DECEMBER 18, 1997 on a proposed amendment to the Land Use Element of the General Plan, notice of the time and place of hearing having been given at least twenty-one (21) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, the City of Bakersfield has applied for the proposed amendment to the Land Use Element of Metropolitan Bakersfield 2010 General Plan as follows: An amendment to the Metropolitan Bakersfield 2010 General Plan to incorporate land use changes and specific plan documents approved by the County of Kern which include Western Rosedale and the Rosedale Ranch amendment, McAllister Ranch, Pacificana, and Breckenridge Hills specific plans. This proposal is part of a concurrent action to approve an amendment to the city's sphere of influence. and WHEREAS, for the above-described amendment, an Initial Study was conducted, and it was determined that the proposed project would not have a significant effect on the environment, and a Negative Declaration was prepared and posted on October 24, 1997; in accordance with CEQA; and WHEREAS, the law and regulations relating to the preparation and adoption of Negative Declarations as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures have been duly followed by City staff and the Planning Commission; and WHEREAS, by Resolution No.108-97 on December 18, 1997, the Planning Commission recommended approval and adoption of GPA P97-0216 excluding the specific plans and land use changes for McAllister Ranch and Pacificana, and the Council has fully considered the findings made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Council of the City of Bakersfield in accordance with the provisions of section 65353 of the Government Code, held a public hearing on OR]GJNA~ WEDNESDAY, JANUARY 14, 1998, on the described proposed text amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan and moved to hear this matter with the first general plan cycle in 1998; and WHEREAS, the Council of the City of Bakersfield in accordance with the provisions of section 65353 of the Government Code, held a public hearing on WEDNESDAY, APRIL 22, 1998, on the described proposed text amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan notice of the time and place of hearing having been given at least (21) calendar days before said hearing by publication in the Bakersfield Californian, a local newspaper of general circulation; and WHEREAS, the Council of the City of Bakersfield continued the matter to the meeting of May 6, 1998 to allow consideration of this proposal by the Urban Development Committee; and WHEREAS, the Urban Development Committee met on April 23, 1998 and considered this proposal and the related Sphere of Influence amendment and recommended approval of GPA P97-0216 excluding McAllister Ranch, Pacificana, and Breckenridge Hills; and WHEREAS, the Council considered the recommendations of the Planning Commission and Urban Development Committee and hereby make the following findings: 1. All required notices have been given. The provisions of the California Environmental Quality Act (CEQA) have been followed. The proposed project will not have a significant effect on the environment. The environmental review performed for the subject GPA P97-0216 specifically considered and relied upon the Final Environmental Impact Reports conducted and certified by the County of Kern including the related specific plan for Western Rosedale and the Rosedale Ranch Amendment. NOW, THEREFORE, IT IS HEREBY FOUND AND RESOLVED AS FOLLOWS: 1. The above recitals and findings, incorporated herein, are true and correct. 2. The Negative Declaration for GPA P97-0216 is hereby approved. 3. The report of the Planning Commission, including all maps, reports and papers relevant thereto, transmitted by the Secretary of the Planning Commission to 2 ~? The City Council hereby approves and adopts P97-0216 of the proposed amendment to the Land Use Element of the Metropolitan Bakersfield 2010 General Plan, constituting land use changes as shown in the attached EXHIBIT "A" subject to LAFCO approval of Sphere of Influence amendment 1-97. 5. That P97-0216, approved herein, be combined with other approved segments described in separate resolutions, to form a single Land Use Element Amendment as the First quarter cycle. ......... 000 ........
