HomeMy WebLinkAboutRES NO 124-00RESOLUTION NO. ijX ~ 4 - 0 0 RESOLUTION SUPPORTING THE ORIGINAL INTENT OF SENATE BILL 332 WHEREAS, beverages containers included in California's redemption system have been successfully recycled for a decade at rates exceeding 75% and containers not included in the program are being recycled at a rate less than 25%; and WHEREAS, increased recycling diverts materials from landfill disposal and helps the City of Bakersfield and other jurisdictions meet their AB939 obligation to reduce landfill disposal by 50% by the end of the year 2000; and WHEREAS, SB332, passed by the California Legislature and signed into law by the Governor, expands the beverage container redemption system to include an additional 2 billion containers annually, beginning January 1, 2000; and WHEREAS, the provisions of SB332 were adopted after ample and comprehensive negotiations by stakeholder interest groups; and WHEREAS, the rules for recycling need to be simple and consistent so that California residents and retailers can easily understand them; and WHEREAS, because of the growth and diversity in the beverage market, authors of the legislation did not attempt to list all of the new types of beverages intended by the legislature to be included; and WHEREAS, the California Department of Conservation (DOC), which administers the beverage container redemption system, originally adopted a broad and inclusive interpretation of SB332, presuming that all beverages would be covered unless specifically excluded; and WHEREAS, under intense industry lobbying, the Administration pressed the DOC to change its interpretation of the law for the benefit of certain industries and to the detriment of residents and the California environment without allowing for any public input to the rulemaking process. NOW, THEREFORE, BE IT RESOLVED that the City of Bakersfield affirms its support for a broad expansion of California's beverage container redemption law and urges the Governor of the State of California to rescind his objections to full implementation of the letter and spirit of SB332. Specifically, the Governor is urged to include all beverage containers in the redemption program that were not specifically exempted by law, including plastic "pouches", and to accept the original processing fee recommendations of the DOC for containers newly added to the program.
