A RESOLUTION MAKING FINDINGS, APPROVING A NOTICE
OF EXEMPTION (GENERAL RULE) AND ADOPTING
PROPOSED AMENDMENT TO THE LAND USE AND
CIRCULATION ELEMENTS OF THE METROPOLITAN
BAKERSFIELD 2010 GENERAL PLAN (GENERAL PLAN
AMENDMENT P98-0146 ).
WHEREAS, the Planning Commission of the City of Bakersfield, in accordance
with the provisions of Section 65353 of the Government Code, held a public hearing on
MONDAY, MARCH 16, 1998, THURSDAY, MARCH 19, 1998 and APRIL 2, 1998, on a
proposed amendment to the Land Use and Circulation Elements of the General Plan, notice of
the time and place of hearing having been given at least twenty-one (21) calendar days before
said hearing by publication in the Bakersfield Californian, a local newspaper of general
circulation; and
WHEREAS, such proposed amendment to the Land Use and Circulation
Elements of Metropolitan Bakersfield 2010 General Plan is as follows:
GENERAL PLAN AMENDMENT P98-0146
The City of Bakersfield has applied to amend the Land Use and
Circulation Elements of the Metropolitan Bakersfield 2010 General
Plan consisting of a change to the Polo Grounds and Western
Rosedale Master Equestrian Trails. The amendment is proposed
to the west side of Jewetta Avenue adjacent to Rosedale Union
Middle School site;
and
WHEREAS, for the above-described amendment it was determined that the
proposed project would not have a significant effect on the environment, and a Notice of
Exemption (General Rule) was prepared; and
WHEREAS, the law and regulations relating to CEQA and City of Bakersfield's
CEQA Implementation Procedures have been duly followed by city staff and the Planning
Commission; and
WHEREAS, by Resolution No. 48-98 on April 2, 1998, the Planning Commission
recommended approval and adoption of this General Plan Amendment subject to the condition,
and this Council has fully considered the findings made by the Planning Commission as set
forth in that Resolution; and
WHEREAS, the Council of the City of Bakersfield, in accordance with the
provisions of Section 65355 of the Government Code, conducted and held a public hearing on
WEDNESDAY, APRIL 22, 1998, on the above described proposed amendment to the Land
Use and Circulation Elements of the Metropolitan Bakersfield 2010 General Plan, notice of time
and place of the hearing having been given at least ten (10) calendar days before the hearing
by publication in the Bakersfield Californian, a local newspaper of general circulation; and
WHEREAS, the Council has considered and hereby makes the following
findings:

1. The above recitals, incorporated herein, are true and correct.
2. All required public notices have been given.
This project is covered by the General Rule Section 15061(b) (3) in that
there is no possibility that the project may have a significant effect on the
environment, and is exempt from the California Environmental Quality
Act.
A Notice Of Exemption will be filed with the County Clerk when the
project is approved.
5. The proposed amendment is consistent with the surrounding land uses.
The proposed amendment is consistent with the surrounding land use
designations of the Land Use Element.
The proposed amendment is necessary to protect the health, safety and
welfare of elementary school age children.
That the Polo Grounds Master Equestrian trail is necessary on the west
side of Jewetta Avenue to maintain a consistent trail system along all of
Jewetta Avenue.
NOW, THEREFORE, BE IT RESOLVED and found by the Council of the City of
Bakersfield as follows:
1. The above recitals and findings, incorporated herein, are true and correct.
2. The General Rule Exemption, CEQA Section 15061 (b)(3) is hereby approved
and adopted.
3. The report of the Planning Commission, including maps and all reports and
papers relevant thereto, transmitted by the Secretary of the Planning Commission to the City
Council, is hereby received, accepted and approved.
4. The City Council hereby approves and adopts the proposed amendment to
the Land Use and Circulation Elements of the Metropolitan Bakersfield 2010 General Plan,
constituting of changes as shown on the map marked Exhibit "A", attached hereto and
incorporated as though fully set forth, for property generally located along the west side of
Jewetta, south of Noriega Road adjacent to Rosedale Union School District Middle School site
frontage, subject to condition of approval:
· Subject to signage to be approved by Public Works Director.
5. That General Plan Amendment P98-0146, approved herein, be combined
with other approved amendments described in separate resolutions, to form a single Land Use
Element Amendment.
