A RESOLUTION AUTHORIZING THE
NEGOTIATION AND EXECUTION OF AN
AGREEMENT FOR SERVICES REGARDING
MAKING THE CITY COUNCIL CHAMBERS
MORE ACCESSIBLE TO PERSONS WITH
DISABILITIES.
WHEREAS, the City of Bakersfield desires to make its City Council chambers more
accessible to disabled persons; and
WHEREAS, previously, City Council has authorized the expenditure of up to
$85,000 of Community Development Block Grant monies to accomplish the goal of making
the City Council chambers more accessible to persons with disabilities; and
WHEREAS, staff has determined that after the south wall is relocated, the council
dais, as well as other woodwork in the chambers will need to be redesigned and possibly
rebuilt to fit the new areas; and
WHEREAS, under federal law, an agreement for services or products under
$100,000 can be procured using an informal procurement procedure; and
WHEREAS, under federal law, agreements for architectural/engineering
services/products can be let without regard to price; and
WHEREAS, under Bakersfield Municipal Code section 3.20.060. D.1 authorizes
procurement of agreements in the open market without going out to formal bid; and
WHEREAS, staff disseminated a Request for Qualifications to various cabinet-
design businesses concerning the reworking of the woodwork; and
WHEREAS, because the time frame under which the reworking of the woodwork
must be done is very short, staff requests authorization to negotiate and execute an
agreement with the most qualified respondent without having to bring the agreement back
to Council for authorization.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
The City Manager or his designee is authorized to negotiate with companies
responding to the Request for Qualifications.

2. The Mayor is authorized to execute an Agreement created as a result of
those negotiations which does not exceed $85,000.
