Types,1 WHEN RECORDED MAIL TO: CITY OF BAKERSFIELD CITY CLERK 1501 TRUXTUN AVENUE BAKERSFIELD CA 93301 RESOLUTION NO. 060-02 A RESOLUTION ORDERING THE SUMMARY VACATION OF SUPERSEDED PORTIONS OF COUNTY ROAD NO. 912 (MORNING DRIVE) BETWEEN THE NORTH LINE OF PARCEL MAP NO. 2583 AND ALFRED HARRELL HIGHWAY. , QMé ~ ~" .~ ~ ~ S ORIGINAL RESOLUTION NO. 0 6 0 - 0 2 A RESOLUTION ORDERING THE SUMMARY V ACA TION OF SUPERSEDED PORTIONS OF COUNTY ROAD NO. 912 (MORNING DRIVE) BETWEEN THE NORTH LINE OF PARCEL MAP NO. 2583 AND ALFRED HARRELL HIGHWAY WHEREAS, Chapter 4, Article 2, Section 8335 of the Streets and Highways Code authorizes the City Council to summarily vacate certain streets, highways or public service easements by adoption of a Resolution; and WHEREAS, The City of Bakersfield Public Works Department, petitioned the Council for the summary vacation of the superseded portions of County Road No. 912 (Morning Drive) between the north line of Parcel Map No. 2583 and Alfred Harrell Highway in the City of Bakersfield, described more particularly as all ofthat portion of the 80 foot wide public road easement for County Road No. 912 (Morning Drive) per Kern County Board of Supervisors Viewers Report filed for record in Book 4772, Page 1132, Official Records, Office of the Kern County Recorder, situated in the southwest 1/4 of Section 5, southeast 1/4 of Section 6 and northeast comer of Section 7, T. 29 S., R. 29 E., M.D.M., City of Bakersfield, County of Kern, State of California, said portion of road easement being bounded southerly by the south line of the northeast 1/4 of said Section 7 and bounded northerly by the south right-of-way line of County Road No. 2239 (Alfred Harrell Highway). RESERVING THEREFROM, for public road easement purposes, any portion of the above described County Road No. 912 lying within the 110 foot wide public road right-of-way for Morning Drive deeded to the City of Bakersfield in compliance with the City's MORNING DRIVE SPECIFIC PLAN LINE, approved by City Resolution No. 144-95 adopted September 13,1995;and WHEREAS, the subject portions of public road easements are eligible for summary vacation on the basis that the easement portions have been superseded by relocation and no other public facilities are located within the road easement portions pursuant to Section 8330 of the Streets and Highways Code; and WHEREAS, the public road easement portions are unnecessary for present prospective public purposes; and WHEREAS, the Planning Commission, at its meeting on March 21, 2002, considered and found that the proposed vacation is consistent with the Metropolitan Bakersfield 2010 General Plan. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: -1- ,*\lMê~ ç'" ~ ô ~ ORIGINAL 1. All the foregoing recitals are found to be true and correct. 2. The proposed vacation is consistent with the Metropolitan 2010 General Plan. 3. In accordance with Section 8330 of the California Streets & Highways Code, the public road easement in the City of Bakersfield described more particularly in the above recital has been superseded by relocation and therefore may be summarily abandoned by the legislative body. 4. The action herein taken is exempt from the requirements of the California Environmental Quality Act pursuant to Section 15061 (b)(3) of CEQA guidelines (general rule), because there is no possibility that the action may have a significant effect on the environment. 5. Pursuant to Chapter 4, Article 2, Section 8335 of the Streets and Highways Code, the above-described portions of public road easement are hereby abandoned and from the date of recordation of this Resolution shall no longer constitute public road easements. 6. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under the seal of the city, to be recorded in the Office of the County Recorder of the County of Kern, California. ----------000---------- I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the City Council of the City of Bakersfield at a regular meeting thereof held on APR 24 2002 , by the following vote: AYES, NOES, ABSTAIN, ABSENT COUNCILMEMBER CARSON.
