A RESOLUTION OF THE COUNCIL OF THE
CITY OF BAKERSFIELD ADOPTING THE
STREET CUT WORKMANSHIP AND
PERFORMANCE WARRANTY FEE
WHEREAS, Chapter 12.16 of the Bakersfield Municipal Code requires
that the City Council adopt a resolution establishing a workmanship and
performance warranty fee for street cuts; and
WHEREAS, this workmanship and performance warranty fee was last
amended on October 16, 2002; and
WHEREAS, this workmanship and performance fee is intended to pay for
the cost of resurfacing a City street subject to street cuts; and
WHEREAS, the Construction Cost Index has increased by 18.38% since
2002; and
WHEREAS, additional regulatory issues have caused the City of
Bakersfield's costs on resurfacing City streets to increase in excess of the
Construction Cost Index; and
WHEREAS, the City Council desires to adjust this fee to recover the City
of Bakersfield's costs in resurfacing streets.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
1. The above recitals are true and correct and are incorporated
herein.
2. That the fee schedule for the workmanship and performance
warranty fee set forth as Exhibit "A" is hereby approved and
adopted.
3. The effective date of this resolution shall be July 24, 2006.
